[Al Arabiya] Fighting between the army and one of the main Darfur rebel groups is intensifying ahead of a referendum on southern independence that could change the map of Sudan and the balance of power between the warring parties.
The Justice and Equality Movement and pro-government forces have crossed swords several times in the past five days, after months of relative calm.
On Wednesday, JEM clashed with police in South Darfur, who were escorting a convoy of nearly 100 lorries to south Sudan, with 37 police potted in the fighting and an estimated 60 dead among the rebels, according to U.N. officials.
The interior ministry said the rebels had attacked a fuel and supplies convoy, while JEM said government forces had hit its positions.
"Our forces shot down a MiG warplane this afternoon at 4:30 pm (1330 GMT) near al-Majrour in North Kordofan," senior JEM commander Suleiman Sandal told AFP late on Monday.

"All the kidnapped expatriates are well and in our safe custody, " it added. "All the fighters who participated in this attack have safely returned to base," MEND said.
"Within the next 24hrs, we will release the names of all expatriates currently being held in our different camps," it added.
A separate report quoted a company official saying that Seven foreign hostages were taken, modifying the previous number of five. It also said two Indonesian victims had been confirmed.

[Al Arabiya] A U.S. judge held a hearing Monday on CIA targeting of key terrorist suspects as a lawyer for the father of radical U.S.-Yemeni holy man Anwar al-Awlaki argued it was unconstitutional for his son to be on a "kill list."
U.S. District Judge John Bates heard arguments in the case on the same day that a video of Awlaki calling for the killing of Americans "without hesitation" was posted on cut-thoat websites.
President Barack B.O. Obama's administration has refused to officially acknowledge the existence of a assassination program but sources have told AFP that Awlaki is on a "capture or kill list."
Nasser al-Awlaki argues that his son, an American citizen suspected of being a leader of al-Qaeda in the Arabian Peninsula and of instigating a string of attacks against the United States, still has a constitutional right to due process.
Jameel Jaffer, a lawyer for the American Civil Liberties Union, which along with the Center for Constitutional Rights has taken Awlaki's case, accused the U.S. government of imposing the death penalty without trial.
The administration is empowered to use lethal force against American citizens deemed an imminent threat to national security and wants the case thrown out on the basis that such matters are not the realm of the courts.
"Your honor, if an injunction is issued here, it provides to the leader of al-Qaeda (in the Arabian Peninsula) the ability to continue planning operations" against the United States, a government lawyer said.
Yemeni authorities, under mounting U.S. pressure to fight al-Qaeda after a foiled air cargo bomb plot, charged Awlaqi last week with alleged ties to al-Qaeda and ordered his arrest by any means possible.
The Yemen-based branch of al-Qaeda has grabbed credit for the parcel bomb plot and said it was also behind the September downing of an American cargo plane in Dubai, according to the SITE Intelligence Group.

How is going after him any different than going after OBL, Zarqawi, Saddam or any other terrorist who is trying to murder us?
Anwar al-Awlaki is a US Citizen. OBL, Zarqawi, and Saddam are not. Having the President ordering the extermination of a US citizen simply because he thinks he is a threat is unconstitutional. I believe it's called due process. However, there is a solution. P2K lists the legal basis above. But first he must be designated as an enemy combatant and/or strip him of his citizenship. Then have the military (Not the CIA) take him out. This is prolly the basis for recent reports about special ops hanging with the Spooks in Yemen.

During WW2 a number of US citizens got caught on the wrong side of the Ocean by Pearl Harbor. Many of them got drafted by the other side.
Nobody needed specific authority to take them out. They were enemy combatants, citizens or not. Awlaki has recruited people to kill Americans, and announced the desire to kill more. If he is not an enemy, I don't know who is.

al-Awlaki's case is unprecendented. He is the first US citizen to be targeted for assassination even while no warrant for his arrest has been issued in the US. His imminent threat status is because of his influence on others and may incite future violence. Can you say slippery slope?

I think this is a bit far from the slope - he did it first, a US citizen calling for the death of other US citizens.
Besides, he knew what he was getting into and revoked his own US citizenship when pledging alliegence to this non-state armed political group responsible for numberour man made disasters or WTF ever it is called now. Point is, him being a US citizen still is or should be only a paperwork formality.
The slippory slop I see is having a US citizen as a SOP in leadership or personal bodyguard, gonna see a lawsuit every dronezap, snatch and grab, etc.

If al-Awlaki were not a native born citizen the decision would be simpler for stripping him of citizenship and then targeting him for his terrorist activities.
Sen. Lieberman proposed legislation that would enable the stripping of citizenship from a citizen if they engaged in terror activities. There was considerable pushback on the issue.
The Supreme Court in 1958 upheld a citizenship-stripping law in Perez v. Brownell. But then in 1967, the Warren Court overruled Perez by a 5−4 vote. The court held that Congress cannot strip anyone of citizenship unless that person voluntarily renounces it.
In the 1980 case of Vance v. Terrazas, the Supreme Court split the difference, moving back in the opposite direction. The Court modified its 1967 holding to clarify that in addition to renouncing American citizenship verbally or in writing, a person can renounce their citizenship by their conduct. The Court also held that whether their conduct amounts to renouncing citizenship can be determined by a preponderance of the evidence, meaning that the odds only need to be better than 50−50, instead of a higher standard such as proof beyond a reasonable doubt.
The law seems to be somewhat murky with regards to the stripping citizens of there citizenship rights.
Citizens should have concerns about citizenship rights being stripped from citizens too easily.

With Rahm back in Chicago perhaps I can be more comfortable, but the thought of the Federal government identifying individual U. S. citizens for termination by hit squads without due process of law does not make me sleep well at night and is not that far down the slope. Consider the domestic violence now occurring in EUrope. We are not that far away from that here if we do not get our fiscal house in order. How far would a New Black Panther Party go and how far could the USG go to stop them once this precedent is established?
The AUMF authorizes combat. If Awlaki dies in combat, such are the fortunes of war. But, this kind of activity, targeting a U. S. citizen individually without due process, is right on the edge overseas, and over the edge in CONUS. It is particularly troubling that this is being done without the participation of the legislative branch in formulating the law necessary to give the President such immense authority. Awlaki should be told to turn himself in for criminal prosecution or stripped of his citizenship before he is made a target.
Penguin, if they do that, and put it on pay-per-view, we could easily pay off the national debt with the proceeds.

There is no "slippery slope" or any other bullshit. Awlaki has declared war on the United States and Americans, here and elsewhere. This is an act of rebellion, and can be suppressed without any other paperwork being necessary. Awlaki is in rebellion against the legitimate government of the United States, and is therefore a target. Pops and the ACLU should go play "chicken" on the local Interstate - in dark clothes, on a moonless night, miles from any light source.

Awlaqi and his relative, Othman al-Awlaqi, have been charged in absentia with "incitement to kill foreigners and members of security services" -- charges that arose during the trial of Hisham Assem, who allegedly bumped off Jacques Spagnolo, an employee of energy firm OMV, in October. Prosecutors have said that Awlaqi corresponded with Assem for months, encouraging him to kill foreigners.
Mohammed al-Saqqaf, a lawyer for both Awlaqi and Othman, told the court on Tuesday that they had no "connection or contact" with Assem, and that he also did not know where Awlaqi was. "No one knows where Anwar al-Awlaqi is because if he revealed his location he would be jugged and thrown in prison without a specific charge," Saqqaf said.
The court in Yemen, under mounting US pressure to fight Al-Qaeda after a foiled air cargo bomb plot, on Saturday ordered the arrest by any means of Awlaqi and Othman for alleged links to the terror group. "In the end, one other person -- a Brit described by OMV as an expert who worked at the company's branch office -- was maimed in the October 6 attack Assem allegedly carried out.
Judge Mohsen Alwan said the court will further consider the case after the Mohammedan Eid al-Adha celebration due to start on November 16, but did not specify a specific date.

Details have emerged from the Mexican Navy operation to capture Gulf Cartel Matamoros commander Antonio Guillen that shows a coordinated operation using electronic means and interrogations leading to a massive seizure of men and munitions in the area.
According to "Narcoblog" posts, Guillen escaped the initial encounter at 1100 hrs last November 5th only to be located by means of electronic intercept six hours later in the same city, and ultimately killed by elements of the Mexican Army and Navy.
For more than six months, a Mexican Navy operation concentrated on capturing Guillen beginning with an initial encounter on March 31st of this year against Guillen's security team which led to capture of three armed suspects. Information obtained from the arrests was used in subsequent operations.
On April 7th, a second encounter took place in Matamoros ending with the capture of three more armed suspects, weapons, cash and cars.
From the April 7th arrest, the Mexican Secretaria de Defensa (SEMAR) found out that Guillen's security team was dubbed Los Escorpiones, Scorpions, a security/enforcer group heavily armed with armored vehicles, grenades and trained snipers.
On September 14th, a Mexican Marine operation took place when SEMAR found Guillen was at a residence on Calle Mexico in the Rios colony near the US border.
Before the cordon could take place, however, military reinforcements were attacked by presumed Gulf Cartel elements. The ensuing firefight led to a toll of one Mexican Marine dead and one Gulf Cartel member captured. Rantburg's report on the action can be read here. Other residences Guillen used as safe houses were found following the September operation.
On November 1st, SEMAR found out that Guillen was spending the night at a residence on calle Canal in the Expo Fiesta Oriente colony. But when units of the Mexican Marines arrived, Guillen slipped through the cordon to escape.
Marines found a large munitions cache including more than 69,000 rounds of ammunition and 230 40mm grenades. Rantburg's report on the November 1st action can be read here.
It was erroneously reported that Guillen died in the 1030 hours encounter. That initial encounter was apparently an intergang firefight near Plaza Fiesta, which was reported by residents in the area, but before the Navy could arrive another firefight took place at 1100 hrs between elements of the Mexican Army and armed groups on calle Valle del Inca in the Centro colony. That encounter cost the life of one Mexican soldier and Mexican photojournalist Alberto Guajardo Romero of the Expresso de Matamoros.
Commanders on the ground following that battle received reports that Guillen was on the move in Matamoros, so a request was made for communications intercepts.
Guillen was located on Calle Abasado. At 1430 huge force of 660 effectives, 17 vehicles and three helicopters was sent to the area, where they were fired on by Guillen's security detail.
A three hour firefight took place where heavy weapons such as hand grenades and RPGs were used against military forces. Guillen's security team used armored vehicles and snipers to attempt to rescue him, but ultimately failed with the death of Guillen ad four members of his security team.
In the aftermath, Mexican military forces captured 47 Gulf Cartel members, seized 92 rifles, 12 pistols, 27 hand grenades, more than 111,000 rounds of ammunition, two rocket launchers, an RPG, 518 porters, close to a million pesos in cash and 44 cars.

"A VAZ-2101 car boom was found in Vtoraya Street, which contained a 65-litre canister with a mixture of ammonium nitrate and aluminum powder, as well as destructive agents: bolts, nuts and pebbles," the information center of the National Anti-Terrorist Committee (NAK) told Itar-Tass.
"The remotely controlled homemade bomb weighed some 70 kilograms," NAK said.

[Geo TV] KOHAT: A vital commander of outlawed Tehreek-e-Taliban Pakistain said his outfit is not involved in kidnapping of Ajmal Khan, Vice Chancellor of Islamia College University Beautiful Downtown Peshawar, Geo News reported Tuesday.
Tariq Afridi, Taliban Commander for Darra Adamkhel and Khyber Agency, said this in an interview.
He said the TTP kidnapped Kohat University of Science and Technology's Vice Chancellor Lutfullah Kakakhel some days back, who was released after demands were met.
He said Lutfullah was released after the government had set free 50 of their accomplices and paid the ransom money.
Afridi said he received reports that Ajmal was lifted by Wazoo's Taliban.

BAGHDAD / Aswat al-Iraq: One civilian was killed and ten more were wounded in four explosions in western Baghdad, a security source said on Tuesday.
A booby-trapped car went off on Tuesday evening (Nov. 9) near the Islamic party headquarters in al-Amal al-Shaabi street in al-Aameriya region, western Baghdad, killing a civilian and injuring six, the source told Aswat al-Iraq news agency.
Three bombs exploded in al-Mansour neighborhood, western Baghdad, injuring four citizens, he added.

NINEWA / Aswat al-Iraq: Army forces seized on Tuesday a depot during a security operation in central Talafar, western Mosul, an official army source said.
A force from the 10th brigade of the 3rd division of the Iraqi army seized on Tuesday evening (Nov. 9) a depot, which includes 60 mortar shells, in al-Saray region, central Talafar, the source told Aswat al-Iraq news agency.
Acting on information from a detained gunman, the forces found the depot in a deserted house, he explained. Three bombs went off in central marketplace in Talafar, without leaving casualties."
Talafar is 60 km west of Mosul, the capital of Ninewa, which lies 405 km north of Baghdad.

Two bombs targeted at a passing IDF patrol exploded along the Israel-Gaza border Wednesday. The unit, made up of armored and engineering units as well as paratroopers, suffered no casualties.
After the blasts, Israeli helicopters were called in and opened fire, according to reports. A third bomb was uncovered, which the IDF destroyed in a controlled explosion.
Islamic Jihad has claimed responsibility for the attack.
Incidents of church attacks and religious violence are spreading throughout Java, outside of traditional "hot spots" such as Greater Jakarta and West Java, activists said on Sunday.
The latest violent incident occurred in Sukoharjo, Central Java, on Oct. 13, when 12 people on motorcycles set fire to a Protestant church, said Theophilus Bella of the Jakarta Christian Communication Forum (FKKJ), which documents sectarian violence in Indonesia.
A day before, an attempt to set fire to St. Joseph Catholic church in Klaten, Central Java, was foiled and caused only minor damage, he said in a report made available to The Jakarta Post. On Oct. 17, radical Muslims threatened to attack a Catholic church in Karanganyar, Central Java.
Last month, an unidentified group attacked a Catholic church in Pasir regency, East Kalimantan, it said.
Most of the incidents over the last several years took place in Greater Jakarta and West Java, including attacks and forcible church closures that occurred with little or no intervention from the government, the report said.
According to the FKKJ, officials of Lubuk Linggau, Sumatra, said Huria Kristen Indonesia (HKI) congregation members lacked an official permit and could not conduct religious activities in their church, in apparent response to complaints from local residents.
The FKKJ said religious violence in Indonesia has escalated since the country gained independence in 1945. Between 1945 and 1967, two churches were set on fire. Between 1967 and 1969, after former president Soeharto took power, 10 attacks were recorded.
Church attacks soared to 460 between 1969 and 1998, after Soeharto's government issued a joint ministerial decree on establishing places of worship, which was seen as favoring the nation's Muslim majority.
After the start of the reform era in 1998, the number of cases skyrocketed to 700, bringing the total number of church attacks between 1945 and 2010 to 1,200.
"It's not wrong to say that Indonesia is the world champion of church burnings," Theophilus said.
Catholic priest Benny Susetyo, executive secretary of the Indonesian Bishops' Council, said that the attacks were due to weak law enforcement.
"Terror has increased due to negligence on the part of law enforcement officials," he said. Benny added that violence against the churches had continued since perpetrators could act with impunity.
"This is dangerous because violence may escalate in other areas," he said, adding that narrow-minded local administrations were also partly to blame.
Hendardi from the Indonesian human rights watchdog Imparsial said that attacks on religious groups in Central Java and other places were copycat attacks based on incidents in Greater Jakarta and West Java.
Imparsial said West Java had the most cases of violence perpetrated against minority religious groups. "The attacks, especially in West Java, which have yet to be properly handled by the government, have set a bad precedent," he said.
