Federal judge shuts down Dakota Access pipeline
2020-07-07
[UPI] A federal judge ordered the shutdown of the Dakota Access pipeline until an environmental review can be completed, handing a blow to the Trump administration and victory for the Standing Rock Sioux Tribe.
Up to the appeals court for reconsideration or straight to the Supreme Court?
President Donald Trump
...New York real estate developer, described by Dems as illiterate, racist, misogynistic, and what ever other unpleasant descriptions they can think of, elected by the rest of us as 45th President of the United States...
signed an executive order earlier in the year allowing for the completion of the Dakota Access pipeline after the B.O. regime blocked it over environmental concerns.

The pipeline has long been contentious in North Dakota because of its closeness to tribal lands. Supporters touted its safety and that it would create jobs for the local community.

U.S. District Judge James Boasberg
...Obama appointee, appointed by UNSC chief justice John Roberts presiding judge of the US Foreign Intelligence Surveillance Court and chief judge of the US Alien Terrorist Removal Court....
said the pipeline must be closed within the next 30 days. He ordered the U.S. Army Corps of Engineers to re-examine the risks of the pipeline and prepare a full environmental impact statement.

"Today is a historic day for the Standing Rock Sioux Tribe and the many people who have supported us in the fight against the pipeline," Mike Faith, chairman of the Standing Rock Sioux Tribe, said in a statement. "This pipeline should have never been built here. We told them that from the beginning."

#9  Warren Buffet will like the decision. He can keep his tank car unit trains going, with occasional wrecks and crude oil spills along RR right of way. No big deal.

#8  Partially explains the quality of decisions we are getting from FISA.

Really? Chief judge of the US Alien Terrorist Removal Court? Isn't that how guys like the Tsarnaev Bros get to stay here long enough to kill our fellow citizens?

#6  I expect the appeals court will stay the District court's decision. With respect to the Supreme court I'm not so optimistic.

The Obama decision to deny the permit was based on the imagined effect of construction; that it would discourage other countries emission reduction programs. Even the Obama team couldn't find any actual environmental detriment.

I would just ignore him and keep going.

#4  That Senate confirmation from 2011 is also telling: 96-0. Only nine years ago.

#3  Yet another Judge John Roberts and Soetoro legacy. BTW, he is or has been a FISA judge:

On June 17, 2010, President Barack Obama formally nominated Boasberg to the District Court for the District of Columbia.[9] Boasberg was confirmed on March 14, 2011 by a vote of 96 ayes to 0 nays.[13] He received his commission on March 17, 2011.[10]

#2  Evidently 'eminent domain' only applies to non-tribal citizens.
