On TikTok, Chinese State Media Pushes Divisive Videos About U.S. Politicians
[Forbes] Many of the videos attacked specific U.S. politicians before the midterm elections and pushed divisive social issues, without clear labels disclosing they were coming from state-controlled media.

TikTok accounts run by the propaganda arm of the Chinese government have accumulated millions of followers and tens of millions of views, many of them on videos editorializing about U.S. politics without clear disclosure that they were posted by a foreign government.

The accounts are managed by MediaLinks TV, a registered foreign agent and Washington D.C.-based outpost of the main Chinese Communist Party television news outlet, China Central Television. The largest of them are @Pandaorama, which features cute videos about Chinese culture, @The…Optimist, which posts about sustainability, and @NewsTokss, which features coverage of U.S. national and international news.

Kari Lake Responds To Corrupt Obama-Appointed Judge's Sanctions Against Her
[GatewayPundit] Kari Lake responded today to Obama-Judge John Tuchi’s decision to sanction her and Mark Finchem at the request of Maricopa County for daring to bring a lawsuit against the unreliable and corrupt voting machines.

John Tuchi is the same Federal Judge who recently ruled that Maricopa County was justified in discriminating against TGP reporter Jordan Conradson and preventing him his First Amendment rights and access to the County’s press room after another election disaster in the County.

The Gateway Pundit reported on the decision to sanction Lake’s lawyers yesterday in an apparent effort to discredit and discourage any election challenges after the State certifies the corrupt Midterm next Monday.

The Judge even admitted that this order was intended to "send a message" to those who file what he considers "baseless" lawsuits in the future.

Kari Lake and her attorneys argued that the voting machines are "potentially unsecure, lack adequate audit capacity, fail to meet minimum statutory requirements, and deprive voters of the right to have their votes counted and reported in an accurate, auditable, legal, and transparent process."

However, as we saw on Election Day in the Midterm Election, voting machine failures and tabulation issues led to massive and unprecedented voter disenfranchisement at the polls.

The election was an uncertifiable disaster on Election Day when voting machines and printers suddenly stopped working at over 30% of voting centers the moment the polls opened. Republican voters were forced to wait in extremely long lines, turned away from the polls, or told to deposit their ballots in the questionable "box 3" for misread ballots.

These issues were present ALL DAY at some locations.

Because of this, despite having had only 17% of the turnout on election day, Democrats outperformed Republicans in multiple counties, which is unlikely and impossible.

Don't Trust Zuck: Facebook Failed to Block Ads Containing Death Threats to Election Workers
[Breitbart] While social media giants are known for acting quickly and without hesitation to censor certain information being posted during election season — such as the bombshell news story about Hunter Biden’s infamous "laptop from hell" — Facebook reportedly failed to block ads containing death threats to election workers ahead of the 2022 midterm elections.

Facebook failed to block 75 percent of ads "explicitly calling for violence against and killing of US election workers" ahead of the midterm elections, according to an investigation by Global Witness and the New York University Tandon School of Engineering’s Cybersecurity for Democracy (C4D) team.

"The ads contained ten real-life examples of death threats issued against election workers and included statements that people would be killed, hanged or executed, and that children would be molested," the report said.

Global Witness explained that it submitted the content as ads in both English and Spanish and that Facebook approved nine of the ten ads in English and six of the ten ads in Spanish.

"Once Facebook approved the ads for publishing, Global Witness and C4D removed the ads before they would be displayed on the platform in order to avoid spreading hateful and violent speech," the report added.

#2  During my days of hunting down Jihadi pages on FB, it was curious to see how certain instances went down. I had great success against AQIS (19 pages alone in 2016) but had zero success against Paleo hate pages urging the killing of Jews. Of all the attempts and communications, not one of the Paleo pages was taken down. All these things point to task and design.

Appeals Court: Feds Can Keep All Records Seized In Mar-a-Lago Raid, And There’s Nothing Trump Can Do About It

’s review of documents seized in the Mar-a-Lago raid was invalid, the district court never should have exercised jurisdiction, with the implication that the Special Master process was unauthorized.

The decision points to a massive gap in citizens’ rights. So long that the government lawfully convinces a magistrate judge — in an ex parte proceeeding in which the target has no role — that probable cause exists for a search warrant, the target cannot challenge the government’s possession of documents and property seized within the scope of the warrant. There are some rare exceptions where property is urgently needed by the target, but the types of records seized in Trump’s case did not fall under those exceptions. The only remedy is to move to keep the records out of evidence if there is a criminal prosecution — but during the investigative stage, tough luck.

Here, of course, the search warrant was massively overly broad. And allowed the feds to sweep up a wide range of documents, basically anything in the vicinity of the documents marked classified. Tax, medical, and other records were swept up for review by the feds.

Here’s some key excerpts, but understand, you have almost no rights in the face of federal government-obtained search warrants, unless and until you are prosecuted.

From the Opinion:

This appeal requires us to consider whether the district court had jurisdiction to block the United States from using lawfully seized records in a criminal investigation. The answer is no.

Former President Donald J. Trump brought a civil action seeking an injunction against the government after it executed a search warrant at his Mar-a-Lago residence. He argues that a courtmandated special master review process is necessary because the government’s Privilege Review Team protocols were inadequate, because various seized documents are protected by executive or attorney-client privilege, because he could have declassified documents or designated them as personal rather than presidential records, and—if all that fails—because the government’s appeal was procedurally deficient. The government disagrees with each contention.

These disputes ignore one fundamental question—whether the district court had the power to hear the case. After all: "Federal courts are courts of limited jurisdiction. They possess only that power authorized by Constitution and statute, which is not to be expanded by judicial decree." Kokkonen v. Guardian Life Ins. Co. of Am., 511 U.S. 375, 377 (1994) (citation omitted).

This case was such an expansion. Exercises of equitable jurisdiction—which the district court invoked here—should be "exceptional" and "anomalous." Hunsucker v. Phinney, 497 F.2d 29, 32 (5th Cir. 1974).1 Our precedents have limited this jurisdiction with a four-factor test. Richey v. Smith, 515 F.2d 1239, 1243—44 (5th Cir. 1975). Plaintiff’s jurisdictional arguments fail all four factors.

In considering these arguments, we are faced with a choice: apply our usual test; drastically expand the availability of equitable jurisdiction for every subject of a search warrant; or carve out an unprecedented exception in our law for former presidents. We choose the first option. So the case must be dismissed.

The case is over for all pracitcal purposes:

... Now, with the benefit of oral argument, we conclude that the district court lacked jurisdiction to consider Plaintiff’s initial motion or to issue any orders in response to it....

As for records that may otherwise be "sensitive," it cannot be that prosecutors reading unprivileged documents seized pursuant to a lawful warrant constitutes an irreparable injury for purposes of asserting equitable jurisdiction. Here too, Plaintiff’s argument would apply to nearly every subject of a search warrant. The district court’s unsupported conclusion that government possession of seized evidence creates an "unquantifiable" risk of public disclosure is not enough to show that Plaintiff faces irreparable harm....

The law is clear. We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant. Nor can we write a rule that allows only former presidents to do so. Either approach would be a radical reordering of our caselaw limiting the federal courts’ involvement in criminal investigations. And both would violate bedrock separation-of-powers limitations. Accordingly, we agree with the government that the district court improperly exercised equitable jurisdiction, and that dismissal of the entire proceeding is required.

The district court improperly exercised equitable jurisdiction in this case. For that reason, we VACATE the September 5 order on appeal and REMAND with instructions for the district court to DISMISS the underlying civil action.

A Peek Inside the FBI's Unprecedented January 6 Geofence Dragnet
[Wired] Google provided investigators with location data for more than 5,000 devices as part of the federal investigation into the attack on the US Capitol.

The FBI’s biggest-ever investigation included the biggest-ever haul of phones from controversial geofence warrants, court records show. A filing in the case of one of the January 6 suspects, David Rhine, shows that Google initially identified 5,723 devices as being in or near the US Capitol during the riot. Only around 900 people have so far been charged with offenses relating to the siege.

The filing suggests that dozens of phones that were in airplane mode during the riot, or otherwise out of cell service, were caught up in the trawl. Nor could users erase their digital trails later. In fact, 37 people who attempted to delete their location data following the attacks were singled out by the FBI for greater scrutiny.

Global Tracking Systems (GTS) like GEOFENSE have been around for decades.
Real criminals and terrorists use burner phones (throw aways). If they don't now, they certainly will in the future. What a bunch of dumb asses.

The gov't and FBI will likely get away with the use of GEOFENCE. Federal judges and the courts will NOT want to open up the can of worms (beyond GEOFENCE) that GOOGLE cooperation with the gov't and intelligence community likely represents. Insert 'National Security Concerns' here.

The potential revelation that GOOGLE, FB, and the former Twitter platforms, and others, are actually US gov't funded tools would be very bad for business.....both here, and abroad.

How can anyone now assume otherwise? I mean it is a 'Police State' for non-Democrats right ?
