#1 ....For some reason, I seem to remember - but will happily admit to error - that there was a law passed after the Kennedy Administration that blocked this practice.

Unless, of course, Mrs. Biden is special.

you are thinking of 5 USC 3110 passed in 1967

This would bar Dr. Jill from S of Ed. if Joe was POTUS. However, Congress could amend this law to carve out a one time exception. They could pass this exception at the same time as they confirmed her.
