Seattle man, 48, is arrested after standing outside Democrat Pramila Jayapal's house with a GUN and 'telling her to 'go back to India' ' - before being freed due to a 'lack of evidence'

- Police said he was standing in the street with a holstered Glock handgun
- Jaypal had called 911 to report a man outside hurling obscenities
- Neighbor claimed he said 'I'm going to kill you' and 'Go back to India'
- But prosecutors say they're still seeking hard evidence of the slurs and threats
- Forsell was released on Wednesday after no charges were filed after 72 hours
- But he could still face state or federal charges as the investigation continues
