If a 'neutral' state invokes rules of war, does that set the precedent for the declaration of a war following a 'civil action'?

#2 Not necessarily. But it does establish precedent for a 'neutral' state to prosecute its citizens for "violating international law -- including the Geneva Conventions."

It opens up a huge can o' worms, especially if the so-called human rights or other interest groups get involved. Say, a Swede or a Swiss who joins the IDF or French Foreign Legion, or the US military...
