Ben Shapiro's Champ Solution: 'Prosecution Not Impeachment'

[Breitbart] On Thursday, Senator Marco Rubio (R-FL) stated that he was "not, at this point, calling for impeachment." He continued, "The president has two years left in his term. We hope they pass quickly."

That hope is empty. They will pass slowly. And even should Republicans win back the Senate in 2014, President Champ promises heavy executive action--action that will surely violate the Constitutional delegation of powers.

Which is why, says Breitbart senior editor-at-large Ben Shapiro, impeachment isn't the answer: prosecution is. And in his new book, The People vs. The Champ: The Criminal Case Against The Champ Administration, Shapiro lays out the charges.

"A criminal administration can do virtually anything, without any sort of real consequences," Shapiro writes. "Impeachment is rarely used - in the entire history of the United States, there have been just 19 House impeachments, and just eight of those ended with full removal after a Senate trial. No doubt the founders intended impeachment to be utilized far more often than it has been...But in practice, impeachment has been a failure."

Instead, Shapiro proposes, criminal prosecution of the Obama administration under the Racketeer Influenced and Corrupt Organizations (RICO) Act should be on the table.

That act was created as a response to the mafia--it was designed to undermine mob claims of plausible deniability. It was created to hold command and control structures accountable for activities taking place down the chain. Shapiro writes, "Congress expressly worried in the RICO law itself that organized crime was using its money and power to 'subvert and corrupt our democratic processes.' Clearly, those worries were understated. Now the chief threat to the democratic process comes not from the mafia but from within the government itself."

RICO does not rely solely on the Attorney General to prosecute--and in Eric Holder's America, that's a good thing. Civil suits may be filed under RICO, turning citizens into "private attorneys general...undertaking litigation in the public good." Americans become the check on the executive branch--and Shapiro argues for the changes to the law that would make such action possible against what he terms the "Obamob."

"The alternative," Shapiro writes, "is an unanswerable government in which corrupt bargains between corrupt officials predominate, protected by the barrier of plausible deniability. The American people are left out in the cold."
Notorious Chicago gangster Alphonse Gabriel Capone enjoyed a great deal of local success due to his ability to leverage corrupt Chicago cops. His downfall was his inability to leverage the Feds. You can 'lay out' all the charges you wish. Without the DoJ and the Rule of Law, you still have nothing.

#7  I have been saying for some time that I would LOVE to see a County Sheriff with a pair show up when Champ lands within his county some day. And attempt to arrest him.

Nice and polite. The SS won't allow it, but it would be AWESOME theater - the list of charges he could be placing him under arrest for could be quite lengthy. Think of the Administration trying to defend the President being a fugitive. LOL Love it!

#5  Prosecution would make a martyr of him and then the folks would start to rally around him again. I'd rather win elections than get justice or revenge.

My example is Pinochette who was allowed to leave power with a deal not to be prosecuted. Many opposed such a deal but getting him out of power peacefully was more important to the nation of Chile. The president that dictators can be bought off adn removed without bloodshed is far more powerful and useful than justice (at least in most cases).

#4  I saw a good idea somewhere (think PJMedia) that while no one will impeach the first black president, hamstringing him is easier if the Republicans have both houses.

Cut off funds for his pet projects and impeach jr. level people from his organization. Take him down like the FBI does with the mob. Take out the little guys, work your way up and starve the mob of funds.

Just pass authorization bills one by one for his veto. In some cases (DoE,EPA,et al), no legal authorization for funding at all. When the government shuts down, there's only ONE person to blame. It's simpler. When he says he'll print money without authorization, just pass a joint resolution telling the citizens they have no obligation to pay taxes either (since the inflationary effect of just printing money is the same as taxes in reducing their real income).
