#3 Decision by 2 Clinton appointees. Concurring opinion by a Senior judge appointed by GHW Bush. In other news, there is currently only 1 vacancy on a federal appeals court (5th - which is already heavily Republican), and there have been no new openings for months now. No doubt everyone is holding out to see what happens in November. After that, well, there are lots of 70+ and even 80+ year old Clinton judges out there. |
