Caravan Migrants File Lawsuit Against Trump, U.S. Government
2018-11-03
Hattip Besoeker.
[Bongino] Twelve migrants colonists traveling on foot from Honduras to the United States filed a lawsuit against President Trump and the Department of Homeland Security on Thursday.

The lawsuit claims the migrant’s Fifth Amendment due process rights would be violated and that the president cannot utilize the military to stop asylum-seekers from entering the country when they have a fair claim. It also criticizes President Trump for stoking "fear and hysteria" with his claim that gang members have joined the migrant caravan.

Twelve Honduran nationals are listed as plaintiffs in the suit which was filed in the U.S. District Court in Washington, D.C. The lawsuit said the "well-documented human rights
...which are usually entirely different from personal liberty...
crisis" in Guatemala, Honduras and El Salvador is widely known. It also claims the plaintiff’s right to the Administrative Procedures Act and the Declaratory Judgement Act were being infringed upon.

During a Thursday speech on immigration at the White House, President Trump said his administration was finalizing a plan to end the abuse of the United States’ asylum program.

"The biggest loophole drawing illegal aliens to our borders is the use of fraudulent or meritless asylum claims to gain entry into our great country," said Trump. "An alien simply crosses the border illegally, finds a Border Patrol agent, and using well-coached language ‐ by lawyers and others that stand there trying to get fees or whatever they can get ‐ they’re given a phrase to read. They never heard of the phrase before. They don’t believe in the phrase. But they’re given a little legal statement to read, and they read it. And now, all of a sudden, they’re supposed to qualify. But that’s not the reason they’re here."

#6  The lawsuit, which was filed by Mike Donovan of Libre Nexus, alleged that Trump’s vow to send the migrants back to their country of origin violates the Fifth Amendment. Tucker Carlson gave him a Constitutional lesson the other night, correcting the faulty logic.
“Let me just correct you as a non-lawyer. They do not possess those rights if they are in another country and not U.S. citizens. If they possess those rights, then, I don’t know, the entire country of Nigeria — pick a country that is poorer than the United States and say ‘we want to come there,’ president says you can’t come and all of a sudden eight hundred million people sue you for violating their constitutional rights for a country they’ve never been to?” Carlson responded before being cut off.

Libre Nexus is facilitating this illegal migration and could be sued by the victims. Ran into this get out-of-jail without collateral scam reading about Beto's shady financing.

#5  And what are the rules about standing to bring suit?

At the least they have to get here, no?

#4  Any judge wants to rise their hand for being impeached? They're foreigners in a foreign land, they have no standing as there is no jurisdiction involved. There is no need to examine any issue involved. Other than the judiciary's long running game to subordinate the people and the rest of the government to their rule by fiat.

#3  Migrants have to shop for a sympathetic judge.

#2  The fact that they refused asylum in Mexico makes their 'fair claim' totally bullshit.

But I'm sure the democrats are shopping for a judge right now.
