#5  If the Supreme Court had ruled the other way, what punishment does the treaty on chemical weapons stipulate? Under the equal protection clause I would insist on the same punishment as pencil-neck; i.e. nothing.

You mean someone up there still recognizes the 10th amendment? Or is this another 'one from column A and one from column B' excuse to avoid some esoteric conflict with an earlier power grab?
