The government and relatives of terrorist suspects in Mauritania have concerns as those charged await trial. The government has moved the suspects inside a military garrison to prevent another escape, but their relatives say they are innocent, and that they are being tortured.
Can't they get a writ of habeas corpus?

Khawaja considering creating terror camp in Canada: witness
The Crown's star witness in the terror trial of Momin Khawaja wrapped up his evidence Wednesday by telling Ontario Superior Court that the former software developer once considered establishing a jihadi training camp in Canada.

Mohammed Junaid Babar said Mr. Khawaja suggested to him in 2003 that 'the brothers' in the United Kingdom could send him money to establish a training camp in this country. 'He mentioned . . . that there was a lot of land around in Canada and that it was very cheap,' Babar testified.

The idea was never hatched and Mr. Khawaja -- who has pleaded not guilty to seven terrorism-related charges in connection with an alleged plot to bomb sites in and around London, England -- did not specify where in Canada the training camp might be located.

BREAKING: Supreme Court Upholds Right to Keep and Bear Arms
The Supreme Court says Americans have a right to own guns for self-defense and hunting, the justices' first major pronouncement on gun rights in U.S. history. The court's 5-4 ruling strikes down the District of Columbia's 32-year-old ban on handguns as incompatible with gun rights under the Second Amendment. The decision goes further than even the Bush administration wanted, but probably leaves most firearms laws intact.

The court had not conclusively interpreted the Second Amendment since its ratification in 1791. The amendment reads: 'A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.'

The basic issue for the justices was whether the amendment protects an individual's right to own guns no matter what, or whether that right is somehow tied to service in a state militia.

Justice Antonin Scalia, writing for four colleagues, said the Constitution does not permit 'the absolute prohibition of handguns held and used for self-defense in the home.'

In dissent, Justice John Paul Stevens wrote that the majority 'would have us believe that over 200 years ago, the Framers made a choice to limit the tools available to elected officials wishing to regulate civilian uses of weapons.'

#1  I'll have to read the two opinions but it sounds like the supreme Court has limited the owning of weapons to self defence and hunting, not what the constitution or the framers of the Constitution said. Thomas Jefferson wrote, "The 2nd Ammendment shall never be construed as to give Congress the power to deprive law abiding citizens of their arms". He also wrote, "What country can preserve its liberties if their rulers are not warned from time to time that their people preserve the spirit of resistance. Let them take arms".

#7  The court did not establish a level of review (e.g. strict scrutiny) for 2nd amendment cases. Given that it was a 5/4 decision, that's probably a good thing.

The court did strike down the DC handgun ban and the disassembly/trigger lock requirement. It did not rule on licensing, but that will probably survive.

So, gun bans are now unconstitutional. I like that. And if we can win the next presidential race and get just one more seat on the SCT we can probably look forward to more good decisions like this one.

#23  The reason its ruling mainly mentions only the home is that the law only mentions the home.

HOWEVER....

The "background" and reasoning and construction of the decision point very strongly toward using it as a basis for other pro-gun decisions - since it very clearly and strongly enforces that the 2nd amendment is specifically applicable to individuals, and that it is a fundamental right that precedes and underlies the constitution.

Scalia and the majority weer ver pointed in thier references to guns rights being indiidual rights for self defense. They completely demolished the Miller case and destroyed the "militia" clause as a "collective right" ro the right beloning to the states/milita.

There is absolutely NO doubt that individuals have it - meaning it is to be treated much as the 1st, 4th and 5th amendments.

When the militias were about in the writing of the constitution, the 2nd amendment could have been seen as a collective right.
However, since ALL able bodied men 18-45 were to be members of the militia in that time frame (see compulsory), all men would have arms under their roof. As the militias fell out of favor, the idea that all men would have arms stayed, so the 2nd amendment was seen as an individual right.
Under the views of the founding fathers, all men should be armed and be allowed to carry arms if able, therefore the non-criminal or mentally deranged could and should be able to carry arms.

That is how I see the 2nd amendment coming from our founding fathers.

Pakistanis ‘won't allow’ attacks into Afghanistan

ISLAMABAD - Pakistan said on Wednesday it will not allow militants to attack Afghanistan from its territory and it will never let foreign troops operate on its soil. The declaration came after threats from Afghan President Hamid Karzai to send troops into Pakistan to fight Taliban militants he says operate from border sanctuaries, and after 11 Pakistani border soldiers were killed in a U.S. air strike.

"Pakistan will not allow its territory to be used against other countries, especially Afghanistan and under no circumstances will foreign troops be allowed to operate inside Pakistan," the government said in a statement after a top-level security meeting.

Prime Minister Yousaf Raza Gilani presided over the meeting which included federal and provincial government leaders and military and security agency chiefs. "The meeting unanimously agreed that elimination of terrorism and extremism is the gravest challenge to Pakistan's national security and to fight this menace a multi-pronged strategy will be followed," the government said.

It was the strongest message on militancy yet from a three-month old government that critics say has been preoccupied with internal political wrangling and blind to looming security threats. The main thrust of the policy would be the political engagement of the people through their elected representatives and tribal elders, together with economic development and "selective use of military force", the government said.

The government said tribal elders would be responsible for expelling foreign militants and for ensuring that militants did not cross the border into Afghanistan. "All agreements with the tribes ... will be backed by a robust enforcement mechanism" with the government reserving the right to use force, it said. It did not refer to similar agreements struck under the previous government which failed to curb militant violence and, critics say, enabled the militants to regroup.

Fear of Peshawar falling to Taliban
Even as Pakistan struggles to put in place peace deals with the Taliban militants in the restive border areas with Afghanistan, fears of insurgents taking control of Peshawar in North West Frontier Province is haunting the government, a news report said on Wednesday. “Peshawar is in a state of siege and if Peshawar falls, the rest of the districts in the NWFP would fall like ninepins,” a worried senior government official was quoted as saying by the Dawn daily of Pakistan.
Notice that the Talibunnies can take Peshawar but can't take Kandahar.
The report said the security situation in Peshawar is grim. “So grim has the situation become that a committee that includes Chief Minister Ameer Haider Khan Hoti, Governor Owais Ahmed Ghani, and the Corps Commander Masood Aslam met on May 31 to discuss possible options for defending Peshawar,” the daily said.

It noted that officials in Pakistan’s Home Department, who evaluate the situation on an almost daily basis, believe declaring a state of red alert is now only a matter of time. “The military, the paramilitary, the constabulary and the police are unable or unwilling to muster enough force to defend the city,” the report said.

According to the daily, with militants knocking at the gates of the capital of the NWFP, “even the more circumspect government and police officials now grudgingly concede that Peshawar, too, could fall in a few months.” “It would be a shame if Peshawar were to fall. It is not Swat. It is home to the headquarters of the 11th Corps, the paramilitary Frontier Corps, the Frontier Constabulary and the police,” the daily said.

Police stations in Pakistan’s rural Peshawar have long given up patrolling at night. “No less a person than Maulana Fazlur Rehman, the chief of JUI, saw it urgent to ring alarm bells, saying in a statement on Tuesday that the government must act to stop the Taliban march before it was too late,” the daily reported.

The Pakistan government assured the National Assembly yesterday that an anti-militancy operation will be carried out in NWFP within a week. However, the spurt in militant activity, especially in Peshwar, has become a major concern in security circles.

PM approves NWFP operation
Prime Minister Syed Yousuf Raza Gilani on Wednesday approved a military operation to clear the Tribal Areas of militants.

Government and defence sources said that Gilani approved the use of force during a high-level meeting at Prime Minister’s House that reviewed progress on the war on terrorism and the state of law and order in the NWFP and Tribal Areas.

Challenges: Meanwhile, a press release from the government said that the meeting had unanimously agreed that terrorism and extremism were the gravest challenges to national security.

It decided that the government would continue negotiations with local elders to isolate hardcore militants. The chief of army staff (COAS) would take the lead on deciding when to employ military force, including the Frontier Corps (FC) and the law-enforcement agencies (LEAs). However, the NWFP governor and chief minister could also employ the FC and LEAs to maintain law and order.

The COAS would decide the quantum, composition and positioning of military effort and would decide on the level of liaison, contact and co-operation with the ISAF in Afghanistan and keep the government informed about operations.

Co-ordinator: According to the press release, the NWFP governor would be the chief co-ordinator for all activity in FATA, and would liaison with the government, important political leaders and the local military commander. All agreements with tribes in FATA will be backed by an enforcement mechanism, with the government reserving the right to use force in case of violation of agreement.

The meeting also decided that the tribes would be responsible for stopping militants’ cross border movement and expelling foreign militants.

Final talks with govt today: Swat Taliban
Local Taliban on Wednesday announced that they would conduct decisive peace talks with the government today (Thursday). NWFP Environment Minister Wajid Ali Khan also confirmed the meeting. Spokesman Muslim Khan told reporters after a shura (council) meeting that even though the peace deal was intact, the Taliban would not hesitate to retaliate against government attacks.

On Wednesday, the Taliban killed one security worker and injured another three in an attack on a checkpost. They also occupied one girls’ school and set fire to another eight. Khan admitted to the checkpost attack, but denied any involvement in the school arson. Militants also planted a remote control bomb near a security forces convoy at the Shah Dherio area but a bomb disposal squad defused it.

'European Muslim converts moving to Peshawar'
Several European converts to Islam have started to take up residence in the suburbs of Peshawar, an area where militancy is growing, police officials said on Wednesday.

“We were surprised to learn that European converts to Islam are staying in Peshawar in areas where the security situation is extremely volatile,” said police officials monitoring the areas of Peshawar where militancy has increased recently. Requesting anonymity, they said that the converts were of Scottish, British and Norwegian origin.
Does Peshawar have room for a few million more?
The police officials said that they had been apprised of the whereabouts of six European converts in the past five months. “The number of such people could be much higher as the matter has not been fully investigated. There could be converts from other countries as well,” they added.

A senior government official who met one Norwegian convert at a social gathering said that the foreigner had told him: “I am very impressed by the life of a Muslim. My soul feels good ever since I converted to Islam.”

One of the police officials quoted another convert as saying: “I am impressed by Shia Islam.”

The converts have been spotted living in Mattani, 15 kilometres south of Peshawar, and close to Darra Adam Khel and Mathra, just six kilometres north of Peshawar and close to Mohmand Agency. The two areas are considered hotbeds of militancy and the provincial government has been continuously monitoring the situation to stave off any serious threat to Peshawar.

“It is not clear whether these converts want to join jihadi groups yet. You also cannot be certain that these people are merely converts, as they could be here to collect intelligence on militancy,” the police officials added.

The buzz in Pakistan's tribal areas is that there are several dozen European converts to Islam, up in the hills, attending terrorist training sessions in al Qaeda and Taliban camps. The men, and possibly one or more women, enter the tribal areas as tourists, but are later spotted travelling with known Islamic terrorists.

People directly affected by the Lal Masjid operation in July 2007 will meet next month to press the government to reconstruct Jamia Hafsa, re-open Jamia Faridia and the pay compensation to families of those killed in the operation.

The government razed Jamia Hafsa and closed Jamia Faridia after a seven-day military operation against militants hiding in the madrassa.

A ‘Shuhada-i-Lal Masjid Conference’ is being organised within the premises of Lal Masjid on July 6, in consultation with the Wafaqul Madaris Al Arabia Pakistan.

Former Jamia Hafsa principal Umme Hasaan told Daily Times on Wednesday that conference participants would press the government to honour the verdict of the Supreme Court regarding reconstruction. She said the conference organisers had informed the Islamabad administration of the event, adding that madrassa students and scholars would attend the conference from across Pakistan.

She urged the government to resolve Lal Masjid-related issues at the earliest, adding that a series of “worst kind of suicide attacks” Pakistan faced in 2007 was a reaction to the Lal Masjid operation.She said the conference would also urge the government to review cases against former Lal Masjid cleric Abdul Aziz and ensure his release.

Concerning compensation to the families of Lal Masjid victims, Umme Hasaan said families had made no demand, as yet, but added that the government could be asked for a compensating package.

The Islamabad administration started Jamia Hafsa’s reconstruction several weeks ago but has stopped the work.

Israel shuts Gaza crossings after rocket attacks
GAZA CITY - Israel shut down border crossings with the Gaza Strip on Wednesday after Palestinian rocket attacks tested a fragile truce between the Jewish state and the besieged territory's Hamas rulers. "We are keeping the Karni, Sufa and Nahal Oz crossings closed for the time-being following the firing of rockets in flagrant violation of the truce deal," Israeli military spokesman Peter Lerner told AFP.

However, he said that while the goods terminals were closed, the Erez passenger crossing -- used by diplomats, journalists, and sick Gazans requiring medical care in Israel or abroad -- remained open.

"Any fire from the Gaza Strip is a gross violation of the understanding reached with Egypt," Israeli Prime Minister Ehud Olmert's spokesman Mark Regev told AFP, adding that Hamas bore responsibility for any attack from Gaza. He said the attacks violated "two cardinal points of the understandings reached through Egypt, namely that the truce applies only to the Gaza Strip and not to the West Bank and that it concerns all armed groups."

Hamas says not to maintain ceasefire by force
(Xinhua) -- A senior leader of the Islamic Resistance Movement (Hamas) said on Wednesday that it would not turn into force maintaining security on Israel's borders with the Hamas-controlled Gaza Strip.

'No one will have the chance to be happy when seeing Hamas raising its gun in the face of a fighter,' said Khalil al-Hayya, a senior Hamas leader in Gaza. 'Hamas will not maintain the lull in the Gaza Strip by force even if the factions breached it.'

His remarks were made after Israel said Hamas is responsible for the existing of the ceasefire which took effect between the two sides last Thursday.

On Tuesday, the Islamic Jihad movement violated the lull and fired rockets into southern Israel to respond to an Israeli raid in the West Bank where a commander and another Palestinian were killed. The Egyptian-brokered ceasefire doesn't include the West Bank.

Following the incident, Hamas said it was still committed to the ceasefire and urged the Palestinian factions to restrain.

Al-Hayya claimed that the ceasefire did not take place in the West Bank because Israel and Palestinian President Mahmoud Abbas, whose forces control the territory, rejected the ceasefire in the West Bank.

Olmert, Government Will Vote On Trade Of Hezbollah Prisoners
(AGI) - Jerusalem, June 25 - The Israeli government will vote on Sunday on the potential exchange of prisoners with Hezbollah. Premier Ehud Olmert made the announcement. As of July 2006 Hezbollah holds 2 israeli soldiers: Ehud Goldwasser and Eldad Regev. It was their capture 2 years ago that led to the 34 day war in Lebanon. In exchange for their freedom Israel has offered to release 5 Lebanese militiamen. Olmert said in parliament that "I have decided to submit the matter to the Cabinet on Sunday for a decision".

Iran issues warning over nuclear program
Iran's parliament speaker on Wednesday warned that the West could face a "done deal" if it provokes Iran, in a rare hint by an Iranian official that Tehran could build nuclear weapons if attacked.

Iran's leaders have long been adamant that the country's nuclear program is and will always be aimed only at generating electricity. Ali Larijani did not directly contradict that stance, but his veiled warning comes amid increased Iranian fears that the U.S. or Israel could strike its nuclear facilities.

Earlier this month, Israel sent warplanes and other aircraft on a major exercise in the eastern Mediterranean that U.S. officials said was a message to Iran — a show of force as well as practice in the operations needed for a long-range strike mission.

Larijani, who was once Iran's top nuclear negotiator with the West, made the comments in a speech to parliament aired on state TV and radio.

He pointed to recent comments by Mohamed ElBaradei, the U.N. nuclear watchdog chief, who said in an interview last week that a military strike on Iran could turn the Mideast into a "ball of fire" and "prompt Iran, even if it didn't produce a nuclear weapon today, to resort to an emergency plan to produce a nuclear weapon."

"Take Mr. ElBaradei's warnings seriously," Larijani said, addressing the West.

"Don't provoke Iran otherwise you will face a done deal that will block the path of your return to a compromise with Iran," Larijani told a parliament session broadcast live on state radio Wednesday.
