Military selects rarely used charge for Bergdahl case
[WAPO] RALEIGH, N.C. -- Military prosecutors have reached into a section of military law seldom used since World War II in the politically fraught case against Army Sgt. Bowe Bergdahl, the soldier held prisoner for years by the Taliban after leaving his post in Afghanistan.

Observers wondered for months if Bergdahl would be charged with desertion after the deal brokered by the U.S. to bring him home. He was -- but he was also charged with misbehavior before the enemy, a much rarer offense that carries a stiffer potential penalty in this case.

"I've never seen it charged," Walter Huffman, a retired major general who served as the Army's top lawyer, said of the misbehavior charge. "It's not something you find in common everyday practice in the military."

Bergdahl could face a life sentence if convicted of the charge, which accuses him of endangering fellow soldiers when he "left without authority; and wrongfully caused search and recovery operations."

Huffman and others say the misbehavior charge allows authorities to allege that Bergdahl not only left his unit with one less soldier, but that his deliberate action put soldiers who searched for him in harm's way. The Pentagon has said there is no evidence anyone died searching for Bergdahl.

"You're able to say that what he did had a particular impact or put particular people at risk. It is less generic than just quitting," said Lawrence Morris, a retired Army colonel who served as the branch's top prosecutor and top public defender.

Yeah, but a lot of commanders and their JAG advisers could also be charged similarly. Article 99 of the UCMJ -

(8)willfully fails to do his utmost to encounter, engage, capture, or destroy any enemy troops, combatants, vessels, aircraft, or any other thing, which it is his duty so to encounter, engage, capture, or destroy; or

(9)does not afford all practicable relief and assistance to any troops, combatants, vessels, or aircraft of the armed forces belonging to the United States or their allies when engaged in battle;

Man arrested with 160 kg of explosives in Kunar

A statement issued by NDS on Sunday states that the kabooms were concealed in a 'Suzuki' vehicle and were brought from across the border.

NDS statement adds that Jahanzib was arrested while driving the truck to deliver these materials to Manogai District for making roadside and magnetic bombs.

NDS has also released a video with the statement purportedly showing the arrested man 'Jahanzib'.

"My name is Jahanziib, my father's name is Shah Mahmood, I am a resident of Asmar District," he said. "These kabooms were handed over to me in Shelton by Khan, who told me to deliver the materials to Nangalam, on the bridge a man will be waiting for you, you have to give them hand over to that man."

This comes as Kunar province is witnessing severe insecurity these days.

Hundreds of snuffies attacked several security posts in Manogai and Chapa Dara districts on yesterday.

During the clash, a rocket fired by Taliban landed on a house in Chapa Dara district leaving a woman and three of her children dead.

14 Taliban Insurgents Killed in Attack on Security Posts in Kunar
[Tolo News] At least 14 Taliban bandidos Death Eaters were killed in an attack on security posts in eastern Kunar province

on Saturday, local officials said.

In addition, 23 other bandidos Death Eaters were maimed during the festivities.

The incident took place in Mano Gai and Chapa Dara districts of the province after more than 500 Taliban bandidos Death Eaters attacked the posts. However they were met by a large-scale response from security forces, provincial police chief Abdul Habib Sayedkhili said.

"An Afghan security soldier was also killed in the attack along with 14 Death Eaters." Sayedkhili said. "The Taliban bandidos Death Eaters also torched eight shops and four civilian houses in Chapa Dara," he added.

He said that the bandidos Death Eaters have since fled the area.

officials at the local hospital said: "Eight civilians and four soldiers who were maimed in the attack have been transferred to the central hospital -- where a woman died from her injuries."

The Taliban bandidos Death Eaters have grabbed credit for the attack but said they have taken control of a number of posts in the district.

Kidnapped army officer found dead
[Libya Herald] An army officer who was kidnapped three days ago in Tripoli’s Drebi district has reportedly been found dead. Colonel Musbah Al-Daudi Al-Warshefani had shot a number of times and there are said to be torture signs on his body. It had been dumped in Siyad district on the western edge of the capital. The reason for his abduction and murder is unknown.

The Saudi-led coalition says it does not target civilian facilities. But on Saturday, at least 27 members of two families were killed in Sanaa by air strikes targeting Houthi positions in the city, according to hospital officials.

Coalition warplanes struck military bases on the capital's Nahdain and Fajj Attan hills and the neighboring presidential complex, south of Sanaa, as well as a headquarters for special forces.

Also targeted were Huthi positions in the northern areas of Sufan and al-Nahda, forcing scores of residents to flee, as well as rebel positions near the Saudi and Emirati embassies, witnesses said.

Elsewhere, coalition warplanes hit rebel positions in Bayhan, in the southern province of Shabwa, military sources said.

In the neighboring province of Baida, 27 people were killed -- 14 rebels, 10 loyalist fighters and three civilians -- in two days of coalition raids on the town of Mukayris, military sources said.

Belgium holds Cairo flight over 'suspect' passenger
[AlAhram] A scheduled Brussels-Cairo flight by the Egyptian airline Egyptair was cancelled on Saturday because of suspicious behaviour by a passenger, Belgian police said.

Egyptair flight MS 726 was denied clearance for take off to let security "re-examine the passenger list and baggage", the federal police said in a brief blurb.

"In the light of uncertainties about a passenger and as a matter of precaution, the flight cannot takeoff until security services are able to carry out wider checks," it said.

The Phlegmish-language newspaper Het Nieuwsblad said that the passenger was detained for questioning after saying "something's going to happen" on the flight.

Frederike Geerdink, a freelance journalist who reports on Kurdish issues, wrote on her Twitter account Sunday that she was taken into custody in the town of Yuksekova.

She added that she was with "a human shield group," who are all in jug, and that she expected to be questioned by the prosecutor "today or tomorrow."

Geerdink was also arrested last January, accused of disseminating terrorist propaganda and acquitted of those charges in April.

Two British journalists from Vice News were released this week after they were arrested on terror charges while reporting from the city of Diyarbakir, the bastion of Turkey's Kurdish region and the outlawed Kurdistan Workers' Party (PKK).

Kurdish militants claim deadly ambush, Turkish jets retaliate

In a statement posted online, the outlawed Kurdistan Workers' Party (PKK) said its guerrillas had ambushed the convoy of armored vehicles in Yuksekova district, in what could be the bloodiest assault since the collapse of a ceasefire in July.

"An attack from several sides left 15 soldiers dead, and a large number of weapons were seized in the action," the statement read.

The number of casualties could not be independently verified but in a televised statement President Tayyip Erdogan confirmed an incident had taken place in Hakkari province, close to Turkey's borders with Iran and Iraq.

Prime Minister Ahmet Davutoglu, who had been watching the national soccer team playing in the city of Konya, left the stadium early to return to the capital as news of the attack broke.

A security bigshot told Rooters that Turkish jets had retaliated, hitting at least 10 PKK targets, including those behind the ambush.

Arms cache of 'political party's militant wing' seized
[DAWN] KARACHI: Pakistain Rangers, Sindh, on Saturday claimed to have seized a huge cache of arms and ammunition in Landhi, dumped by the "militant wing of a political party", said a statement.

Though the statement did not carry the name of the political party behind the dumping of the arms, the paramilitary force said that with the seizure of the arms it had "averted a major terrorist activity in the city".

"A volunteer law-abiding citizen belonging to a political party, who denounces terrorism, guided Pakistain Rangers to recover the arms," said the statement.

"According to details, Pakistain Rangers Sindh conducted a surgical action in Al-Burq Gymkhana, Landhi, and recovered a huge weapons cache. The weapons and ammo was to be used to carry out sporadic murders and other sabotage activities in the city from a hard boy wing of a political party."

The seized arms included a 12.7 gun with mound, a rocket-propelled grenades launcher, a 7mm rifle, an 8mm rifle, a pump action 12 bore rifle, a revolver, 40 Avan bombs, 2,730 rounds of light-machine gun and 640 rounds of sub-machine gun, added the statement.

Attacks in KP leave two councillors dead
[DAWN] Two councillors and another man were killed and two others injured in a bomb kaboom in Hangu and firing in Kohat district on Saturday.

Iraq Puts New F-16s into Action against IS Jihadists

"Fifteen air strikes were carried out in the past four days," Staff Lieutenant General Anwar Hama Amin told AFP following a news conference in Baghdad.

"Smart weapons" were used in the strikes, Amin said, without specifying the type.

Defense Minister Khaled al-Obaidi told the news conference that the strikes had achieved "important results" and that the jets will have "an impact on the conduct of operations in the future."

Amin told the news conference that the F-16 strikes had taken place in Salaheddin and Kirkuk provinces, north of Baghdad.

The first four Iraqi F-16s arrived from the United States in mid-July, out of a total of 36 Washington has agreed to sell to Baghdad.

The purchase had been a source of tension, with Baghdad repeatedly complaining that they have not been delivered quickly enough.

Insecurity in Iraq, where IS seized significant territory in June 2014, had delayed the delivery of the jets, with the first batch being sent to Arizona, where Iraqi pilots have been training.

An Iraqi pilot was killed when his F-16 crashed during training in Arizona earlier this year.
Hopefully his Breitling survived the crash. Good Navitimers are getting hard to find.
F-16 jets are much more sophisticated than other aircraft in Baghdad's arsenal and will boost Iraq's capacity for air strikes, which are currently carried out by aging Sukhoi Su-25 jets, Cessna Caravan turboprop aircraft and various helicopters.

But with foreign aircraft from the international anti-IS coalition also carrying out strikes against the jihadists on a daily basis, the delivery is not seen as a game changer in the war against the Lion of Islams.

ISIS governor killed in Tal Afar
[Rudaw] The US led coalition carried out Arclight airstrikes on ISIS positions in Tal Afar on Saturday, reportedly killing the ISIS governor of the Jazira region bridging northern Syria and Iraq.

Issa Zewai, the commander of the 4th Peshmerga Brigade on the Shingal front, told Rudaw that "lately the US coalition war planes have intensified their attacks on ISIS military bases and positions, destroying ISIS vehicles and targeting a strategic line where ISIS attacks Peshmerga by directing mortar shells."

Zewai added that during the coalition Arclight airstrikes many ISIS fighters were reportedly killed, including Hazm Klash, the Jazira governor.

Abu Nahal was chosen by the PRC back in 2010 to commit a suicide kaboom on Israeli targets on the Israeli-Egyptian border and received special coaching to that end, added the Shin Bet, and that year left the Gazoo Strip for Sinai through a tunnel in preparation for an attack on a bus next to Eilat -- but the plan failed for various reasons.

Last year, Abu Nahal was recruited into the radical Salafist faction linked to ISIS, according to the Shin Bet. An indictment was issued against him last week at the Be'er Sheva Magistrate's Court.

He is accused of the following offenses: Contact with an outside agent, membership and activity in an unlawful association, forbidden military training, weapons offenses, conspiracy to murder and attempted murder.

Hamas naval commando drowns in training accident off Gaza coast
A member of the naval commando unit of Hamas's military wing, the Kassam Brigades, drowned in a training accident on Sunday off the coast of Gaza, the group announced.

The Hamas naval commando was named as 27-year-old Nabil Marine, from Beit Lahia in the northern Gaza Strip.

Three NPA militants surrender in Mindanao
Three New People's Army militants have surrendered in Zamboanga del Sur province. Military spokesman Lieutenant Colonel Audie Mongao identified the surrenderees as Erme Elnas, Anselma Quijano, and Lodevico Nadal Jr., all are members of the NPA's Western Mindanao Regional Party Committee.

Four Thai soldiers injured in bomb blast
[The Nation] Four soldiers were injured when their pickup truck was caught in a bomb explosion in Pattani province. The troops had been returning to their base in Kapho district when their pickup was hurled 50 meters by the blast. The bomb had been planted on a motorcycle and sidecar that had been stolen two years ago.

One source said authorities think the attack may have been the work of the Runda Kumpulan Kecil (RKK).

Respected imam gunned down in southern Thailand
[Anadolu] A Muslim leader in southern Thailand who had survived a previous attack was gunned down Saturday in Pattani province. Dormeng Benjaewan, the 76-year-old imam of the Payonok Mosque in Saiburi district, was shot several times by a suspect riding pillion on a motorcycle in front of a food store. He was taken to a local hospital where he died from his injuries.

Benjaewan had been respected among local residents and had worked with Thai offiials to resolve the decades-long insurgency that has been destabilizing the three southernmost provinces.

Saturday's attack came as the military government is holding peace talks with Mara Pattani, an umbrella movement grouping six different insurgent factions. Some analysts, however, have expressed doubts about the degree of control of Mara Patani has on the insurgents active on the ground, where the main movement is the Barisan Revolusi Nasional (BRN, National Revolutionary Front).

Bomb attacks kill 12 in Syria's Damascus, Idlib
[EN.ZAMANALWSL.NET] At least 12 people were killed Sunday when the Syrian regime targeted opposition-held towns in the provinces of Damascus and Idlib with vacuum bombs and explosive-laden waste containers, according to civil defense sources.

At least six non-combatants were killed, and dozens injured when the Syrian regime jets dropped vacuum bombs on a residential area in the town of Arbin in Eastern Ghouta, an opposition-held region east of the capital Damascus, a civil defense source told Anadolu Agency.

Three buildings were completely destroyed in the attack, and the locals were helping the civil defense teams in search-and-rescue efforts, the source said.

A separate attack carried out by Syrian army helicopters in the town of Ariha south of Idlib killed at least six others, another local civil defense source said.

Dozens were maimed in the attack on a residential area with explosive-laden waste containers, the source said.

"Six buildings were destroyed in the attack, with dozens of others suffering major damage," he added.

Assad forces have reportedly been using explosive-filled waste containers lately instead of barrel bombs, since they are more effective and easier to make, according to local sources.

Syria says militant confesses to car bombs that killed dozens in south
[IN.REUTERS] Syrian state media said on Sunday that an Islamist Lion of Islam had confessed after his arrest to being behind two boom-mobile blasts that killed 37 people in the south of the country on Friday, including a Druze leader.
