Trump kicked off Colorado ballot in 14th Amendment case

[The Hill] Colorado’s highest court on Tuesday knocked former President Trump off the state’s Republican primary ballot under the 14th Amendment in a 4-3 ruling, making it the first state to block him from seeking the presidency because of his role in the Jan. 6, 2021, Capitol attack.

The court put its ruling on hold until Jan. 4, so Trump can first seek review from the U.S. Supreme Court. Trump’s spokesperson quickly vowed to do so, meaning Trump’s name automatically remains on the ballot until the justices in Washington resolve the appeal.

In a major legal blow to Trump, the Colorado court affirmed he engaged in insurrection by inflaming his supporters with false claims of election fraud and directing them to the Capitol — preventing him from a second White House term under the 14th Amendment’s “insurrection clause.”

The state justices determined that the office of the president is covered under the insurrection clause, which specifically lists those who previously took oaths to support the Constitution as “a member of Congress,” “officer of the United States,” “member of any State legislature” or an “executive or judicial officer of any State.” The district court had ruled that the office of the president was not covered under the clause.

#10  Even if SCOTUS overturns this decision, it is at the very least harassment. It is costly and distracting for any candidate to appeal this nonsense and it's happening all the time wherever we have liberal justices who believe their ideology is more important than the Constitution. How do you prosecute a judge for insurrection?

#2  Never gonna stick. Even the lower judge said the congress or an officer of the government (see speaker of the house and such) must declare the person in a state of insurrection. Suddenly the rubber stamp "Supreme" court of CO says, yeah insurrection. Trial balloon and posturing. Little more.

On the other side I would be happy to kick off the Civil war here.
