#2 actually being in the Senate (or House for that matter) gives immunity for anything done in a speech by the Constitution (Art 1, Sec 6) and courts have expanded that to cover all 'legislative acts'

there are various, not entirely consistent ruling by different courts on what is a 'legislative act'

I don't know about that. I just saw what seemed like an air-tight case against Hillary outlined by Comey essentially "disappear" after Slick Willy had a secret meeting with Lynch in an airplane in Phoenix.

#4 I believe the senate immunity only applies when the speech is done on the Senate floor. Harry Reid used to be very careful to make his various accusations from the senate floor.
