#4 James, you obviously never dealt with the Maricopa County Prosecutor's Office in Phoenix. I know of at least five instances where some brilliant legal mind there said that two or more tons of rolling, accelerating steel was not an "instrumentality of the crime" when the police wanted to charge someone with aggravated assault. I used to think that it was probably some sterling graduate of Taco Tech de Tucson who didn't like cops making that stupid decision, but maybe it's standard nationwide. |

#3 "Police officers shall not discharge their firearms at or from a moving vehicle unless deadly force is being used against the police officers or another person present, by means other than a moving vehicle." So a car is not a deadly weapon. Interesting. Counterintuitive. |
