Devin Nunes 'definitely' taking legal action after phone records appear in impeachment report
[WASHINGTONTIMES] Rep. Devin Nunes, Caliphornia, an impregnable bastion of the Democratic Party, Republican, said Saturday that he will pursue legal action over his phone records being exposed by the House Intelligence Committee he sits on.

Mr. Nunes, the committee’s ranking member and former chairman, threatened the litigation in light of records of his phone calls appearing in a recent congressional report issued as part of the ongoing impeachment inquiry into President Trump.

"I believe I am the first member of Congress, and I believe my staff and former staff are the first ones ever to have their phone records exposed like this," Mr. Nunes said on Fox News.

"We’re definitely going to take legal action," Mr. Nunes said on the "Fox & Friends: Weekend" program.

Released on Tuesday, the intelligence committee’s report contains its findings thus far with respect to the ongoing impeachment inquiry triggered by Mr. Trump withholding hundreds of millions of dollars in military assistance to Ukraine amid pursuing a favor from his counterpart in Kyiv.

Among the report’s 300-pages are phone records indicating Mr. Nunes and his staff was in contact earlier this year with individuals including Mr. Trump’s personal lawyer Rudolph W. Giuliani and Lev Parnas, a Ukrainian businessman associated with Mr. Giuliani who has since been indicted on campaign finance law violations, among others.

Patrick Boland, a front man for Intelligence Committee Chairman Adam B. Schiff, California Democrat, said on Thursday that Sherlocks "did not subpoena call records for any member of Congress or their staff" and instead suggested that Mr. Nunes and his team had been in touch with others under scrutiny.

"Any questions about the fact that Members, congressional staff or journalists appear in call records released by the Committee should be directed at those individuals, who were in contact with individuals of investigative interest to the impeachment inquiry," Mr. Boland said.

Todd followed up by asking if he had seen direct evidence of collusion and Schiff responded that there was "evidence that is not circumstantial and is very much worthy of investigation"...
(D-CA), high Chancellor of the Trump impeachment effort, might be getting away with murder. The impeachment circus that has engulfed D.C. has overshadowed the House Intelligence Committee chair’s egregious abuse of power. He executed a secret subpoenas adventure of phone records of prominent Republicans. He got their phone records and published them in the committee’s 300-page impeachment report. Now, the report is a work of fiction. Schiff is a liar, and nothing from House Democrats on this whole fiasco should be believed. This isn’t about the Constitution, or the framers, or the rule of law. It’s not about upholding the integrity of our institutions; Democrats have already perverted those with their deep state antics against this administration. It’s about the Democratic Party’s inability to grasp that it lost the 2016 election. Democrats wanted to boot Trump since day one of his presidency. The ironic twist is that their impeachment fetish could very well be what secures him a second term. This is not popular in swing states. No one cares. And the liberal media has been so wrong, so stupid, and so corrupt in their coverage of this White House, even Democrats in these states cannot believe what they hear. But let’s get back to that pencil head, Schiff.

He may have opened himself up to oodles of lawsuits by those he decided to go after with these secret subpoenas. Rudy Giuliani, the president’s attorney, was included in this hit list, and we now have to factor in attorney-client privilege into this whole mess. Seldom is this cast aside concerning an investigation unless the evidence of wrongdoing is overwhelming. Schiff decided to ignore those protocols because he wants to boot Trump before the 2020 election, or at least severely damage his re-election chances. It’s funny. The man who says he’s doing this for the country and the rule of law thinks he can break the rules...because he feels he’s right.

Why I Still Don't Think Trump Will Be Impeached
[PJ] Just a few days ago, I predicted that Trump won't be impeached. Of course, today we saw the announcement that Nancy Pelosi has directed the Judiciary Committee to start drafting articles of impeachment based on the hearing yesterday.

Now, that means a committee chaired by Rep. Jerrold Nadler (D-Moria) is supposed to start coming up with a list of charges. Apparently, this is supposed to include bribery, abuse of power, and damned if conspiracy and collusion with the Russians isn't back, Mueller investigation be damned.

You might think this would cause me to rethink my prediction, but it doesn't.

Let's hypothetically assume articles of impeachment were voted and sent to trial in the Senate. Then what?

Who is subpoenaed first? It's going to be a race among Adam Schiff, Eric Ciaramella, and Mark Zaid (Ciaramella's lawyer). Followed by Schiff's staffers, Vindman again, other Democrat members of the HPSCI.

You can expect extensive declassification. In particular, of transcripts of the closed-door meetings that Schiff won't release. (Hint: Classification is under the president's authority, not a Congress member's.)

After yesterday, you can expect extensive subpoenas of communications records.

You can expect (yet another) rehash of the last three years, and you can bet that the GOP will be out for blood.

You can expect a concurrent effort to expel Schiff from the House. (No, members of the House can't be impeached. But they can be expelled.)

You can expect every witness from the Schiff hearings to be re-called and examined by hostile questioners, and you can bet Mitch McConnell won't shush the Republicans.

You can expect most of the upper levels of the Obama administration to be subpoenaed: if they appear, they will be examined in ways that would make a proctologist squirm; if they resist, you can bet an attempt will be made to compel them, and "no one is above the law" will be the watchword on Republican lips.

Given the number of actual crimes that appear to be involved, the fallout could be expensive. No one will go to actual jail ‐ nobody at that level goes to jail ‐ but they could lose clearances, pay millions in lawyer fees, and become laughingstocks.

If it comes to trial and Trump is acquitted, especially when the evidence against the Obama administration comes out, it probably means a massive election victory for Trump and the GOP. If it comes to trial at all, then it'll be happening during Iowa's caucuses and many of the major contenders will need to be at the trial ‐ or they won't show up, and the Trump oppo ads will be solar fusion fire.

I still think the risks are too great for the Democrats. Instead, we'll see this "drafting of articles of impeachment" drag on, "vaster than Empires and more slow," because they get all the political benefits of keeping IMPEACHMENT IMPEACHMENT IMPEACHMENT in the news, with none of the risks.

Devin Nunes Sues CNN: Reveals He Was Not in Vienna in Late 2018, Did Not Meet Victor Shokin
[BREITBART] House Permanent Select Committee on Intelligence (HPSCI) ranking member Rep. Devin Nunes (R-CA) filed a lawsuit on Tuesday against CNN for a fake news story the outlet printed about him before Thanksgiving, revealing in the lawsuit that he was never as CNN alleged in Vienna in late 2018 and did not meet with the ousted Ukrainian prosecutor CNN alleged he met with there.

Nunes’s lawsuit includes revelations of key facts that undermine the case CNN made against him, severely harming the news outlet’s credibility. The lawsuit, filed in federal court in Virginia, shows Nunes is seeking more than $435 million in damages from CNN over the fake news it printed against him. But more importantly, it demonstrates that Nunes was 100 percent correct when he told Breitbart News before Thanksgiving that CNN’s story was untrue‐and that CNN was completely inaccurate in its reporting and had relied on a compromised source for its piece.

It remains to be seen how successful this lawsuit will be‐it is very difficult for public figures to successfully sue media outlets because of a variety of protections the media are afforded‐but the facts as laid out by Nunes and his attorney in this suit are particularly damning for CNN as Nunes and his team successfully demonstrate that the network engaged in printing and then disseminating demonstrably false information about him.

HJC Chairman Nadler Attempts to Reframe ‘Impeachment Inquiry’

Nadler, together with Lawfare contracted impeachment agents Barry Berke and Norm Eisen, are attempting to reframe a collapsing impeachment and pull-in White House participation.

Chairman Nadler has announced a December 4th hearing with a panel of democrat selected constitutional lawyers and legal ’experts’, to discuss the procedural framework of an impeachment process. As Nadler states: "Our first task is to explore the framework put in place to respond to serious allegations of impeachable misconduct". So the HJC initial objective to build their narrative is to explain what the impeachment process is about.

This is transparently an attempt by Nadler/Lawfare to give legitimacy to an illegitimate political exercise. The hearing purpose is framed as a trap to pull the White House in, and thereby create the optics of constitutional legitimacy. Strong caution is advised and I would not be surprised to see the White House refuse to participate. Here’s why:

and a yet invisible report from the HPSCI committee submitted, either the House Judiciary should follow their own process or not. The White House and the minority have not even seen the one-sided report mandated by the House Impeachment Inquiry Resolution.

My advice to the White House would be to respond to Nadler’s letter by informing him the House "Impeachment Report" authorized by resolution 660 has not yet been delivered; therefore, without a basis for the HJC to consider the validity of the first phase, it would be presumptuous to engage in a second phase framework exercise without the origination material described by the House Democrats’ own procedure.

Lt. Col. Alexander Vindman Outs Himself as Source for CIA Whistleblower Complaint
[THECONSERVATIVETREEHOUSE] HPSCI Ranking Member Devin Nunes questioned NSC official Lt. Col. Alexander Vindman about whether he had shared the contents of the phone call between President Trump and Ukraine President Zelensky with anyone outside the White House.

In responding Vindman stated "two people", and then named State Dept George Kent, and a person from the intelligence community. Then things get interesting. Vindman refused to name the intelligence agency because it would likely expose the CIA "whistle-blower".

This non-answer makes Alexander Vindman the source for the CIA "whistleblower" Eric Ciaramella.

Intel Community IG Stonewalling Congress On Backdated Whistleblower Rule Changes
[The Federalist] Michael Atkinson, the inspector general for U.S. intelligence agencies, acknowledged that his office secretly changed key whistleblower forms and rules in September, but refused to explain to lawmakers why those changes were backdated to August.

In tense testimony before the House Permanent Select Committee on Intelligence (HPSCI) on Friday, the inspector general for federal spy agencies refused to disclose why his office backdated secret changes to key whistleblower forms and rules in the wake of an anti-Trump whistleblower complaint filed in August, sources told The Federalist.

As The Federalist reported and the Intelligence Community Inspector General (ICIG) confirmed, the spy watchdog secretly changed its whistleblower forms and internal rules in September to eliminate a requirement that whistleblowers provide first-hand evidence to support any allegations of wrongdoing. In a press release last week, the ICIG confessed that it changed its rules in response to an anti-Trump complaint filed on August 12. That complaint, which was declassified and released by President Donald Trump in September, was based entirely on second-hand information, much of which was shown to be false following the declassification and release of a telephone conversation between Trump and Ukrainian President Volodymyr Zelensky.

Michael Atkinson, the intelligence community inspector general, told HPSCI lawmakers during a committee oversight hearing on Friday that the whistleblower forms and rules changes were made in September, even though the new forms and guidance, which were not uploaded to the ICIG’s website until September 24, state that they were changed in August. Despite having a full week to come up with explanations for his office’s decisions to secretly change its forms to eliminate the requirement for first-hand evidence and to backdate those changes to August, Atkinson refused to provide any explanation to lawmakers baffled by his behavior.

Papadopoulos Hints Conversation That Launched Trump-Russia Probe Was FBI Setup
[The Federalist] The recently released transcript of George Papadopoulos’s congressional testimony reveals a significant fact: Papadopoulos’s introduction to Joseph Mifsud‐the source of the "Russia has Hillary’s emails" tip that purportedly prompted the FBI to launch an investigation into the Trump campaign‐was arranged mere days after Papadopoulos announced he was joining the Trump campaign.

Saturday evening, Papadopoulos rocked Twitter with claims that "a woman in London, who was the FBI’s legal attaché in the U.K." encouraged him "to meet Joseph Mifsud in Rome in March 2016." These new revelations raise fresh concerns that, with the approval of the FBI, foreign governments were meddling in the 2016 election.

Mifsud has long been a focal point of those on the right attempting to disembowel the Russia collusion hoax. The basics have been known for some time.

From court documents filed in connection to Papadopoulos’s guilty plea for lying to the FBI and from the House Permanent Select Committee on Intelligence’s (HPSCI) report on "Russian Active Measures," we know that "on March 14, 2016, George met London-based college Professor Joseph Mifsud while traveling in Italy." During that meeting, "Mifsud, then director of the London Academy of Diplomacy, claimed connections to the Russian Government."

A week later, on March 21, 2016, Trump publicly identified Papadopoulos as one of his foreign policy advisors. Then on March 24, 2016, Mifsud traveled to London, "where he introduced George to a young woman named Olga," telling the newly named Trump advisor that Olga was Russian President Vladimir Putin’s niece and suggesting they could arrange meetings with high-level Russian officials.
