P2K has it exactly right - It is the State Militia, the Military Department of the State of Texas, not the National Guard that is installing the wire and guarding the border. They are NOT a federal entity in any respect. Hence, Posse Commitatus and conversion from Title 32 to Title 10 is not involved!
