Money for Migrants and Ukraine, but no money for Snow Creek Bridge |

[Gateway] A year ago, veteran Phil Paxson was leaving a birthday party for his daughter after volunteering to stay and clean up in Hickory, North Carolina. He plugged in the 4 mile trek back to his home in the dark and rain, driving his Jeep Gladiator, a brief ten minute trip that Google Maps told him went over Snow Creek Bridge. |

#4 Unless its a US highway or Interstate, its a local funding issue. |

#3 On Monday, near Magnolia TX, there was a similar event. A five ton capacity bridge vs a 20 ton cement truck. Gravity won. The driver, an illegal, drove past warning signs. He would likely have hoofed it but when the truck went nose down in the gully, he couldn't get out of the truck. Probably had to do with the nine yards of concrete pushing on the cab, cause the drum ruptured. |

#2 Negligence does not have to be "witting." to be actionable. |

#1 In a way, I just discovered a hint of virtue in this tragedy, in of all places, lawyers. My initial reaction was to focus on the moronic decision to remove traffic barriers that blocked the approach to the missing bridge. But any financial rewards would most likely punish the taxpayers of that jurisdiction since the idiot that ordered the removal of a barrier would claim protection from personal liability while acting in a public capacity. The Goggle defendant choice actually seeks compensation for loss due to negligence from a private, albeit unwitting negligent party. I get that it is also a deep pocket for whom a six or seven figure cursory settlement with a sealed non-disclosure agreement is a pinprick if successful. But at least the effort avoided, it seems, the taxpayers around Hickory, North Carolina, and for that, note should be made. |
