#2 It's simple. You don't have a valid ID, you fill out a paper ballot which is enclosed in a envelope with your claimed ID information. If the election is close enough, then the voter information is validated before being opened and counted in the final numeration for the election.

1 - they still get the vote.
2 - the information is validated prior to counting.
3 - the unvalidated votes show you why there are ID requirements.

Implicit in the Judge's Scenario is that a person who did not have ID will have, mirabile dictu!, sufficient ID in the future.
