US to take land for Flight 93 memorial mosque by eminent domain
2009-05-08
One man inherited property that his grandfather bought during the Depression. A Lutheran pastor owns a cottage where he planned to retire with his wife. Two others own businesses.

But they and other property owners in rural southwestern Pennsylvania knew things would change in the aftermath of United Flight 93's crash on Sept. 11, 2001, which killed 40 passengers and crew and four terrorist hijackers. Plans were soon in the works for a memorial to honor the victims. Property owners say they realized that and were willing to cooperate and help make it happen.

But now that the government intends to take their land by eminent domain so the Flight 93 memorial can be built by the 10th anniversary of the terrorist attacks, property owners say they're disappointed and surprised by the plan.

#12   ION E.D. PAKISTANI DEFENSE FORUM [paraph]> VIDEO: TRUTH STILL LIVES - US LAWMAKER, POTUS CANDIDATE RON PAUL SAYS US DRONE ACTIONS INSIDE PAKISTAN ARE ILLEGAL US ATTACKS AGZ A SOVEREIGN COUNTRY.

Actually, they are legal U.S. attacks against a sovereign nation, JosephM. Dr. Paul is a sweet hearted idiot. Given that Pakistan refuses to act against their citizens and guests (Taliban, Al Qaeda, etc) conducting attacks against Afghanistan, another sovereign nation, Afghanistan and its allies are justified in pursuing the attackers back home, even into another country. Those who host bad guys are complicit in the bad actions and get to share the punishment.

#8  Give the feds an inch, and they'll take your entire yard, spend all of your money, spend you deeply in debt, prohibit you from supporting yourself and your family, take away your freedom of choice in many things, control what you can say and hear, and sanctimoniously whine at you that you consume too many resources and must cut back.

#7  I used to do title searches regularly, back when we were renovating houses. Figure half a day to make the rounds of the various rooms at the courthouse; one can do a dozen or more at one go, because liens are recorded by lot number -- very rarely will a property have more than two or three liens, recorded on a single index card, and in my limited experience I've never seen a property require more than one card. For the rest, each sale document for a given property contains the reference number for the sale that preceded it, and lists all the buyers and sellers involved. There are professionals that do title searches for a very reasonable fee, guaranteeing their results, which even with formal write-ups should be turned around in a week.

I call the title search argument spurious. Clearly Mr. Sheridan was not able to reach his target on the property cost, or was able to reach agreement with all sellers but the last few, as so often happens, and now intends to have his way by force.

#6  Sheridan said he did not want to characterize any individual landowner as unwilling to negotiate, but, "Basically, at this point, we have not been able to acquire all the land we need," he said.

Even with willing sellers, Sheridan said title questions, liens and other claims can arise that would have to be worked out and could delay the project.

Can arise? He doesn't know? I thought he had already been negotiating with the property owners? In which case he should have already done a title search - or did he to go into negotiations without even knowing if the title was clear and who had clear ownership?

I'm not in real estate but I would think they would at least check the title.
