Exclusive -- Jeff Sessions Orders Look into ‘DOJ Slush Fund’ Payments to Leftists

[BREITBART] An internal Department of Justice memorandum obtained by Breitbart News Friday indicates Attorney General Jeff Sessions is trying to get to the bottom of the DOJ "slush fund" for left-wing groups he dismantled in June.

The memo asks all components of the DOJ to recount the last ten years of payments made to non-governmental organizations as third parties in settlements and provide that information to Associate Attorney General Rachel Brand, the number three Justice official. These "cy pres" payments were a long-standing policy of having mostly corporate defendants, for example in a civil rights suit, agree to pay into charities as part of their settlement with the government to avoid further prosecution.

In recent years, especially during the B.O. regime, the practice increasingly funneled funds to left-wing "community organizing" groups such as the now renamed National Council of La Raza, or "The Race," a Latino racial advocacy group that supports mass illegal immigration. Congressional Republicans and conservative groups decried the payments for years, often characterizing the system as a "slush fund" for leftists but, since they were made under the auspices of the Department of Justice using broad, decades-old legislation, it was difficult to rein in.

Attorney General Sessions, however, put a stop to the payments unilaterally in June, issuing a department-wide memo prohibiting all payments to third parties in settlements not under three narrow exceptions, for example, genuine victim compensation. The announcement was widely heralded as a victory by conservatives.

The new memo, dated July 28, goes further, commanding DOJ attorneys to look back into the history of these settlements and report back every payment that would not meet the new standards laid down in June. Payments agreed to but not yet paid out are also to be identified. Every component is to be reported to Associate Attorney General Brand by the end of the month.

#2  Corporations were required to pay Jizya (slush fund) to the government for settlements (probably out-of-court) to make the allegations go away. The Jesse Jackson model writ large. That money was then doled out to leftwing and radical organizations such La Raza (and most likely Acorn) and others. "We the people" end up paying the freight in the way of higher prices and losses in jobs and lost commerce and lost representation. Is it time for the pitchforks yet?

Wasserman Schultz talks about arrested aide Imran Awan

"I believe that I did the right thing, and I would do it again," Wasserman Schultz said Thursday in an exclusive interview with the Sun Sentinel. "There are times when you can’t be afraid to stand alone, and you have to stand up for what’s right.

"It would have been easier for me to just fire him," she said.

As the former Democratic National Committee chairwoman, Wasserman Schultz is the most prominent Democrat who employed Awan. Her decision to keep employing Awan has been under fire from her Democratic primary challenger, Republicans and multiple conservative websites. They’ve suggested Wasserman Schultz is hiding something and the Awan matter is much more serious than she’s letting on.

His arrest, the congresswoman said, had nothing to do with the months-long investigation of Awan as an IT worker for a variety of members of Congress. An FBI affidavit filed with the criminal complaint said Awan and his wife claimed a property used to secure a home equity line of credit was a "principal residence," when it was, in fact, a rental property. Wasserman Schultz said there still hasn’t been any evidence presented that he’s done anything wrong involving his work for Congress.

And, she said, she believes he may have been put under scrutiny because of his religious faith. Awan is Moslem.

Awan, his wife and brothers worked for years for various members of Congress, including Wasserman Schultz. He was a so-called shared employee, with each office paying a part-time salary.

In February, Wasserman Schultz said, chiefs of staffs for members of Congress were told that Awan was under investigation and his access to the House network was suspended. House payroll records show that multiple members of Congress terminated Awan quickly, early in February.

Instead of firing him, Wasserman Schultz said her office worked with the House chief administration officer to develop a job description that "would allow him to continue to do work ... until such time as there were other charges brought or we had some evidence that there was something that was produced that warranted further action."

Even without access to the IT network, Wasserman Schultz said, "there are plenty of technological issues that an IT person can assist with. He didn’t have access to the network, but he was able to give us guidance and advice and troubleshoot on a wide variety of other technological issues." IT isn’t limited to computer network issues, she said; it includes phones, printers, the website and helping people with software.

"I had grave concerns about his due process rights being violated," she said. "When their investigation was reviewed with me, I was presented with no evidence of anything that they were being investigated for. And so that, in me, gave me great concern that his due process rights were being violated. That there were racial and ethnic profiling concerns that I had," she said.

Wasserman Schultz said the chiefs of staff were told that Awan and his family members were having their access to the House IT network cut off because they were under investigation for "procurement violations and data transfer violations." Wasserman Schultz said from what she has been able to discern the data transfer issue doesn’t involve anything sinister.

Former Director of National Intelligence James Clapper Says He and Susan Rice Both ‘Did Unmaskings'
[Breibart] Former Director of National Intelligence James Clapper admitted on CNN that he has unmasked Americans during his time under the Obama administration, and defended doing so.

"So I did unmaskings during my six-and-a-half years at DNI, Susan did as well, and it was not done for political purposes whatsoever," he said.

He also said National Security Adviser H.R. McMaster was "right" to approve Rice for a top secret security clearance in April, despite President Trump criticizing her for unmasking his campaign associates.

"Good on General McMaster, he’s a great soldier and he’s done exactly the right thing here," Clapper said.
A Jim Clapper endorsement? I'll bet McMaster is cringing.
Clapper pointed out that "there’s no criminal activity connected with unmasking." Clapper did not address, however, how classified intelligence with unmasked Trump associates made its way to the press, which is illegal.

A conversation former National Security Adviser Michael Flynn had with Russian Ambassador Sergei Kislyak was illegally leaked to the Washington Post in February.

Sally Yates, the former deputy attorney general under the Obama administration, admitted in May that Flynn was indeed unmasked, and said she discussed documents in which Flynn was unmasked with other members of the intelligence community.

Clapper further defended unmasking Americans swept up in foreign surveillance, even those their identities are shielded for moral, legal and privacy reasons.

"And I should explain that the nexus, the start of unmasking is a valid foreign intelligence target, and when that valid intelligence target is observed engaging with a U.S.person, it is perfectly appropriate, and in fact, I would argue irresponsible not to understand the significance and the context, and the only way you can do that is to know who it is," he said.

#8  The Foreign Intelligence Surveillance Act of 1978 ("FISA" Pub.L. 95–511, 92 Stat. 1783, 50 U.S.C. ch. 36) is a United States federal law which prescribes procedures for the physical and electronic surveillance and collection of "foreign intelligence information" between "foreign powers" and "agents of foreign powers" suspected of espionage or terrorism).[1] The Act created the Foreign Intelligence Surveillance Court (FISC) to oversee requests for surveillance warrants by federal law enforcement and intelligence agencies. It has been repeatedly amended since the September 11 attacks.

Generally, the statute permits electronic surveillance in two different scenarios.

Electronic surveillance

Without a court order[edit]

The President may authorize, through the Attorney General, electronic surveillance without a court order for the period of one year, provided that it is only to acquire foreign intelligence information,[5] that it is solely directed at communications or property controlled exclusively by foreign powers,[6] that there is no substantial likelihood that it will acquire the contents of any communication to which a United States person is a party, and that it be conducted only in accordance with defined minimization procedures.[7]

The code defines "foreign intelligence information" to mean information necessary to protect the United States against actual or potential grave attack, sabotage or international terrorism.[5]

"Foreign powers" means a foreign government, any faction of a foreign nation not substantially composed of U.S. persons, and any entity directed or controlled by a foreign government.[8] The definition also includes groups engaged in international terrorism and foreign political organizations.[9] The sections of FISA authorizing electronic surveillance and physical searches without a court order specifically exclude their application to groups engaged in international terrorism.[10]

A "U.S. person" includes citizens, lawfully admitted permanent resident aliens, and corporations incorporated in the United States.

"Minimization procedures" limit the collection of information concerning United States persons by protecting their identities and requiring a court order to retain the communications for longer than 72 hours. The communications can be retained without court order if there is evidence of a crime. Identification of a US person, known as "unmasking", may also be authorized if an agency believes it is necessary in order to understand the intelligence or believes that the person was committing a crime.[11]

The Attorney General is required to make a certification of these conditions under seal to the Foreign Intelligence Surveillance Court,[12] and report on their compliance to the House Permanent Select Committee on Intelligence and the Senate Select Committee on Intelligence.[13]

Since 50 U.S.C. § 1802(a)(1)(A) of this Act specifically limits warrantless surveillance to foreign powers as defined by 50 U.S.C. §1801(a) (1),(2), (3) and omits the definitions contained in 50 U.S.C. §1801(a) (4),(5),(6) the act does not authorize the use of warrantless surveillance on: groups engaged in international terrorism or activities in preparation thereof; foreign-based political organizations, not substantially composed of United States persons; or entities that are directed and controlled by a foreign government or governments.[14] Under the FISA act, anyone who engages in electronic surveillance except as authorized by statute is subject to both criminal penalties[15] and civil liabilities.[16]

Under 50 U.S.C. § 1811, the President may also authorize warrantless surveillance at the beginning of a war. Specifically, he may authorize such surveillance "for a period not to exceed fifteen calendar days following a declaration of war by the Congress".[17]

With a court order[edit]

Alternatively, the government may seek a court order permitting the surveillance using the FISA court.[18] Approval of a FISA application requires the court find probable cause that the target of the surveillance be a "foreign power" or an "agent of a foreign power", and that the places at which surveillance is requested is used or will be used by that foreign power or its agent.[2][19] In addition, the court must find that the proposed surveillance meet certain "minimization requirements" for information pertaining to U.S. persons.[20] Depending on the type of surveillance, approved orders or extensions of orders may be active for 90 days, 120 days, or a year.[21]

Illinois Establishes ‘Barack Obama Day'
[Daily Caller] Republican Illinois Gov. Bruce Rauner signed a bill Friday establishing August 4 as "Barack Obama Day."

The 44th president received the honor from his home state on his 56th birthday. The bill passed through both chambers of the state legislature without any dissenting votes.

"August 4th of each year is designated as Barack Obama Day, to be observed throughout the State as a day set apart to honor the 44th President of the United States of America who began his career serving the People of Illinois in both the Illinois State Senate and the United States Senate, and dedicated his life to protecting the rights of Americans and building bridges across communities," the bill states.

#12  This is nothing more than a coup attempt by the DC elites. Why are the republicans not striking out??? Why are they defending and siding with the Dems. Short answer is they are putting their political control of this nation above the peoples wishes. They do not serve We the people. They are attacking the very leader we elected. They are using a special council with a grand jury to isolate and destroy the president in the same fashion that was used in Columbia to capture Pablo Escobar. They will pull in every person that has ever done business with Trump into the grand jury. The antics will be public. They will make wild accusations and charges. A defense by the accused is not permitted, by law. Don't believe it? Look it up. They are going to turn honest men and women into scapegoats for crimes they did not commit. And why are they doing this? There has yet to be evidence of a crime? This is the systematic tearing apart of an individual in the hopes of finding some dirt. In the hopes of stopping the president from performing his duties. When you act like this its because you cant have an outright coup, so you bind him up in a legal fishing trip. Last question, how many of you that read this could stand this level of investigation, and the level of lies with zero ability to defend yourself????

Acosta Pulls the Media’s Mask Off
[SPECTATOR.ORG] It is impossible to overstate the partisan jackassery of CNN, which is at once a product of the cynical, ratings-driven scumbaggery of its head Jeff Zucker and the pretentious liberalism of its "news hounds," almost all of whom come from Democratic circles. What an astonishing collection of frauds. With their anchormanish baritones, they try to hoodwink viewers into thinking they are "serious" journalists. But they are all just liberal activists playing news hounds on TV. Jake Tapper was a Dem staffer. So was Jim Sciutto. Ace newshound Christiane Amanpour, last heard lecturing journalists on the need to drop "neutrality" in its coverage of Trump, is married to former Clinton staffer James Rubin. And the list goes on and on.

Out of this ethos came Jim Acosta, who, thanks to Trump, has justly become the face of fake news. Acosta’s hectoring of Stephen Miller on Wednesday -- behavior indistinguishable from a La Raza activist at a Trump rally -- confirms once again the journalistic bankruptcy of Jeff Zucker’s CNN. Acosta doesn’t need any encouragement to be a demagogic jerk, but Zucker has no doubt flashed that green light to him. (By the way, where are the successors to the Kalb brothers to tsk-tsk Zucker for his complete abandonment of "objective" journalistic conventions in pursuit of the cheapest of entertainment values? That even those old charades no longer occur is itself proof of the media’s status as an unapologetic opposition party.)

But conservatives should thank Acosta for pulling off CNN’s mask completely. It reveals the face of an exceedingly dumb and arrogant liberal. Poets, according to the windy adage, are the unacknowledged politicians of mankind. But Acosta on Wednesday was determined to turn Emma Lazarus into an acknowledged one. He demanded to know why the Trump administration wasn’t using her poem as the organizing principle of immigration policy.

Of course, he wasn’t literate enough to use her name. He had the "Statue of Liberty" voicing her poem. Miller had to point out to him that the poem wasn’t part of the original Statue of Liberty, a correction the media resented terribly (it spawned a spate of stories dunning Miller for his lack of appreciation for the poetry of Lazarus).

It became quickly apparent that Acosta was out of his depth, as Miller gave him a brief tutorial on the history of America’s immigration policy. My favorite moment came when Miller responded to the lazy retort of Acosta -- What policy am I advocating? -- by saying: "unfettered immigration." That’s exactly what he is demanding. Acosta in effect wants the Statue of Liberty renamed the Statue of Open Borders, with perhaps a worthy poetic successor to Emma Lazarus made head of the INS.

Acosta was too much of a dummy to grasp Miller’s point -- that liberty and open borders can’t coexist, with the loss of that liberty hitting the poorest, including legal immigrants colonists, the hardest.

#4  It seems CNN is owned by Time Warner company which is soon to be merged with AT&T and that AT&T may sell CNN to CBS. IMHO, CBS does a better job of pretending to be objective but that only makes them more dangerous.

Sessions DOJ Blocks Sanctuary Cities from Police Assistance Program
[BREITBART] Attorney General Jeff Sessions banned sanctuary cities from participating in a federal public safety program.

In a statement through the Department of Justice (DOJ), Sessions said sanctuary cities would not be allowed to participate in the Public Safety Partnership program until they prove that they have properly dropped their status and made efforts to reduce violent crimes by illegal aliens.

"By protecting criminals from immigration enforcement, cities and states with so-called ’sanctuary’ policies make all of us less safe," Sessions said in the statement. "We saw that just last week, when an illegal alien who had been deported twenty times and was wanted by immigration authorities allegedly sexually assaulted an elderly woman in Portland, a city that refuses to cooperate with immigration enforcement."

#1  Had we had an immigration policy over the years that made sense and was enforced, there would be no sanctuary cities. There are also too many people on the left who embrace Soros' "Open Society, Open Borders" policies. Look to Europe for what happens when open borders is actually implemented.
