Judge seeks freedom for child murdering rapist
SANTA CRUZ (AP) - The state's oldest California Youth Authority inmate was in court again in a bid for freedom.
Donald Schmidt, 34, was a 16-year-old kid high on methamphetamines when he sodomized a 3-year-old girl and drowned her in a bathtub at a Lompico house where he was a guest in 1988.
Another good reason to make capital punishment available in juvenile cases involving special circumstances.
He was convicted entered CYA, where juveniles are typically not held beyond age 25. "He's a danger to others," said Dr. Elaine Mura, a prison psychologist.
But not quite dangerous enough for some idiot judge not to try and free him.
On Tuesday, Superior Court Judge William Kelsay decided a jury should decide if Schmidt is a danger to society. A jury trial was set for Dec. 19. "I feel very bad. I'm not sure if the system's meeting his need," said Kelsay,
