November 13, 2009: In areas controlled by al Shabaab, foreign aid groups have to meet a new list of regulations, or shut down. The air groups must pay $40,000 a year in "registration fees,", take logos off their vehicles, not take Sunday off, not promote democracy, not employ women and several similar restrictions.

The AU peacekeepers have proved a formidable foe. Meanwhile, al Shabaab has to deal with growing unrest in parts of southern Somalia that it nominally controls. People are not happy with the strict application of Islamic law, but al Shabaab sees these draconian punishments (stoning, cutting off limbs, floggings) as an effective way to terrorize the population and prevent organized resistance. But more clan militias are being organized to fight al Shabaab anyway.

Yemeni rebel leader calls on Saudi for ceasefire
[Al Arabiya Latest] As Saudi forces continue to pound the positions of the Yemeni rebels who infiltrated into its borders, Houthi leader Yehia al-Houthi called for a ceasefire and expressed his group's willingness to engage in dialogue in an interview with Al Arabiya late on Wednesday.

"We call upon Saudi Arabia to stop its military attacks and start negotiations," he said, adding, "Our war is not with Saudi Arabia."

Houthi leader Yehia al-Houthi
But Saudi forces continued to increase their reinforcement deploying more troops and arsenal in a clear sign of what deputy Defence Minister Prince Khaled bin Sultan called a continued operation to clear the kingdom's borders of all Houthi rebels and force them to retreat to the Yemeni territories.

Around 1,300 Saudi paratroopers left the Tabuk base heading towards the conflict zone. Ammunition was also transferred through an air bridge set at the local Abdullah airport in Jizan.

A group of Houthi rebels attacked a Saudi police station two days ago. They exchanged fire with the Saudi army then fled to a hospital.

Hours later, the rebels resumed shooting from the hospital, losing two of their group members before the rest was able to run away flee to another area.

Saudi's main civil defense center at al-Khauba, located in the combat zone, is to be closed following unexpected attacks on civil targets such as a hospital and a police station, Al Arabiya reported. The center will be transferred to the more secure area of Ahad al-Masareha, 50 kilometers north of the borderline.

Civil defense teams are equipped with weapons and received combat training in preparation for any unexpected rebel attacks on their facilities.

After the Saudi army made strong statements regarding its preparation to crush the Houthi insurgency, many rebel leaders were reported to have called for a ceasefire and to have shown their readiness to look for other means to resolve the conflict.

Ctg grenades used in all attacks
[Bangla Daily Star] The grenades that went missing from the Chittagong 10-truck arms cache in 2004 were used in all grenade attacks including the one on August 21 Awami League rally, detained former BNP state minister for home Lutfozzaman Babar has told interrogators.

The grenades were used in attacks on Shah AMS Kibria, former British High Commissioner to Bangladesh Anwar Choudhury, AL leader Suranjit Sengupta and Sylhet City Mayor Badruddin Ahmed Kamran, Babar told Criminal Investigation Department officials during interrogation in the August 21 grenade attack case.

The former state minister said three days after the August 21 incident Harris Chowdhury asked him to go to Hawa Bhaban where former BNP deputy minister Abdus Salam Pintu was also present.

Both Harris and Pintu had threatened Babar to strip him of ministerial post when he refused hiding the truth and saving the perpetrators, Babar said.

The two also told him not to show any curiosity about the sources of the grenades.

Babar mentioned that all grenade attacks were made in the country after the arms haul at Chittagong Urea Fertiliser Jetty on April 2, 2004 when a huge number of grenades and arms went missing, CID sources said.

Meanwhile, detained Harkatul Jihad al Islam leader Abdul Majid admitted that he received the grenades from Laskar-e-Taiba leader Moulana Tajuddin, also brother of Pintu, for carrying out attack on the AL rally. But he was not sure from where Tajuddin collected them, said sources.

CID sources said Babar however denied his involvement in supplying the grenades saying he came to know about it after the attack.

Babar also said he didn't know then the number of missing grenades as intelligence agency personnel did not give him any information about it.

Meanwhile, Huji founder Moulana Sheikh Abdus Salam divulged that the plan to assassinate Sheikh Hasina was finalised after the masterminds received some of the missing grenades. Tajuddin collected the grenades from them, he added.

CID interrogated Babar, Salam and Majid together to crosscheck information.

Babar would be produced before the court today as his remand for third phase ended yesterday.

Mexico border city groups call for UN peacekeepers
Business groups in the Mexican border city of Ciudad Juarez said Wednesday they are calling for United Nations peacekeepers to quell the drug-related violence that has given their city one of the highest homicide rates in the world.
Because UN peacekeepers have been so effective... where exactly have they been effective?
Groups representing maquiladora assembly plants, retailers and other businesses said they will submit a request to the Mexican government and the Inter American Human Rights Commission to ask the U.N. to send help.

"This is a proposal ... for international forces to come here to help out the domestic (security) forces," said Daniel Murguia, president of the Ciudad Juarez chapter of the National Chamber of Commerce, Services and Tourism. "There is a lot of extortions and robberies of businesses. Many businesses are closing."

The government has sent more than 5,000 soldiers to the city across the border from El Paso, Texas, but killings, extortions and kidnappings continue.

Ciudad Juarez has had 1,986 homicides through mid-October this year -- averaging seven a day in the city of 1.5 million people.

S Korea 'will pay dearly for sea clash'
North Korea has threatened its southern neighbor after naval clashes between the two Koreas intensified tension in the region, according to North Korean media outlets.

South Korea would face costly consequences if it continues its aggressive posture, the North's government-run Minju Joson newspaper said Thursday.

The navies of the two sides clashed off the countries' west coast Tuesday for the first time in seven years, leaving a North Korean naval boat severely damaged.

Following the incident, the two Koreas accused each other of violating the controversial maritime border.

South Korea has put its forces on alert but says it does not want the clash to damage relations.

However, the South has sent one of its newer destroyers equipped with torpedoes and guided missiles closer to the border in addition to two extra patrol boats.

In another article in the North's official Rodong Sinmun daily, Pyongyang said the South will pay an expensive price for Tuesday's clash.

"Warmongers who like to play with fire will be certain to pay an expensive price," the paper said in an editorial.

"The armed clash on the West (Yellow) Sea was not an accident but was a premeditated act of aggression by the South's military seeking intensifying of tensions on the Korean peninsula."

Teens sign up for jihad at Stockholm youth centre
Swedish taxpayers helped fund a youth recreation centre in the north Stockholm suburb of Rinkeby which served as a recruiting station for the Somalia-based Islamist group al-Shabaab.

More than ten young people from the predominantly immigrant neighbourhood who spoke with Sveriges Radio (SR), said that the recruitment drive was led by a youth leader at the Kreativitetshuset recreation centre.

The recreation centre was started by a mosque and received a total of 480,000 kronor ($70,400) from the Stockholm city sports and recreation administration over four years before closing down in 2008.

"It's horrible. There was no suggestion of this when we had contact with the association when it was created," Per Johansson, head of the city's department for clubs and associations, told SR.

"Their paperwork was in order when they submitted it. And during the visits we made to the facility during the first year we didn't see anything to indicate something like this."

The head recruiter, said to be in his thirties, showed young people video clips from YouTube which encouraged viewers to sacrifice themselves for their beliefs.

“I saw how they showed images of war victims, decapitated heads, and all sorts of horrible things while repeating the same message the whole time. It had a big impact on those who weren’t strong enough to stand up to it,” one young person who resisted the youth leaders urges to join al-Shabaab, told SR.

According to Swedish security service Säpo, al-Shabaab successfully recruited around 20 young people from Sweden, some of whom who have been killed in battle.

The news comes on the same day as the magazine Neo previewed an interview by journalist Per Gudmundson with the wife of another man from Rinkeby who was recruited by al-Qaeda in Iraq.

“I don’t think he’s done anything wrong. I see it as a part of our religion,” the man’s wife told Gudmundson, who traced the man’s journey from the Stockholm suburbs to the battlefields of Iraq after reviewing documents confiscated by the US military from al-Qaeda in Iraq hideouts near the Iraqi border with Syria.

The documents, known as the Sinjar Records, contain details about 606 foreign jihadist fighters, including the man from Sweden.

According to Magnus Ranstorp, head of research at the the Centre for Asymmetric Threat and Terrorism Studies (CATS) at the Swedish Defence Research Agency (FOI), there are hundreds of jihadists in Sweden, but the number has remained constant for several years.

“What we can see is that the number of jihadists in Sweden hasn’t increased in recent years. The size of the group is relatively constant. The security police are good at keeping tabs on these people, which occurs either through their own investigations or by having Swedes highlighted in investigations abroad,” he told the Nyheter24 news website.

He added that many Swedish jihadists attempt to join terrorist groups in order to fight with the Taliban in Afghanistan as well as in other conflict zones like Iraq and Somalia.

Ranstorp also confirmed that al-Shabaab carries out “intensive recruiting” in Sweden, often using Somali associations and groups to help their efforts.

Canada: New citizenship guide says no to 'barbaric' practices
Canada's revamped citizenship guide warns newcomers that "barbaric cultural practices" such as honour killings will not be tolerated, marking a stronger tone against importing beliefs that clash with Canadian values.

"In Canada, men and women are equal under the law," the document says. "Canada's openness and generosity do not extend to barbaric cultural practices that tolerate spousal abuse, 'honour killings,' female genital mutilation or other gender-based violence. Those guilty of these crimes are severely punished under Canada's criminal laws."
There's a breath of fresh Arctic air ...
The guide, released on Thursday and called Discover Canada: The Rights and Responsibilities of Canadian Citizenship, (read the full guide) is the first of its kind to explicitly denounce violence in the name of family honour -- a crime in the headlines just this week after an Ottawa man was sentenced to a year in jail for threatening violence against his daughter.

While honour killings remain relatively rare in Canada, several high-profile cases have drawn attention to the issue. Even the use of the term "honour killings" has stirred debate, as critics of the wording say it implies the practice is accepted by certain religions when, in fact, it is not.

"The government had long been cautious about offending people," said Amin Muhammad, a psychiatry professor at Memorial University and author of a recent paper on the subject, which was submitted to the federal Department of Justice. "But now, the government is bravely -- but politely -- warning that this is something that is not to be tolerated."

The inclusion of honour killings and spousal abuse in the guide reminded some onlookers of the tension over reasonable accommodation, a concept that came to a boiling point in Hérouxville, Que., in 2007 when the town council passed a motion governing the behaviour of immigrants, including provisions against stoning women and genital mutilation.

But Farzana Hassan, spokeswoman for the Muslim Canadian Congress, said there is nothing controversial about the statement in the new guide, adding that it is a long-overdue step toward tackling a cultural practice that does not jibe with Canadian values.

"We cannot ignore this in the name of multiculturalism," she said. "But it's not enough to make statements about what people should or shouldn't do, because that approach doesn't register with people who are influenced by this very irrational religious zeal."

Phyllis Chesler, an American feminist author who will soon publish a study of 230 honour killings across five continents, said honour killings are most often committed by Muslims, but added that Canada and the United States have also seen many cases involving Sikhs and Hindus. "The punishment is for becoming western after having moved to the west," Ms. Chesler said. "Wanting to leave a husband, going to college - these sorts of things that we take for granted - are seen as capital crimes among those who practice honour killings."

Ms. Chesler said honour killings are culturally acceptable in some parts of the world, adding that the killers are often glorified and the victim's family is usually complicit. "These people are coming from countries where these behaviours are never punished," she said. "There are people who bring this mindset when they come to the west."

Although Liberal immigration critic Maurizio Bevilacqua said he welcomes the firm language regarding the equality of men and women, he said the document should be assessed not only for what it includes, but also for what it excludes.

"Why wasn't white-collar crime mentioned, for example?" Mr. Bevilacqua said. "This must be what the current government wanted to highlight and prioritize."

For Mr. Muhammad, the new guide is a stepping stone that should be bolstered by stricter immigration processes.

"Canada needs to be more thorough in checking people's background because right now, as it stands, lots of people who support honour killings can slip into the system," he said. "Let people take offence. People who come to Canada must be law-abiding citizens."

Gitmo detainee challenges judge who halted case
[Dawn] A man from Tajikistan seeking his freedom from the US military prison at Guantanamo Bay, Cuba, is challenging a practice among federal judges at the US Courthouse in Washington who in some instances are short-circuiting the cases of longtime detainees.

The Obama administration is trying to pre-empt some of the cases by declaring that a detainee is being cleared for release to a foreign country and asking the judge to stop the review.

In the case of Umar Hamzayevich Abdulayev, US District Judge Reggie Walton halted action on the detainee's case after the government approved a transfer of Abdulayev to Tajikistan, where the detainee says he would be persecuted if sent there.

Abdulayev's argument is that his court case should continue and that he would be entitled to release into the United States if the government does not arrange for a safe country of asylum.

The judge 'eviscerated the clear directives of the Supreme Court' that detainees at Guantanamo Bay have a right to challenge their detention in civilian courts, lawyers for the prisoner said in papers filed this week with the US Court of Appeals for the District of Columbia Circuit.

If the government is allowed to ship Abdulayev off to the 'unmonitored corners of Tajikistan's prisons' before he has even an opportunity to be heard, he will be deprived of his right to court review, his lawyers added.

Suspending his court case places Abdulayev 'at risk of his worst possible fate: repatriation to torture,' the court papers added.

While at Guantanamo Bay, Abdulayev has been interrogated on three occasions by officials of the Tajik government, who allegedly told him that because he had lived in Afghanistan he could work there for the Tajik government as a spy, an offer Abdulayev says he refused, triggering threats from his interrogators, according to the court papers.

In the past year, federal judges at the courthouse in Washington, D.C., have ordered release for 30 detainees from Guantanamo Bay. In the cases of eight other detainees, the judges have rejected pleas for freedom. The total number of Guantanamo Bay detainee cases before the judges is 250.

Abdulayev has been held at Guantanamo Bay for nearly eight years.

According to his lawyers, his family fled Tajikistan for Afghanistan when civil war erupted after the collapse of the Soviet Union. At the time, Abdulayev was 13.

Abdulayev's father was shot and killed when he and other refugees tried to return in 1994 after overtures from the Tajik government were broadcast over the radio in Afghanistan. There, escalating violence led to Abdulayev and his family moving again, this time to Pakistan. Abdulayev was arrested by Pakistani police after the Sept. 11, 2001, terror attacks against the United States and was turned over to the US military.

'Pakistani Taliban ordered attacks in Barcelona'
[Dawn] Eleven suspected militants of South Asian origin are on trial in Spain over an alleged plot to stage suicide attacks on Barcelona's subway system.

Prosecutors say the cell of men from Pakistan and India acted on orders from the Pakistani Taliban. The motive was alleged to be the presence of Spanish troops in Afghanistan.

The trial began Thursday at the National Court, Spain's hub for terrorism cases. It is expected to last several weeks.

Police foiled the alleged plan in January 2008 with a series of raids in Spain's second largest city.

The police moved in after a member of the cell who was designated to blow himself up got cold feet and alerted authorities, according to a Spanish prosecutor.

Swat Valley under control of forces
[The News (Pak) Top Stories] The operational commander of Swat, Maj Gen Asfaque Nadeem, said on Wednesday that 100 per cent area of Swat was under the control of security forces and all entry and exit points had been closed so that militants could not escape from the picturesque valley.
Does that mean Mullah Fazlullah's dead? I thought not...
Talking to a group of senior journalists here, he said security forces were conducting search operation in some areas of Swat on information about the presence of unwanted elements. Gen Asfaque said that work on development projects had already been started and security forces were repairing and constructing mosques.

The situation in Mingora and other parts of the district is normal and under the control of security forces. On this occasion, he announced to organise Skiing championship in December at Malam Jabba with an objective to promote tourism besides restoring the confidence of tourists to visit this scenic valley.

Alleged killer Teitel: No doubt God pleased with me
[Ma'an] Ma'an/Agencies - An Israeli settler charged with a string of murders and assaults told prosecutors in Jerusalem on Thursday that he regrets nothing.

"It was a pleasure and an honor to serve my God," said defendant Yaakov Teitel, according to the Israeli daily Haaretz. "I have no regret and no doubt that God is pleased."

Dubbed the "Jewish terrorist" by Israeli media, the 37-year-old was charged with two murders, three attempted murders using poison and bombs, and other violent acts spanning a decade. Israeli police arrested the settler last month for the killings, which included two Palestinians.

An immigrant from the US, Teitel was arrested in Jerusalem on 7 October. He allegedly confessed to authorities to shooting to death Palestinian shepherd Issa Jibril south of Hebron in 1997 and killing an East Jerusalem taxi driver the same year. After killing Jibril, according to police, Teitel told authorities he came to the country with the specific aim of killing Palestinians in revenge for suicide bombings.

During a search of his home, police discovered rifles, handguns and explosive materials; they were unable, however, to find the gun which he allegedly used to kill the Palestinians. But according to his indictment on Thursday, the settler smuggled a disassembled firearm into Israel from the US in 1997 by placing it in a video player before using it to murder a Palestinian taxi driver the same year.

Teitel, a resident of the northern West Bank settlement of Shvut Rachel, near Nablus, was born in the US state of Florida and began travelling to Israel and the West Bank in the 1990s before immigrating to Israel in 2000. He became involved in the "Hilltop Youth" subculture of the Israeli settler movement, which called for radical grassroots mobilization.

Teitel is also suspected to have carried out a series of bomb attacks, including one that seriously wounded a teenager from a Messianic Jewish family in the settlement of Ariel, and another that lightly wounded liberal Hebrew University historian Zeev Sternhell.

He also allegedly responsible for a blast that damaged a police car at the time of a gay pride parade. Teitel even claimed during his questioning to involvement in the attack on a gay-lesbian youth club in Tel Aviv in August, in which two people were killed. Israeli security officials said however that there is not sufficient evidence to link him to the shooting.

He was also not charged with shooting dead two settler policemen in the Jordan Valley eight months earlier. The shooting led to settler activists rallying against Palestinians and demanding more checkpoints, but Israeli police later determined those killings, too, were likely Teitel's doing.

It was not clear why, but Israel's Shin Bet intelligence agency had prevented the defendant from attending his own hearings since his initial arrest. According to Teitel's lawyer, they have also kept him chained to a bed 24 hours a day.

Teitel's family said they were not particularly surprised by what they heard on Thursday.

"What else can be said today? We are sad. We are talking about a fool. We didn't think for a moment that the Shin Bet was making this up. We knew an indictment would be filed and we were not surprised by the charges," said the defendant's brother in law, according to the Hebrew-language newspaper Yedioth Ahronoth.

#3  Here we see a key difference between Israel and Gaza/West Bank: Israel is a nation of laws. This man killed innocent Palestinians. He is being prosecuted by Israel and may spend the rest of his life in jail.
In Gaza/West Bank, a Palestinian who killed Jews (and survived), would not only not be prosecuted, he would be hailed as a hero.

Europe aid convoy arrives in Gaza after month-long delay
[Ma'an] The European medical aid convoy "Miles of Smiles" arrived in Gaza late night Wednesday night after spending 25 days waiting on the Egyptian side of the crossing.

Hamdi Sha'th, head of the committee against the siege, told Ma'an over the phone that the convoy will stay in Gaza only 48 hours and will leave on Friday after the noon prayer. The short trip was part of the terms negotiated by Egyptian border officials.

Initial conditions were set at a 24-hour visit, but negotiations with convoy leaders saw the timeframe extended by a day.

The group brings into the Strip 100 small trucks loaded with medical aid and nearly 260 wheelchairs in addition to a number of ambulances, 102 cars for transportation of the disabled and computers for schools damaged during the last war.

Sha'th said the convoy consisted of 60 individuals from 10 different European countries, who would travel to the northern Strip where they would meet with members of the Palestinian Legislative Council, then head to the Ash-Shifa Hospital in Gaza City, which bore the brunt of casualties from Israel's last war on the area in December and January. Later in the day the delegation will meet families of prisoners being held in Israel, and finally a meeting with de facto government officials.

Minister of Labor and Social Affairs in the de facto government Ahmad Al-Kurd said in a news conference after the convoy arrived in Gaza that it was carrying a moral message to the world, demanding they "stop besieging one and a half million Palestinians," and will carry the "devastating humanitarian impact" of the siege back to their countries and spread the word.

Convoy coordinator Dr Issam Younis said "we've come to draw a smile on the faces of Gaza's children and on the faces of every child and youth who has been assaulted, to tell them that there is life is ahead of you and your goal is unique and we are with you."

Report: Netanyahu ready to discuss Golan pullout
[Iran Press TV Latest] The Israeli Prime Minister Benjamin Netanyahu has reportedly expressed willingness to withdraw from the Golan Heights as part of a 'peace deal' with Syria.

In a 'relayed message' to Syrian President Bashar Assad through the French President Nicholas Sarkozy, Netanyahu said that "We have accepted the principle of withdrawing from the Golan; let's discuss the details," the Saudi-owned Arabic-language satellite TV channel, Al-Arabiya, reported on Thursday.

The Al-Arabiya report highlighted that France and Israel agreed not to reveal the content of the message, which was coordinated with Washington, until it is relayed to Assad during his expected meeting with Sarkozy in Paris on Friday.

The Israeli Prime Minister's Office on Thursday denied the report. "The Al-Arabiya report has nothing to do with reality. Nothing of this kind ever happened," said Netanyahu's office, in a response.

However, a senior political source in Jerusalem on Thursday said that Netanyahu is considering French mediation for talks with Syria because of Sarkozy's close ties to both him and Assad.

On Wednesday, Netanyahu said that Israel would be prepared to hold immediate peace negotiations with Syria, as long as the talks were held without preconditions. Netanyahu made the remarks in a meeting with French counterpart, Sarkozy, in the Elysée Palace.

Netanyahu's declaration regarding Syria came hours after Assad said he would not set any preconditions for peace negotiations with Israel.

"Resistance to Israeli occupation has been at the core of our policy in the past and in future. We do not put forward conditions to achieve peace. We nonetheless do have rights that will not abandon," Assad said in a speech opening the fifth Conference of the Arab Parties entitled 'The Independent Arab Decision' in Damascus.

Palestinian electoral body postpones Jan. polls
[Al Arabiya Latest] The Palestinian electoral commission on Thursday indefinitely postponed general elections called for January because the vote cannot take place in the Hamas-ruled Gaza Strip.

"I regret to say it is unfortunate that the elections will be postponed," commission head Hanna Nasser told reporters.

"It has become clear to us that conducting elections in the Gaza Strip is not likely to happen," he said.

Palestinian President Mahmoud Abbas received a recommendation to postpone the January vote and will accept the advice, a senior official earlier said.

Irans Al-Alam TV resumes service on new sat
[Iran Press TV Latest] Iran's Arabic-language Al-Alam television network has resumed broadcasting on a new satellite after it had been taken off the air by Arab satellite operators based in Egypt and Saudi Arabia, without explanation.

The Tehran-based television news channel is now putting its programs on air on Atlantic Bird 4: frequency 11355 MHz, vertical polarization.

Atlantic Bird 4 (formerly Hot Bird 4) provides high-power Ku-band coverage of regions, including Central and Eastern Europe, North Africa, the Middle East and Central Asia.

The leading provider of satellite telecommunications, Eutelsat, has been operating Atlantic Bird 4 since June 2006 alongside two Nilesat satellites, also located at 7 degrees West, as well as complementing capacity on Atlantic Bird 2, located nearby at 8 degrees West.

Iran's Arabic-language Al-Alam television network had been off the air since November 3, when Saudi-based Arabsat and Cairo-based Nilesat dropped it without prior notification.

Several regional and international media and political activists slammed the move then, saying that the ban is in violation of freedom of expression.

The British Association of Journalists, Turkey's Felicity Party, The International Association for Media and Communication Research - IAMCR, Lebanon's National Information Council, Turkey's Organization of Human Rights and Solidarity with Oppressed People, The International Association of Journalists (IAJ), and Al-Manar television network were among the organizations that protested the arbitrary measure.

Lebanese resistance movement, Hezbollah, also condemned the action of the two Arab satellite companies and described the decision politically motivated and a flagrant violation of the freedom of speech.

Al-Alam extensively covered the latest developments during the 33-day Israeli war in Lebanon and the 22-day assault on Gaza.

Khalid Sheikh Mohammed & four others to stand trial in New York
WASHINGTON -- Prosecutors will seek the death penalty for self-proclaimed Sept. 11 mastermind Khalid Sheikh Mohammed and four other Guantanamo Bay detainees, who will be sent to New York to face trial in a civilian federal court, Attorney General Eric Holder said Friday.

At a news conference Friday, the attorney general said five other suspects will be sent to military commissions. Holder said the detainees in the New York case will be tried in a courthouse just blocks from where the Sept. 11 attackers felled the twin towers.

Bringing such notorious suspects to U.S. soil to face trial is a key step in President Obama's plan to close the terror suspect detention center at Guantanamo Bay, Cuba. Obama initially planned to close the detention center by Jan. 22, but the administration is no longer expected to meet that deadline.

The New York case may also force the court system to confront a host of difficult legal issues surrounding counterterrorism programs begun after the 2001 attacks, including the harsh interrogation techniques once used on some of the suspects while in CIA custody. The most severe method -- waterboarding, or simulated drowning -- was used on Mohammed 183 times in 2003, before the practice was banned.

Holder also announced that a major suspect in the bombing of the USS Cole, Abd al-Rahim al-Nashiri, will face justice before a military commission, as will a handful of other detainees to be identified at the same announcement, the official said.

It was not immediately clear where commission-bound detainees like al-Nashiri might be sent, but a military brig in South Carolina has been high on the list of considered sites.

The actual transfer of the detainees from Guantanamo to New York isn't expected to happen for many more weeks because formal charges have not been filed against most of them.

Holder had been considering other possible trial locations, including Virginia, Washington and a different courthouse in New York City. Those districts could all end up conducting trials of other Guantanamo detainees sent to federal court later on.

The attorney general's decision in these cases comes just before a Monday deadline for the government to decide how to proceed against 10 detainees facing military commissions. The administration has already sent one Guantanamo detainee, Ahmed Ghailani, to New York to face trial, but chose not to seek death in that case.

At the last major trial of al-Qaeda suspects held at that courthouse in 2001, prosecutors did seek death for some of the defendants.

Mohammed already has an outstanding terror indictment against him in New York, for an unsuccessful plot called "Bojinka" to simultaneously take down multiple airliners over the Pacific Ocean in the 1990s.

Some members of Congress have fought any effort to bring Guantanamo Bay detainees to trial in the United States, saying it would be too dangerous for nearby civilians. The Obama administration has defended the planned trials, saying many terrorists have been safely tried, convicted, and imprisoned in the United States, including the 1993 World Trade Center bomber, Ramzi Yousef.

Mohammed and the four others --Waleed bin Attash, Ramzi Binalshibh, Mustafa Ahmad al-Hawsawi and Ali Abd al-Aziz Ali -- are accused of orchestrating the attacks that killed 2,973 people on Sept. 11, 2001.

Mohammed admitted to interrogators that he was the mastermind of the attacks -- he allegedly proposed the concept to Osama bin Laden as early as 1996, obtained funding for the attacks from bin Laden, oversaw the operation and trained the hijackers in Afghanistan and Pakistan.

The charges against the others are:

  • Bin Attash, a Yemeni, allegedly ran an al-Qaeda training camp in Logar, Afghanistan, where two of the 19 hijackers were trained. Bin Attash is believed to have been bin Laden's bodyguard. Authorities say bin Laden selected him as a hijacker, but he was prevented from participating when he was briefly detained in Yemen in early 2001.
  • Binalshibh, a Yemeni, allegedly helped find flight schools for the hijackers, helped them enter the United States and assisted with financing the operation. He allegedly was selected to be a hijacker and made a "martyr video" in preparation for the operation, but was unable to get a U.S. visa. He also is believed to be a lead operative for a foiled plot to crash aircraft into London's Heathrow Airport.

  • Ali allegedly helped nine of the hijackers travel to the United States and sent them $120,000 for expenses and flight training. He is believed to have served as a key lieutenant to Mohammed in Pakistan. He was born in Pakistan and raised in Kuwait.

  • Mustafa Ahmad al-Hawsawi, a Saudi, allegedly helped the hijackers with money, western clothing, traveler's checks and credit cards. Al-Hawsawi testified in the trial of Zacarias Moussaoui, saying he had seen Moussaoui at an al-Qaeda guesthouse in Kandahar, Afghanistan, in early 2001, but was never introduced to him or conducted operations with him.

    #1  A clever defense attorney will try to get evidence and charges eliminated based on waterboarding. They'll attempt to obtain classified evidence and complain if they can't get it. They'll want covert CIA operatives and Bush officials to testify and try to make the trial about them. They'll complain about bias in the NYC jury pool and try to pack the jury with left wing loons. As the trial drags on, possibly for years, it will make NYC an even more attractive terror target.

    This trial will turn into a circus and it's even possible that there will be a hung jury or the terrorists may even be acquitted.

    This is all foreseeable and I hope Obama pays a heavy political price for this. I just pray that America doesn't pay a price in lives lost to a new terrorist attack due to the administration's stupidity.

What really is going to happen is that the American judicial system is going to be on trial. When it fails, the sanctity in the structures the judiciary has erected for decades will die with them.
