#3 This highlights one of the differences between crime and terrorism. Even though someone has Bank Robber on their resume, we don't (normally) throw them in jail until after the fact. With terrorists, given the mass casualties that make terrorism such good theater, waiting around is generally a bad idea. Western legal systems evolved to deal with crime, not terror. Attempting to treat terror as crime runs into all sorts of problems.
