Justice Department Sues Yale Claiming Admissions Discrimination Against Whites And Asian-Americans

[Forbes] The U.S. Department of Justice has filed a lawsuit against Yale University, alleging it violated civil rights law by discriminating against white and Asian-American students in its admissions process, in the latest step President Donald Trump’s administration has taken in opposition to affirmative action.

  • The DOJ filed the lawsuit Thursday in federal district court in Connecticut, where it claimed that Yale’s "oversized, standardless, intentional use of race has subjected domestic, non-transfer applicants to Yale College to discrimination on the ground of race."

  • Yale has been under investigation by the DOJ since 2018, after a complaint was filed by the Asian American Coalition for Education claiming discrimination in Yale’s admissions process.

  • In August, the DOJ said its probe found that race was a "determinative factor" in hundreds of admissions decisions per year, and it asked that Yale submit a plan within two weeks describing how it would eliminate race and national origin from its admission process.

"Because Yale claims that its race discrimination is necessary to admit sufficient numbers of racially-favored applicants, mostly Black and Hispanic applicants, Yale signals that racially-favored applicants cannot compete against Asian and White applicants," the lawsuit said, according to the Journal. "This kind of race discrimination relies upon and reinforces damaging race-based stereotypes."

KEY BACKGROUND
In 2017, the Civil Rights Division of the DOJ announced it would investigate and file lawsuits against universities using race as part of admissions. That move was followed up in 2018, when the Trump administration rescinded a policy put in place under President Barack Obama calling for race to be a considering factor in college admissions. The Trump administration has also pushed to end the consideration of race in admissions at Harvard University, while the Department of Education sent a letter to Princeton University last month demanding documents in order to inspect whether the elite university engages in discriminatory practices.
