Administration's ‘Catch and Release' Policy Struck Down
[Epoch Times] The federal government’s program of releasing many illegal immigrants rather than holding them until their cases are resolved violates federal law, a U.S. judge ruled on March 8.

"The evidence establishes that Defendants have effectively turned the Southwest Border into a meaningless line in the sand and little more than a speedbump for aliens flooding into the country," U.S. District Judge Judge T. Kent Wetherell, a Trump appointee, said in the ruling.
So now what?
Wetherell struck down Alternatives to Detention, a program through which President Joe Biden’s administration has released more than one million aliens into the U.S. interior.

Florida Attorney General Ashley Moody, a Republican, sued the government in 2021 over the policy, arguing the catch-and-release policy violated federal law.

Biden administration officials have claimed they had the discretion not to hold immigrants and that Florida lacked standing.

Under Supreme Court precedent, immigration officials have "broad discretion" in carrying out immigration laws, but must adhere to laws established by Congress. The Immigration and Nationality Act, one such law, states that immigrants who arrive at the border without proper documents are subject to quick removal without a hearing or review. Immigrants who claim asylum can have their claims heard but "shall be detained" until the claims are resolved.

The "shall be detained" wording "means what it says and that is a mandatory requirement," Wetherell said in the new ruling.

The judge also said Florida has standing because it has a procedural right under Administrative Procedure Act and a quasi-sovereign interest in its territory and on illegal aliens being within that territory. The government’s failure to hold immigrants as required by the Immigration and Nationality Act, according to the judge, harms states because "they cannot do anything to keep those aliens out of the state." States are also harmed because they have to spend money to deal with the aliens, the ruling said.
Send 'em all back? Oh, the horror! So unfair! Lots of harpy screeching.

#1  What about if the immigration service is transporting them across the border and about the country like they are Illegal Immigrant Uber rather than the arm of government charged with enforcing immigration law?

#2  State of Florida lacks standing? Well then, who's gonna pay for those people when Biden buses them to Florida? Biden? Hmmm?

I fear that SCOTUS will bite on this claim.

#4  Florida lacks standing

Not sure why the commenter said this. What the article stated is: The judge also said Florida has standing because it has a procedural right under Administrative Procedure Act and a quasi-sovereign interest in its territory and on illegal aliens being within that territory.

-Land of the Free
When You've Lost the Daily Mail...
[Daily Mail] Over the course of two years, hundreds of witness interviews, and 10 highly choreographed public hearings, Democrats in Congress sought to create a carefully constructed story of the January 6th Capitol Hill riots.

How fitting that such an extravagant outlay of government resources would be thrown on the trash heap by a single cable news segment.

On Monday night, Fox News' Tucker Carlson played never-before-seen footage of the Capitol riot. The closed-circuit security tape appears to show the notorious, so-called QAnon Shaman (a.k.a. Jacob Chansley) being led through the halls of Congress by police.

The video has no audio, so we can't hear what the police told Chansley. But we can see with our own eyes - Chansley didn't overpower anyone.

In fact, it looks like Capitol Police willingly guided him, shirtless and adorned in horns, into the Senate chamber for his infamous photo-op.

So, for all the effort and expense poured into the January 6th committee, why is America only seeing this footage now?

The answer is obvious. It didn't fit the Democrats' narrative, so it was left out.
We will all be shocked, of course, when the Dems win the next election with the widest margin ever /sarc

#2  Chansley plead guilty to 'obstructing an official proceeding'

the new video tape evidence is not exculpatory to that charge

however, the new video, showing him mostly complying with instructions of capital police, may be exculpatory to his 41 month sentence - I don't know how that works in D.C.

#3  And how long was he in the J7 Gulag, in solitary confinement before he gave up and pleaded guilty?

His defense attorney was never given access to these video - so I imagine he accepted a plea deal based on 'plead guilty to this lesser charge, and get the mental help you need --OR-- back to solitary confinement until we try you in a few years'.

Government Corruption
SoCal Mountain Disaster: Newsom Seems Incompetent and Indifferent?

Caliphornia, an impregnable bastion of the Democratic Party, Governor Gavin can't be Bee'd Newsom
...the Mitt Romneyesque mayor of San Francisco as it transformed itself into Poopville, currently governor of California as it transforms itself into Cinderland...
’s incompetent response to the unprecedented winter storms that have buried mountain towns in both Northern and Southern California under more than a foot of snow has led to the deaths of at least three people in San Bernardino County, and those involved in volunteer search and rescue efforts believe that body count will climb.

While the area receives some snow every year and has snow plows and other snow removal equipment, it received a year’s worth (or more) of snow over a seven-day period. Newsom declared a State of Emergency the morning of March 2 just prior to jetting off for Cabo for the weekend, but the promised assistance from state officials still hasn’t arrived, for the most part — and that’s had deadly consequences.
And caught Covid in Messico
Longtime resident Susie Newman-Harrison, a private pilot affiliated with CalDART, a volunteer network of pilots who help during disasters, including this one, described the conditions on the morning of Tuesday, March 7:

#4  Blame the battery-powered generators for lack of heat and battery-powered snowblowers for the exceptional street clearing.
On the serious side, saw a video dated 1 March where a Union Pacific freight engine was creeping through an intersection: seems to me if a locomotive could get there, some outside the box thinking could have put some freight cars behind it with supplies or a cut of passenger cars (UP has their heritage pax fleet all tuned up for season’s excursions) to evacuate those stranded.

is taking a whole-of-government approach to torturing new Twitter under Elon Musk into silence. Those damn Twitter Files have gotten under someone’s skin and the FTC is on the case, demanding that Twitter "identify all journalists" who have had a look. That should get someone’s attention. The FTC demand is part of a broader investigation on which the Wall Street Journal reports here ("The FTC is also seeking to depose Mr. Musk in connection with the probe"). The New York Post reports the story in accessible form here. Fox News reports on the demand for the identification of journalists'.

Controversial Biden FCC Nominee Withdraws After Democrat Concern over Anti-Police Rhetoric
[Breitbart] President Joe Biden’s FCC pick, Gigi Sohn, withdrew her nomination Tuesday after she faced criticism for her anti-police rhetoric and other controversial views.

Sohn withdrew her nomination after facing severe criticism from both Republicans and Democrats over her controversial views. This ends the 16-month battle over her nomination.

The Democrat nominee said she decided to withdraw after facing “unrelenting, dishonest, and cruel attacks” from the cable and media lobbyists. Democrat commissioners at the FCC have been stalled from carrying out their agenda because they have been unable to secure a majority at the agency.
