Chauvin defense attorney asked for mistrial, citing prosecutorial misconduct, publicity; jury convicts on all counts
Continuing the discussion started in comments yesterday here.
[KSTP] The attorney representing former Minneapolis police officer Derek Chauvin asked the court to declare a mistrial, citing prosecutorial misconduct and ongoing comments from public officials they feel will influence the jury's decision.

Shortly after jurors began deliberations, defense attorney Eric Nelson argued that special prosecutor Jerry Blackwell's characterization of his closing argument laid the grounds for a mistrial.

Nelson recited several instances where Blackwell told jurors the defense had created "stories" or were "shading" the truth of what happened on May 25, 2020.

"I do believe that it constitutes ... prosecutorial misconduct," Nelson said.

Retired Hennepin County Judge Kevin Burke, who has watched the proceedings, said there are special rules in Minnesota that govern things you are not supposed to say in closing arguments, particularly in rebuttal to the defense's theory of the case.

"You can be aggressive, but you have to be careful about what you say," Burke said.

Cahill denied the motion for a mistrial, but Nelson tried one more time in light of recent comments by U.S. Rep. The Ageless and Downright Brilliant Comrade Maxine Impeach 45! Waters
...U.S. Representative for California's 43rd congressional district, serving since 1991, a total of 29.38653 years. A member of the Democratic Party, she is the most senior of the twelve black women currently serving in the United States Congress, and a member and former chair of the Congressional Black Caucus. Before becoming a member of Congress she served in the California Assembly, to which she was first elected back when Disco was in flower, in 1976, which would make it 44.38448 years. She has been a politician for virtually all her adult life. If she was a little brighter she'd be a Communist...
. The Caliphornia, an impregnable bastion of the Democratic Party, Democrat had joined protesters on Saturday and pressed for protests to escalate if Derek Chauvin was not found guilty on murder charges.

"There is a high probability that members of this jury have seen these comments," Nelson told the court.

The judge denied the motion, but not before saying the Congresswoman's comments could lead to a verdict being appealed and overturned.

"This goes back to what I've been saying since the beginning. I wish elected officials would stop talking about this case especially in a manner that is disrespectful to the rule of law and to the judicial branch and our function," Cahill said.

Chauvin guilty on all charges in the death of George Floyd
[NYPOST] Former Minneapolis police officer Derek Chauvin on Tuesday was found guilty of murder in the death George Floyd during an arrest last year.

Cheers erupted outside the courthouse as the judge announced that jurors had found Chauvin, 45, guilty on all three charges — second-degree murder, third-degree murder and second-degree manslaughter — on their second day of deliberations. He faces up to 40 years behind bars on the top charge.

Chauvin — wearing a light gray suit, white shirt and blue tie — showed little emotion as the verdict was read, nor as he was lead out of the courtroom in cuffs after Hennepin County District Judge Peter Cahill swiftly revoked his bail.

"We put everything we had into this prosecution," Minnesota Attorney General Keith Ellison said at a presser outside the courthouse after the verdict. "I’m proud of every hour, every minute, and every ounce of effort we put into this case."

Jurors deliberated for more than 10 hours over two days before reaching a verdict in the closely watched case stemming from Floyd’s May 25, 2020, death — which kicked off worldwide protests against police brutality and racial injustice.

The 12-member jury consisted of three black men, one black woman, two white men, four white women, and two women who identify as interracial.

The Minnesota city — and the entire country — was on edge in anticipation of the verdict, with heightened security in place preparing for a renewal of the violent mostly peaceful protests that marred the city after video of Floyd’s death became public.

Hundreds gathered outside the fortified Minneapolis courthouse on Tuesday prior to the announcement of the verdict, calling for justice.
Legal Insurrection summarizes:
Sentencing in 8 weeks, state moving for aggravated sentencing above and beyond guidelines.

FYI, state has filed Blakely motion for aggravated sentencing, above and beyond guidelines, arguments for that will be heard over next couple of weeks.

Chauvin could have had jury make call on aggravation factors, waived that right, Cahill will make that call.

Count 1. 2nd degree felony murder: GUILTY

Count 2. 3rd degree murder: GUILTY

Count 3. 2nd degree manslaughter: GUILTY

#2  I didn't realize until late last week that the Prosecution in Minnesota gets to make two summaries to the jury; one before the defense summary and one after.

That gives the prosecution an enormous advantage since their words are the last the jury hears and furthermore the prosecution can bring out new facts that the defense can't counter or even make non factual or misleading remarks.

I would hope that this would mean a serious review by the Appeals Court of misconduct in addition to the reprehensible jury influencing comments of the Mayor, the Gov, Biden, Waters, etc.

I was also surprised that MN law only required the accused to 'substantially contribute to the death of the victim rather than be the major cause. I only learned that during the second week of the States's case.

#5  Can anyone honestly say that justice was served?

... or that an impartial jury of his peers gave the defendant the presumption of innocence?

Or that the burden of proof was on the prosecution?

That the jury evaluated the evidence introduced at trial with the aid of logic and common sense, and without bias?

That our nation's president complied with the judge's strict warning yesterday that "elected officials" must not intrude on the court's independence and integrity, lest he declare a mistrial?

Or was this trial a political persecution and an insult to our laws, our Constitutional principles and our traditional sense of justice and fair play?

This cannot stand. We cannot accept the obvious fact that what we have witnessed is an episode out of the history of Stalin's Russia, the era of the show trials of the 1930s.

How much longer do we tolerate the continuing desecration of all our sacred beliefs and principles?

#22  This gets back to the question of how you get people to volunteer for military service or law enforcement when they know they will be subject to the whims of politicians who have their heads up the butts. I'm afraid I know the answer. This is one reason why Biden and his ilk want so many immigrants, legal or otherwise. It is expected that these will be ignorant peasants from Third World countries who won't know any better than to obey the orders they get from people like Biden, Harris, Pelosi and Waters.

#23  For Cops, never hurry to a crime in progress scene, and avoid physical contact with minority suspects, even if it means they can walk away. Always use your audible systems as you approach the scene carefully for safety. Lights and sirens are your best legal protection against being forced to arrest someone who is a threat to your life or pension...21st century urban policing made easy, SF style!

#24  This was always going to be a rapid conviction on all charges. Didn't matter what the defense did, or what the prosecution presented.

The jury knew if they voted to acquit on ANY of the charges, their names, faces, family members, phone numbers, employers, and HOME ADDRESS would be leaked to BLM/Antifa for direct corrective action via riot, arson and gunfire, and threats to family members.

It really is that simple.

#29  The Floyd family got a $27 million settlement, why wasn't this action held until after the trial if it was to happen at all? Guilt hadn't been decided yet, no question this swayed the jury.
Along with jurors not wanting to be doxxed & afraid of violence to their families & rioting in their streets.
Jurors being told not to watch the news, this news was everywhere.
Biden giving his views "while jury was sequestered' but the mob outside heard loud and clear. And Maxine inciting the mob...it just boggles

Citing Israel’s military edge, top Democrats aim to slow sale of F-35s to UAE
[IsraelTimes] Raising concerns about implications of transferring stealth jets to United Arab Emirates, Senators Menendez and Feinstein introduce bill requiring congressional oversight on deal.

Top US Senate Democrats introduced a bill that would slow down the sale of F-35 stealth combat aircraft to the United Arab Emirates, part of the deal closed by the Trump administration as an incentive to normalize relations with Israel.

Critics of the sale say it undercuts Israel’s "qualitative military edge" in the region.

Sen. Robert Menendez, the chairman of the Foreign Relations Committee, and Sen. Dianne Feinstein
...Dem Senator-for-Life from Caliphornica. She has been a politician since about the time she was weaned. Feinstein was the author of the 1994 Federal Assault Weapons Ban, and tried it a second time in 2012. Feinstein has chaired the Select Committee on Intelligence since 2009. At age 80, Feinstein is the oldest currently serving United States Senator....
, a longtime former chairwoman of the Intelligence Committee, have introduced legislation that would mandate congressional oversight to ensure that the transfer of the aircraft complied with US law upholding Israel’s qualitative military edge in the Middle East.

"I remain concerned with the implications of a sale of our most advanced fighter jet given numerous outstanding, unanswered questions about the implications of this sale for US national security, our technology interests, and implications for regional stability including the legal parameters of Israel’s Qualitative Military Edge," Menendez said.

An official of AIPAC, the main pro-Israel lobby, said the group had not taken a position on the bill "although we appreciate the senators’ commitment to preserve Israel’s QME."

President Joe The Big Guy Biden
...46th president of the U.S. Former Senator-for-Life from Delaware, an example of the kind of top-notch Washington intellect to be found in the World's Greatest Deliberative Body....
froze the sale, prompting criticism from Republicans that he was undercutting the normalization agreement, dubbed the Abraham Accords. He unfroze the sale last week.

Israel at first opposed the sale but relented after lobbying by top Trump defense officials. A number of pro-Israel Democrats nonetheless remained wary about selling the state-of-the-art aircraft. Israel already has its own F-35 jets.

The oversight according to the bill would considerably delay any sale, and a provision that would require showing "the recipient country has not committed or enabled human rights
...which are usually open to widely divergent definitions...
violations" would likely be onerous for the UAE, which human rights NGOs score low.

The bill also fires a warning shot not to sell the aircraft to Soddy Arabia
...a kingdom taking up the bulk of the Arabian peninsula. Its primary economic activity involves exporting oil and soaking Islamic rubes on the annual hajj pilgrimage. The country supports a large number of princes in whatcha might call princely splendor. When the oil runs out the rest of the world is going to kick sand in the Soddy national face...

#2  Not really, Biden just signed an exec order allowing the seizure of assets for persons and their family. Under this order Biden can arbitrarily seize all of Trump's estates.

#3  The conspiracy is well lodged into the minds of lefties even if totally unproved. Any actions regarding Russia can leverage that info for support.

#4  Unless the internet is being scrubbed, I don't think the collusion fakery will go away. Same way with the stealing of the 2020 election. It seems the votes are still being counted in many places. If the votes are shifted in favor of Donald Trump, will anything be done about it? SCOTUS seems bumfuddled by the whole mess.

Hero Detroit Police Chief Calls for Rep Tlaib's Resignation for Calling for an End to Policing and Incarceration
[100PERCENTFEDUP] bankrupt, increasingly impoverished, reliably Democrat, Detroit
... ruled by Democrats since 1962. A city whose Golden Age included the Purple Gang...
Police Chief James Craig is fed up with politicians like Rep. Rashida Tlaib for calling for an end to policing and incarceration (see below).

During an interview with local Fox 2’s Let it Rip Weekend, Chief Craig literally let it rip on Rep. Tlaib:

"I’d love to see her resign, I’d throw her a goodbye party. Let her go. Who is she speaking for Charlie? Let me just say this, when you talk about abolishing police, incarceration, you talk about safe cities...what do you think the residents in Detroit want? If I made comments on par with hers, they’d be calling for my resignation."

Chief Craig also called her out on fake news CNN
...formerly the Cable News Network, now who know what it might stand for...
by saying she’s just trying to call attention to herself. Chief Craig believes this is all about politics and he’s right. He had previously said he believes Rep. Tlaib’s comments are "reckless and disgusting."

Andrew Cuomo just keeps the lies coming
[NYPOST] "New York’s success in dealing with COVID is inarguable," Gov. Andrew Sonny Cuomo claimed Monday at another one of his highly controlled pressers, even as a new study suggests the Empire State failed worst in the nation when you consider both the health and employment consequences of the pandemic and the lockdowns.

The report from Hamilton Place Strategies notes that New York lost more jobs, per capita, than any other state except Hawaii (55,000 per million population) and saw among the worst corpse counts (about 3,300 "excess deaths" per million residents, with only Mississippi clearly worse, at 3,800).

OK: Part of New York’s suffering was bad luck. Since New York City is a global hub, we got hit hard early, before anyone realized how much the bug had spread. And any state with a strong tourism industry took a big jobs hit, too.

But the fact is that Cuomo was pooh-poohing virus fears well into last March, even slapping down Mayor Comrade Bill de Blasio
...cryptocommie mayor of New York and for some reason a Dem candidate for president in 2020. Corrupt and incompetent, his qualifications for office seem to consist of being married to a black woman, with whom he honeymooned in Cuba. He has a preppy-looking son named Dante, whose Divine Comedy involved getting his back hair up when a police car drove past him slowly. New Yorkers voted for him, so they deserve him...
’s concerns.

Then he changed course in the worse way possible — shutting everything down in a stringent lockdown that pummeled businesses, even as he forced nursing homes to take COVID-positive patients. So he failed to protect the most vulnerable and locked down the people who were the least in danger.

The governor has long insisted his leadership saved New York from a far worse fate. About 45,000 suckers bought the book where he explains that at length. Now he’s facing an investigation by the state attorney general over whether he illegally forced staff to do work on the book — which reportedly earned him a $4 million advance — at the height of the crisis last year.

Yet Cuomo now says, "I’m going to focus on my job. That’s what I’ve always done" — time out for his book aside?

Even when he’s severely limiting press access, the gov resorts to nonstop lies and deceptions: The Monday event also saw him pretending it’s become impossible to do in-person pressers (though he routinely did them at the pandemic’s height) and also ignoring the state’s bevy of mandates on local governments as he insisted that property taxes are the real problem for New York taxpayers, not the taxes he just agreed to hike by $4.3 billion.

He’s a real peach.

#1  "New York’s success in dealing with COVID is inarguable,"

This is a true statement, just not in the way he thinks it is.

#2  The disappearance from the MSM nightly propaganda films is proof of his fate. He is being disappeared as no longer useful to the flailing narrative of Covid-Forever...
