[Yahoo] A U.S. judge in Florida on Monday dismissed the criminal case accusing Donald Trump of illegally keeping classified documents after leaving office, handing the Republican former president another major legal victory as he seeks a return to the White House.
U.S. District Judge Aileen Cannon, who was appointed to the bench by Trump, ruled that Special Counsel Jack Smith, who is leading the prosecution, was unlawfully appointed to his role and did not have the authority to bring the case.
The judge found that U.S. Attorney General Merrick Garland, who named Smith in 2022 to oversee investigations involving Trump, did not have the authority "to appoint a federal officer with the kind of prosecutorial power wielded by Special Counsel Smith."
Cannon also found that Smith's investigation has been improperly funded through a permanent and unlimited fund Congress set aside in the 1980s for independent investigations.
It marked another blockbuster legal triumph for Trump.
The U.S. Supreme Court ruled on July 1 that Trump cannot be prosecuted for actions that were within his constitutional powers as president - a landmark decision recognizing for the first time any form of presidential immunity from prosecution. That ruling involved charges pursued by Smith in a separate case against Trump in Washington involving his efforts to overturn his 2020 election loss.
Cannon's ruling came two days after Trump was the target of an assassination attempt at a campaign rally in western Pennsylvania. Trump is set to be formally named the Republican presidential nominee in Milwaukee this week, challenging Democratic President Joe Biden in the Nov. 5 U.S. election.
Prosecutors are likely to appeal Cannon's ruling. Courts in other cases have repeatedly upheld the ability of the U.S. Justice Department to appoint special counsels to handle certain politically sensitive investigations.
Trump, in a social media post, said Cannon's ruling should be a "just the first step" and called for the dismissal of all four criminal cases against him.
"Let us come together to END all Weaponization of our Justice System," Trump wrote.
Trump was convicted in May on New York state felony charges involving hush money paid to a porn star to avert a sex scandal before the 2016 election. Trump had pleaded not guilty in the documents case and in Smith's other case, as well as to election-related charges in state court in Georgia.
A spokesperson for Smith did not immediately respond to a request for comment.
In the documents case, Trump was indicted on charges that he willfully retained sensitive national security documents at his Mar-a-Lago estate in Florida after leaving office in 2021 and obstructed government efforts to retrieve the material. Prosecutors have said the documents related to U.S. military and intelligence matters, including details about the American nuclear program.
Two others, Trump personal aide Walt Nauta and Mar-a-Lago property manager Carlos De Olivera, were also charged with obstructing the investigation.
'BREATHTAKINGLY MISGUIDED'
U.S. Senate Majority Leader Chuck Schumer, a Democrat, said in a statement: "This breathtakingly misguided ruling flies in the face of long-accepted practice and repetitive judicial precedence. It is wrong on the law and must be appealed immediately. This is further evidence that Judge Cannon cannot handle this case impartially and must be reassigned."
At the very least, Cannon's ruling throws the future of the case into doubt. Trump's lawyers have not made a similar challenge to the special counsel in Smith's election-related case.
Trump's lawyers challenged the legal authority for Garland's 2022 decision to appoint Smith to lead investigations into Trump. They argued that the appointment violated the U.S. Constitution because Smith's office was not created by Congress and the special counsel was not confirmed by the Senate.
Lawyers in Smith's office disputed Trump's claims, arguing that there was a well-settled practice of using special counsels to manage politically sensitive investigations.
"This ruling flies in the face of about 20 years of institutional precedent, conflicts with rulings issued in both the Mueller investigation and in D.C. with respect to Jack Smith himself," said Bradley Moss, an attorney who specializes in national security, referring to an investigation conducted by Special Counsel Robert Mueller during Trump's presidency.
Moss also said the ruling raises the question of whether Smith will seek to have Cannon removed from the case.
Cannon's ruling is the most consequential in a series of decisions she has made favoring Trump and expressing skepticism about the conduct of prosecutors. The judge previously delayed a trial indefinitely while considering a flurry of Trump legal challenges.
In an unusual move, she allowed three outside lawyers, including two who sided with Trump, to argue during a court hearing focused on Trump's challenge to Smith's appointment.
Conservative Supreme Court Justice Clarence Thomas provided a boost to Trump's challenge to the special counsel. In an opinion agreeing with the court's decision to grant Trump broad immunity, Thomas questioned whether Smith's appointment was lawful, using similar arguments to those made by Trump's lawyers.
Garland appointed Smith, a public corruption and international war crimes prosecutor, to give investigations into Trump a degree of independence from the Justice Department under Biden's administration.

MSNBC pulled its flagship AM program "Morning Joe" from airing on Monday in the wake of the assassination attempt on former President Trump.
Viewers who tuned in expecting to see the staunchly anti-Trump program, hosted by Joe Scarborough and Mika Brzezinski, were greeted instead by continued NBC News special reporting on the attempt on Trump's life on Saturday. A spokesperson said "Morning Joe" will resume airing on Tuesday.
According to a CNN report, a person familiar with the decision said it was made in part over fear that one of the show's many guests over a four-hour broadcast "might make an inappropriate comment on live television that could be used to assail the program and network as a whole."
According to CNN's report, Cesar Conde, the chairman of NBCUniversal News Group, decided to yank the show in consultation with MSNBC president Rashida Jones, as well as the show's co-hosts.
The call by MSNBC to keep "Morning Joe" off the airwaves shocked political observers, with some conservatives saying it demonstrated a lack of trust in one of its most high-profile shows to sensitively cover a fraught situation.
"The fact that Morning Joe's own network can't trust its flagship brand not to spew reckless and inflammatory crap during breaking news tells you all you need to know about the credibility of the MSNBC line-up," a veteran Republican consultant told Fox News Digital.

Separately, the US Central Command said in a statement on Sunday that it has "destroyed two Iranian-backed Houthi uncrewed aerial vehicles (UAV) over the Red Sea and one uncrewed surface vessel (USV) in the Red Sea," as well as "one Houthi UAV in a Houthi-controlled area of Yemen."
"It was determined these systems presented an imminent threat to US, coalition forces, and merchant vessels in the region," US Central Command added.

Iran has been smuggling weapons and expertise needed to develop long-range precision missiles and drones to the Houthis for many years. In some cases, ships destined for Yemen have been interdicted by the US Navy and other navies that patrol off the coast. In those cases, the boats are usually disguised as commercial vessels. These types of commercial vessels may also not be very sea worthy and they can disappear in rough seas. Iran’s navy has also suffered recent setbacks.
One of its warships, the Sahand, capsized in the Iranian port of Bandar Abbas on July 7. It is one of several recent Iranian naval accidents.
According to the report at Al-Ain, security sources in Yemen “revealed to Al-Ain that the terrorist Houthi militias lost contact with a large transport boat that was on a smuggling mission via a regular sea route from the Horn of Africa countries to the coasts of the governorate overlooking the Red Sea.” The vessel was also carrying “foreign experts” and military materials for the manufacture of missiles and materials for the manufacture of explosives. It was supposed to arrive in Yemen on Friday but disappeared on Saturday.
In response the Houthis have mobilized along the coast. The Houthis do not have a large navy but they have small boats. In many cases they have used small boats as kamikaze boats to attack ships in the Red Seal. The Houthis also have drones. The Houthis mobilized fishing boats to search for the vessel. However, fishing boats don’t have the technology or range necessarily to conduct searches of this kind.
The Houthis have not asked for outside assistance and it does not appear a distress call was monitored from the smuggling vessel. The reports from Yemen say that “military personnel of non-Yemeni nationalities,” were on the ship. It was not clear if these were Iranians or other supporters of the Houthis. Iran has sent IRGC members in the past to back the Houthis.
HOUTHIS BELIEVE US INVOLVED IN BOAT'S DISAPPEARANCE
The Houthis, in urgent meetings, expressed concern that the ship may have been targeted by the US-backed Prosperity Guardian mission that is designed to protect ships in the Red Sea from Houthi attacks. The Houthis are concerned that the ship may have been interdicted by US or European navies. “The large transport boat may have fallen into the hands of the Americans," sources told Al-Ain.
The missing vessel is described as very valuable to the Houthis who have been attacking international shipping for nine months in support of Hamas. Al-Ain claimed that some sources they spoke to believe that "the loss of this boat comes after Washington and international naval forces intensified their pursuit of Iranian arms shipments smuggled to the militias, while arresting the foreign military experts on board the boat, if it is stopped by American forces, would provide the best way to map the smuggling routes used by Tehran to transport weapons to the Houthis."
The report also is supposed to add evidence to the smuggling of weapons and munitions to the Houthis. This is apparently also happening from countries in the Horn of Africa, which illustrates a new route that is potentially developing to back the Houthis. It was not immediately clear which countries this refers to. The weapons flow to ports in Yemen such as Al-Salif, Al-Ain claimed. The smuggled weapons are unloaded and night and make their way to Houthi forces in the area.
In addition to the Houthi search for the missing vessel, US Central Command said on July 14 that “in the past 24 hours, US Central Command (USCENTCOM) forces successfully destroyed two Iranian-backed Houthi uncrewed aerial vehicles (UAV) over the Red Sea and one uncrewed surface vessel (USV) in the Red Sea.” The uncrewed surface vessels are Houthi kamikaze boats that the Houthis have recently been using more frequently in attacks.

#6 I have known people like her. Fear doesn't seem to be one of their emotions no matter what happens around them. One of the people I knew who were like that was a Brazilian woman who had been hit by a stray bullet as a teenager and survived. She turned out to be one of the strongest women I ever met. She handled difficulties with unusual attitude of stoic courage, grace, and self confidence.

[NY Post] The assassination attempt on former president Donald Trump that played out live on national television should have resulted in the kind of objective, unbiased coverage the country deserved at such a terrifying moment.
Some outlets, however, failed the test miserably.
Take these headlines, for example, in the immediate aftermath:

Associated Press: "Donald Trump Has Been Escorted Off The Stage During A Rally After Loud Noises Ring Out In The Crowd"
The New York Times: "Trump Hurt, But Safe, After A Shooting"
Forbes: "Will Surviving Gunfire Be Donald Trump’s Next Appeal To Black Voters?"
Politico: "In wake of the rally shooting, GOP officials have been quick to blame Democrats for demonizing Trump"
There’s more, but you get the idea.
Needless to say, it was abundantly clear that Trump had been shot once he was brought to his feet by Secret Service agents about one minute after being hit.
Shots could be heard before he crouched down to take cover.
His visibly injured ear had splashed bright red blood across his face that was clear to see, even at a distance.
Yet we had CNN initially reporting he had fallen?
How about the Times and Politico calling this "a shooting" instead of an assassination attempt?
How about Forbes wondering, just hours after the attack, if it would make Trump more appealing to black voters?
And Politico, scolding Republicans for seizing and pouncing on Democrats, angry that they and their allies in the media have referred to Trump as Hitler for eight years?
Margaret Brennan of CBS News, the former home of Walter Cronkite, even managed to victim-blame Trump for nearly getting killed, after reading a statement from the former president thanking the Secret Service and describing what had happened.
"I did notice there was no call for lowering the temperature, condemning all political violence, and really trying to signal to his supporters as well, not to retaliate or to have any kind of escalation here," was Brennan’s immediate reaction.
There are no words.
It somehow got worse over on ABC News Sunday morning during a conversation between George Stephanopoulos and Martha Raddatz, who fancy themselves as serious journalists.
"President Trump and his supporters have contributed to this violent rhetoric as well," Stephanopoulos, Bill Clinton’s former attack dog, argued.
"Absolutely, George," Raddatz concurred.
"And let’s remember Jan. 6," she added.
Many of us will recall forever the iconic moment when a bloodied Trump, surrounded by his Secret Service detail, pumped his fist at the crowd and urged them to "Fight. Fight. Fight."
Trump just proved that he’s a pure warrior after his heinous assassination attempt
It was emblematic of Trump’s toughness and determination and defiance, even after taking a bullet to the ear just one minute earlier.
But on CNN, this was seen as a big no-no, even as the horrific scene was unfolding.
"That’s not the message that we want to being sending right now," CNN’s Jamie Gangel chided the wounded candidate. "We want to tamp it down."
Yes: The network that has endlessly attacked Trump as a racist, fascist demagogue seeking to destroy democracy was lecturing him just seconds after he was a millimeter away from being murdered.
For these outlets, there’s no coming back from this.
Their rhetoric has been building for years without any accountability.
Media figures’ most hyperbolic and personal and dishonest attacks on Trump have not only cost them no consequences, but have probably brought them raises and promotions with each new contract.
As for President Biden and his speechwriters, they have helped foment this deadly environment.
Here’s what the president said on July 8: "We’re done talking about the debate, it’s time to put Trump in a bullseye."
Last year, Rep. Dan Goldman (D-NY) expressed a similar sentiment when he spoke to Jen Paski on MSNBC.
"That man [Trump] cannot see public office again," Goldman said. "He has to be eliminated."

[ZeroHedge] Embattled President Biden opened up a meeting with a group of Democratic US representatives by challenging them to ask him "hard questions" about his candidacy and his fitness to serve -- only to jump down the throat of a member who sought reassurance about the 81-year-old's ability to serve as a strong commander-in-chief. His loss of temper and ill-preparedness for the meeting reportedly did nothing to bolster his audience's confidence.
That audience for the Saturday video conference call was the New Democrat Coalition, a group comprising some 100 centrist Democrats. While the group's chairwoman, New Hampshire Rep. Anne McLane Kuster, politely characterized the conversation as "candid, respectful and productive," members speaking to reporters anonymously were far less charitable about Biden's performance.
"That was a complete disaster. We saw the same Joe Biden from the debate," one of the House reps on the roughly 30-minute, late-afternoon call told Axios. Another said the call was "awful," while a third said "members were not holding back."
[JustTheNews] Illinois Gov. J.B. Pritzker has joined Chicago Mayor Brandon Johnson in blaming Republicans for violent crime in the city. A Chicago Republican says the issue is the Democrats’ “bad policies.”
Pritzker said there is more violence in Chicago because Republicans defunded community violence interruption programs.
“You end up with, and the study from Northwestern shows it about Illinois, you end up with more violent crime,” Pritzker said. “It’s Republicans that have caused this problem.”
The governor referred to a Northwestern University study published last year that found that individuals who completed the full Chicago Real Economic Destiny Program were 73% less likely to have an arrest for a violent crime in the two years following enrollment than those who did not participate.
The Northwestern researchers also found that the rate of firearms victimization remained statistically unchanged during the study period.
Pritzker announced $100 million in private funding from civic groups in an attempt to prevent more violence. The state budget includes $180 million in taxpayer funds for violence intervention and youth summer jobs programs.
On several occasions, Chicago Mayor Brandon Johnson blamed Republicans for the issues around crime for what he said was decades of community disinvestment.
South Side GOP Chairman Devin Jones is the 18th Ward Republican Committeeman. He said the criticism was strange in a city which has no Republican elected officials at any level.
“The issue is the bad policies of the city of Chicago, of Cook County and the state of Illinois,” Jones said.
The most recent criticism of Republicans by Pritzker and Johnson came after more than 100 people were shot in Chicago from July 4 through July 8.
Jones said the GOP is not to blame for violent crime in Chicago.
“So this is a Brandon Johnson and his progressive allies issue and not an issue of Republicans or some other boogeyman party. This is their problem. It is his [Johnson’s] fault and four of his predecessors. This all rests with them,” Jones said.

Dems are in a real conundrum. If Trump is really an evil super villain dictator who wants to destroy our system of government or whatever then assassinating him would be morally justified. But they don’t want to justify this, which means they’re confessing that everything they said about him for ten years was nonsense. They either have to openly defend this assassination attempt or admit that they’re full of shit. There is no good option. They’re screwed.

Assigning those odds was not just the Times’ effort to inform their readers. It was also an effort to crush him. They came not just to condemn Trump, but to bury him. I recall that when Trump won, the Times penitently admitted to being easy on the B.O. administration, but promised to be ever so much more diligent in the future.
Imagine their chagrin when Trump proved them wrong. Imagine, too, the chagrin of Hillary Clinton and the rest of the establishment. The former "smartest woman in the world?" aka "The Thing That Wouldn't Go Away?"
In discerning their chagrin, you don’t actually need to use your imagination at all. We saw it. They blocked Trump’s every effort at governance with dishonest smears like the Russian collusion hoax, two impeachments, and the pee-pee dossier. In their effort to prevent Trump from governing the country effectively, they were willing to prevent him from governing the country at all – the country be damned. The Dems promptly formed The Resistance®, named after Hezbollah and its allies. Maxine Waters actually called for his impeachment before he was inaugurated.
But the attacks on Trump in his first term didn’t kill him; they only made his stronger. They did keep him from doing some things he wanted to do, like finishing the wall and making Mexico pay for it.
He found a way to govern the country, and he did it effectively. A good example is his nomination of three conservative Supreme Court Justices, every one of which he successfully got confirmed by the insiders of the world’s most exclusive club – the United States Senate. That Trump did so well is a tribute to him personally. That Biden has been so consistently incompetent is an indictment of the Democrat Party.
Americans today give Trump’s presidency higher marks than they give Joe The Big Guy Biden ...46th president of the U.S. Former Senator-for-Life from Delaware, an example of the kind of top-notch Washington intellect to be found in the World's Greatest Deliberative Body.... ’s, and in the most important issues like the economy, immigration and foreign affairs, they prefer Trump. That’s why he’s leading in the polls (that, and the fact that his opponent is a senile dolt). Which is why they tried to murder him.

Democrat incompetence has undermined most of the rest. The American people see the lawfare for the corrupt scheme that it is, and Trump’s fight as the righteous one that it is. He’s gone up in the polls. The ghost of Boss Tweed is trying to figure what went wrong.
And this time, he shows a discipline that he’d never shown in 2016. He more often thinks and takes advice before he opens his mouth. He’s stronger. He also lets the Dems do a frabjous job of hanging themselves.
A good example is his handling of the Democrat civil war over Biden’s candidacy. It must be tempting for Trump to pour gasoline on the self-immolating Democrats, but he’s mostly smart enough to let them do it themselves. To fling any 100 octane risks raising sympathy for the bastards.
Leftists are by nature authoritarians. See, e.g., Stalin, Joseph; Zedong, Mao; Pot, Pol. Among the documents from which the secrecy classification has been removed, one can see on the electronic portal of the library intelligence reports on the situation in the territory occupied by the enemy, reports of the agent "Colonist" (N.I. Kuznetsov), intelligence information on the training of intelligence officers and saboteurs by the enemy in special schools, reports of the head of the Main Directorate of Counterintelligence "SMERSH" V.S. Abakumov to the State Defense Committee of the USSR on the atrocities of the Gestapo, the use of gas chambers to destroy the civilian population.
Also in the public domain are now documents of the FSB Directorate of Russia for the Voronezh, Rostov and Novgorod regions, Krasnodar Krai - these are reports of the regional NKGB directorates with intelligence data on the situation in the territory temporarily occupied by the Nazis, on the results of operational-Chekist work in the liberated areas, on Soviet citizens driven to work in Germany, on captured documents of the German army and occupation authorities and other documentary evidence.
Of particular interest are the SMERSH documents on the arrest of German intelligence and counterintelligence agents, in particular on the detention of German agents Tavrin and Shilova, who were sent into the Soviet rear to assassinate I.V. Stalin.
Among the declassified documents of the NKVD/NKGB of the USSR and the Main Directorate of Counterintelligence "SMERSH" from 1943-1944, there are also materials dedicated to the activities of Ukrainian nationalist formations (OUN, UPA) and the fight against them, the liquidation of the Baltic nationalist organization "Aizsargi", the arrest of prominent figures of the Estonian nationalist movement.
The head of the 4th Directorate of the NKVD of the USSR P.A. Sudoplatov informed the 3rd Directorate of the NKVD of the USSR on December 9, 1942: "In the war of Germany against the USSR, the OUN (Organization of Ukrainian Nationalists) as a whole took an active part on the side of Germany. <…>
The OUN's assistance to Germany was expressed in armed uprisings in the rear of Soviet troops during the retreat of the Red Army, espionage and sabotage against the USSR; active participation in the creation of local government bodies and police in the occupied territory of the USSR" (Central Archives of the FSB of Russia. F. 3. Op. 10. D. 387. L. 2).
A number of documents illustrate the attitude of Ukrainian nationalists towards the Polish population. The report of the 4th Directorate of the NKVD of the USSR dated February 16, 1943 recorded: "A group of OUN members (a Bandera movement), hiding in the villages of the Sarny region, carried out a massacre of the Polish population in early February 1943.
In the village of Poroslya, the number of killed and maimed adults and children reaches 150 people" (Central Archives of the FSB of Russia. F. 4. Op. 1. D. 469. L. 126). The report of May 28, 1943 contains information about the complete destruction of the entire population of two Polish villages (Central Archives of the FSB of Russia. F. 4. Op. 1. D. 473. L. 327).
In August 1943, a special report spoke of the murder of about 2,000 Poles in the city of Vladimir-Volynsky by Bandera supporters: “The German garrison, police and Cossacks, numbering up to 600 people, did not take any measures against the reprisals against the Poles, and only after the reprisals did the German command post an announcement calling on Poles to join the gendarmerie to fight the Bandera supporters” (Central Archives of the FSB of Russia. Translation is a challenging problem. Even simple declarative sentences can have layers of meaning, like when your wife says, "That's nice! You just keep on doing that."
Still, we have come a long way from the early days of machine translation where the phrase "The spirit is willing, but the flesh is weak" came out as "The wine is good, but the meat is spoiled".

If I understand the timeline correctly, right after the officer ducked down things jumped off and the shooting started, so not a lot of time to do anything.
Looking at the geography of the site, it took a bit of planning and forethought to pull this off. You need to pick a good firing position, you need a ladder to get up on the roof, and somehow get the rifle through security or pre-position it in a way that won't be discovered in a (presumed) pre-event sweep.
tl;dr: a 20 year old without formal training managed to outfox security professionals. Makes you wonder if he had some help.
Never attribute to malice what can be explained by incompetence.
So far from what I have seen of the police and USS response, it was a complete shit show and an example of how NOT to secure a site, place security and extract the VIP. Several people who privately do this for a living are extremely critical of their performance.
But, I'm also not saying that wasn't intentional to put the Jr Varsity squad out there deliberately.

The EFFBEYE needs to focus on the ladder, it is the lynchpin of the planning for the shot. Where did it come from, when was it placed there, was is ignored by the security sweep, if not who placed it and how.
Its hard to imagine it was just dumb luck the shooter noticed it at the last minute.

Shame on SS for relying on the unidentified "officer" most likely a parking lot security guard. I heard him referred elsewhere as a "township" officer, most likely untrained other than for directing traffic at events.

Policeman climbing ladder may not be correct; may have been climbing another policeman's shoulders, and thus had no means of doing other than observe (only on tv could cops climb with one hand or/and gun in their teeth.) And then he fell backward when confronted with a rifle at short range....
