#1 Erroneous jury instructions by judges are quite common. As long as errors were made in spite of good faith performance, and they can be corrected in a manner that will ensure that a fair determination will arise, corrections are allowed. However, doing so provides a potential review or appeal issue. Mistrial isn't a certainty.

#2 MSM reports that they have convicted him. He does have the option to appeal though.
