Two years ago this month, the University of Pennsylvania law school stopped accusing a tenured professor of making up statistics about black student performance, which she called defamatory, after ignoring requests for the supposedly correct statistics going back four years.
Dean Ted Ruger still sought "major sanctions" against Amy Wax for "intentional and incessant racist, sexist, xenophobic, and homophobic actions and statements," and disgraced ex-President Liz Magill approved a hearing board's recommended one-year suspension, slashed pay and mandatory scarlet letter in her public appearances.
As Wax awaits a decision on her final appeal of the sanctions, Duke University's health system faces similar accusations of retaliation against a doctor for calling out the admitted lack of clinical evidence behind its claim that "racism is a public health crisis" in a May 2021 pledge against "racism, bias, and hate" that was purportedly "guided by science."
Duke Health notified Raleigh emergency room physician Kendall Conger his contract was not being renewed after June 30 under "termination not for cause," because his behavior is "negatively impacting the emergency physician team, which could jeopardize the care of patients" and undermines its "respectful and collegial work environment."
Administrators commonly use perceived lack of collegiality to circumvent academic freedom promises, and at least two federal appeals courts upheld its invocation against race-related speech at public universities in the past year, although the private Duke isn't affected by them.
Asked if Duke Health's action following Conger's public speech could be investigated as a violation of its accreditation terms, its accreditor The Joint Commission told Just the News it "works with healthcare organizations to identify potential risks to patient safety and improve quality of care" but didn't say whether violation of academic freedom is grounds for a probe.
"Based on the nature of the complaint, a number of actions may result, including the potential for an immediate, for-cause survey by The Joint Commission, the state of jurisdiction, or other agencies," but it does not disclose "complainant identity and details of complaints," spokesperson Maureen Lyons said.
Conger exposed Duke Health's lack of clinical evidence for its pledge claim in an article for the North Carolina-based James G. Martin Center for Academic Renewal in May 2023, posting the top of a redacted Feb. 18, 2022 email from a person Conger called a "senior administrator."
The person said "I have looked" without success for a "randomized blinded trial that proves implicit bias is the cause of worse health outcomes for African Americans," but insisted there's "ample causal inference data in the social sciences that link the two" and "undeniable trends" show that "people of color" have worse clinical outcomes in America, "even at Duke."
Conger said he responded that Duke Health is not supposed to rely on such "inherently political" data. "Duke was presuming to make a political assertion on behalf of its employees, who were in no position to push back … acting politically under the guise of medical science," he wrote.
Though Duke Health's May 12, 2021 internal announcement of the new pledge invited staff to share "any experience or perspective contrary" to the pledge's statements, Conger said it didn't respond to his first general or second more detailed query on whether it promotes "equal outcomes for groups, or the equal treatment of individuals?”
He threatened to go public two months later,, if it ignored his third query, with his concern that Duke Health will spark "a real public-health crisis … from favoring a race-based ideology over evidence-based care."
Conger shared his "farewell address" with online publication American Thinker July 2, accusing Duke Health of "leading us away from the successful melting-pot vision to the dreadfully unsuccessful socialist vision" based on the dogma that "whites are unconscious racists."
"I have social science data Duke probably doesn’t want to hear," he wrote. "Of course there was no clinical data. It’s not a scientifically provable hypothesis but a failed political ideology."

[PJ] In the hail storm of epiphanies — real or imagined — that have been hitting the Democrats since Joe Biden's debate disaster, the realization that First Lady Jill Biden isn't much of a team player seems to be a surprise to many of them. A lot of us here on the Right have known all along that she would be the immovable object when the rest of the party finally admitted that it was time to insist that her husband step aside.
I still maintain that Joe didn't really want to run all that badly in 2020, but the missus had it on her "honey do" list and would not be denied.
This is something I wrote in the Morning Briefing four years ago yesterday:
The longer the Joe Biden Obvious Decline Circus is allowed to go on, the more I’m convinced that Jill Biden is a power-hungry madwoman who so desperately wants to be in the White House that she is willing to subject her husband to what has now become bipartisan ridicule. If Joe Biden were your grandfather you would be worrying yourself into an ulcer about him and making sure that you helped him maintain as much dignity as possible.
Four months before the 2020 election, and we all knew the truth about Joe Biden that the Democrats are just pretending to have figured out at the end of last month. The headline of that Briefing was "Jill Biden Wants to Trash Her Husband's Dignity to Be Edith Wilson 2.0."
Nothing has changed, despite the crescendo of cries from more and more Democrats for Biden to remove himself from the race.

The media is there to — as President LOLEightyonemillion infamously said in June — "play by the rules" and do the Bidens' bidding.
Jill Biden has no doubt been assailed by Dem elites since the debate because they know that they need her blessing to make the change at the top that they're so desperate to make. Those conversations can't be very pleasant. As Matt Vespa writes over at Townhall, Mrs. Biden doesn't share their interests, "so the party is in Purgatory."
The Democrats are deep in "be careful what you wish for" territory, and it is Jill Biden who brought them there. If the power brokers in the Democratic National Committee really did think that Joe Biden would relinquish power and not run for a second term, they were obviously overlooking his wife. If she is feeling slighted, it's only going to strengthen her resolve to keep her husband propped up in the Oval Office for as long as she can.
Jill Biden is the de facto President of the United States now and most likely has been for most of her husband's time in office. That's a gig that she isn't giving up without a bloody fight. If I were betting on the winner of the brawl, all of my money would go on her.

It's really unfair to Edith. Presidents back then didn't have the power or the pomp and ceremony of today. Edith was pretty much protecting her husband and both parties, back when Congress had far more power, weren't in a hurry for the VP (about as bright as Harris) to take power.
Jill has more in common with Elena Ceaușescu with the lust for power and position in the government.

On June 19, Hezbollah leader Hassan Nasrallah threatened that if Israel starts an all-out war against it, Hezbollah will conquer the Galilee, flatten the rest of Israel, and attack Cyprus. On June 29, Iran threatened that if Israel escalates the situation, "a war of extermination will begin."
These threats do not indicate self-confidence but rather hysteria. Even nine months after the start of the war, Tehran still estimates that in an all-out war, Israel will deal a fatal blow to Hezbollah, its most important ally. But no less important than that, in several months, there has been a dramatic change in Iran's position towards the war, and in order to understand where Iran and Hezbollah stand today, it is necessary to return to the beginning.
The massacre on October 7 was initiated by Yahya Sinwar without coordination with Beirut and Tehran. Khamenei and Nasrallah financed, trained, and armed Hamas, but that morning, they were as surprised as Israel. Sinwar decided to attack without coordination because he knew they would forbid him. Israel would announce that if Hezbollah does not withdraw, it will start an all-out war, and the United States will undertake to support it with weapons, intelligence, and support in the Security Council. Israel will have to concentrate very large forces in the North in order to convince Nasrallah of the sincerity of its intentions.
If Nasrallah and Tehran are convinced, he will likely withdraw on the assumption that his people will be able to infiltrate back as soon as possible, just as they did in 2006. [10News] Make em pay New York University has settled a lawsuit filed last November by three Jewish students who said they had been subjected to "pervasive acts of hatred, discrimination, harassment, and intimidation" since the start of the Israel-Hamas war.
NYU and the plaintiffs' attorneys announced the settlement Tuesday. It includes undisclosed monetary terms and a commitment from NYU to update its antisemitism language in its Guidance and Expectations for Student Conduct.
NYU officials also said they would dedicate additional academic resources to Judaic studies and the study of antisemitism and strengthen the university's existing relationship with Tel Aviv University.
"We are committed to continuing our vigorous efforts to confront discrimination, including antisemitism, and the settlement in this litigation is yet another step in this direction," NYU President Linda G. Mills said.
In the complaint filed in Manhattan federal court, the students said antisemitism had been a problem at NYU for years and had worsened after Hamas' Oct. 7 attack on Israel sparked an intensive Israeli military campaign in Gaza.
The plaintiffs said their complaints about antisemitic threats and intimidation had been "ignored, slow-walked, or met with gaslighting by NYU administrators."
Marc Kasowitz, an attorney for the plaintiffs, said in a statement that NYU "is to be commended for taking a leading position among American universities in combating antisemitism on campus." He added, "Other universities should promptly follow their lead."
