#4 The question is who's going to do the hammering. Double jeopardy is suppose to prohibit being tried for the same crime twice.

#7 The issue isn't double jeopardy if they are charged with AWOL while in civil custody. Article 15 describing such absence should be a career ended or bar to reenlistment.

#10 Double jeopardy doesn't actually play here.
You get charged in civilian court, and then charged by the JAG's office with the same thing, with "while a sworn member of the US military".
Seen it in person.
In real life the civilian court frequently defers to the military, usually because what the mil hands out generally rates as felony grade punishment, way past what the civilian court can do in what is almost certainly a first offense.

#11 Low on sugar? Case out of Ft Leavenworth. Officer/student accused of throwing his wife over a balcony at a hotel where a dinner was being held. Locals demanded to prosecute. It was given to them. They botched it. He got off. However, in the proceedings it was brought out that he was having an affair with someone not his wife. Court Martialed on that court record. Tried to claim double jeopardy. Not.
