#2 No, they are not the same. However, free citizens may freely choose to enter into contracts or arbitration of disputes according to principles that they think best. In this area, of private concern, all bets are off and the Federal state should tread lightly. Except for indentured servitude and commerce clause stuff, the Feds would be overreaching.
