#4 Keep in mind, he was on the property and that meets the requirement. I doubt they will attempt to charge her. Even in my neighborhood full of foreign born neighbors, when things happen, multiple people ask, "Why the hell didn't someone shoot them?" The attitude is very much Texan:p
