#1 It's the correct decision, though it is one that should be reached in open court.

Would we tolerate a debate about whether or not to open a church? A synagogue? A Hindu temple?

Either we're serious about our First Amendment or we're not.

I know, I know, I also make barbed jokes about mosques being convenient weapons depots for terrorists. And if THIS mosque turns out to be a recruiting center for jihadis then it needs to be shut down and the leadership needs to be arrested.

But in the good old US of A, first we get proof.

Open the mosque.

And keep an eye on it.

Islam is not a religion. It hides behind a mask of religiosity, but that does not give it legitimacy. Christianity, and the Right are going to have to relearn (it seems) that to survive one must kill ones enemies.

Especially when the enemies ideology is as intractable as Islam and Leftism. Even more so when the two have joined forces.

#6 The remedy for bad speech is more speech, good speech. It is justifiable to tolerate bad speech because there's no monopoly in the free marketplace of ideas.

Unfortunately Islam has managed to seriously damage said marketplace, by threatening violent reprisals.

Western political and military elites are hostile to speech critical of Islam, giving aid to the intimidation campaign.

E.g. the commander of Western forces in Afghanistan, in his official capacity, called for the voluntary adoption of sharia censorship rules by non-muslims residing in the West.

In the absence of a free marketplace of ideas tolerance for the intolerant equates surrender to the intolerant.

Either we're serious about our First Amendment or we're not.

Western political and military elites are indeed seriously opposed to 1st Amendment freedoms.
