#4 Given that a couple of New York federal judges went the other way in similar cases, we're going to see enough conflicting case law that eventually the USSC will have to take a look. I fear the outcome. For me it's easy: Congress and the Executive branch can't use "administrative hearings" and procedures to circumvent constitutional guarantees regarding counsel, right to confront witnesses, and examine evidence in an adversarial hearing in which there is an accuser and a defendant. Particularly true if there are penalties attached to the defendant, and even more true if the hearing is guided by a letter issued by a Federal bureaucracy with a desired outcome. |

#2 Some of these extra-judicial campus courts seem to me a bit like Sharia courts. Criminal behavior should be the province of the criminal courts not the PC kangaroo courts. |

#1 It isn't designed to be. You are male, therefore you are guilty. Glad to see at least one judge in California still has a small bit of legal sense. Well... until they are torn down by the twitter mob and run from the state in shame. |
