Use of Shah-Era Constitution Not Final: Source
Unexpectedly.
[ToloNews] Although the Ministry of Justice on Tuesday said the constitution from King Zahir Shah’s era will be enforced for an interim period, a source from the government told TOLOnews on Wednesday that the decision is not final.

officials from the Cultural Commission of the Ministry of Information and Culture said if articles of the constitution which was enstated in 2004 (current constitution) are not in conflict with Sharia Law, they will remain in use until a new constitution is promulgated.

Anaamullah Samangani, a member of the commission, said efforts have started to draft a new constitution based on the Koran and Sunnah. "The government is working so that Afghanistan will have a constitution that can address the demands of a real Islamic system," he said.

In the meantime, a number of lawyers said most parts of Zahir Shah’s era constitution are not compatible with the current situation.

According to the lawyers, most parts of the first chapter of that constitution are about constitutional monarchy and the authorities of the king. Article four of the Shah-era constitution says Afghanistan’s flag is tri-colored and article six says the king symbolizes the national illusory sovereignty of Afghanistan.

"Enforcing the 1964 constitution might be questionable to the people of Afghanistan because that constitution was drafted for that period," said Subhan Misbah, a lawyer.

"Currently the country is in an unknown situation. I think this (enforcing the constitution) is good news," said Sayed Ahmad Silab, an MP.

King Zahir Shah’s constitution has 11 chapters and 128 articles. The constitution was ratified in 1964 by a Loya Jirga (grand assembly).

The officials said that they are working to pay on a mechanism based on which they will pay the salaries of all the babus government employees.

Speaking in a presser in Kabul on Wednesday, September 29 deputy Prime Minister Abdul Salaam Hanafi said that they have established an exclusive commission to address the looming humanitarian crisis in Afghanistan.

Abdul Salaam Hanafi said that the commission has allowed all the private banks in Afghanistan to conduct money transfers in order for the traders to access their money and import food ingredients and medicine.

"We have created this exclusive commission so that we address the ongoing economic problem, a spike in prices, and preparation for the upcoming winter season." Said Hanafi.

The deputy Prime Minister said that they will leave the customs of the country 24-hour open and will fight against the mafia that does not allow imports into Afghanistan.

Abdul Salaam Hanafi also called on the US to release the assets of Afghanistan because the money belongs to the people of Afghanistan not to any government.

Cash Withdrawal Limits Problematic for Customers

Earlier, Pentagon spokesperson John Kirby had said that the US needs drone attacks against bandidos gunnies in Afghanistan and they do not need permission from the Taliban.

Kirby also said that he was not sure to be needing such permission in the future.

“We retain all necessary authorities to execute over the horizon counterterrorism operations and we remain confident in these capabilities moving forward without speaking to specific rules of engagement surrounding airstrikes. The report called on the companies "to end all investments and financial flows" into the settlements, arguing that they are illegal under international law.

The findings detail financial dealings worth $255 billion (218 billion euros) between 2018 and May 2021 directly or indirectly linked to the settlements — including loans or share and bond purchases — involving major European firms like BNP Paribas and Deutsche Bank.

More than 600,000 Israeli Jews live in the West Bank and East Jerusalem, territories captured by Israel from Jordan in the Six Day War of 1967. Many large Israeli companies are active in those communities.

The report is not an account of financial dealings directly occurring in Israeli settlements. For example, many of the European companies named have been implicated because they hold shares in non-Israeli firms, like machinery giant Caterpillar, whose products have been used in settlements.

The "Don’t Buy Into Occupation" coalition that authored the report claimed these European companies "have a responsibility to ensure that they are not involved in violations of international law and are not complicit in international crimes."

When you defeat another nation in a war and then seize and annex their territory, that's called imperialism, not occupation.

Citing US and Paleostinian sources, the Axios news site reported Wednesday that Abbas and his aides inquired about the prospect of a meeting with Biden when considering whether to attend the annual gathering.

The Paleostinians were told by the White House that Biden wouldn’t hold any bilateral meetings while in New York and was also unavailable to meet in Washington, according to the report, which said this message contributed to Abbas’s decision not to address the General Assembly in person and instead speak remotely by video.

The White House would not comment on the report, which noted Biden held several bilateral meetings during his brief stay in New York.

Biden has not made the Israeli-Paleostinian conflict a top foreign policy priority since taking office. In his speech to the UN last week, Biden reiterated his support for the two-state solution but did not call for an immediate resumption of Israeli-Paleostinian peace talks.

His administration has instead been encouraging efforts to "advance peace" and Hady Amr, deputy assistant secretary of state for Israel and Paleostinian Affairs, is due to visit Jerusalem and Ramallah next week, the Axios report said.

In his own UN speech, Abbas demanded Israel withdraw to the so-called 1967 lines within a year or face repercussions, while Prime Minister Naftali Bennett omitted the Paleostinians altogether in his address to the General Assembly.
