#1 This shit's been around since the mid 1980's, probably earlier. I could tell you some stories about similar abuse at the MA state level (most of it caught; refunds were held up and / or denied and the offending tax preparers jugged) that would surprise no one that regulary reads this site. Anti-fraud provisions, while in place, have not been a priority at the Federal level nearly as much as they have been at preventing 501(c)(4) organizations from getting a foothold. State abuse of this stuff is next to nonexistent, in my very informed professional opinion.

Refundable credits, just like the EITC. A recipe for abuse and outright fraud - abolish them all, and tax all public assistance as unearned income. And fire every SOB involved in the above abuses, and cut the IRS funding by 20%; it's the only way they will learn not to make marks out of citizens...
