Prince Andrew: Accuser cannot sue because she isn't in US
NEW YORK (AP) — A lawsuit by an American who claims Prince Andrew sexually abused her when she was 17 might have to be thrown out because she no longer lives in the U.S., lawyers for the Prince said in a court filing Tuesday.

Attorneys Andrew Brettler and Melissa Lerner wrote that they recently discovered Virginia Giuffre has lived in Australia all but two of the last 19 years and cannot claim she’s a resident of Colorado, where she hasn’t lived since at least 2019.

In an August lawsuit, Virginia Giuffre claimed that the prince abused her on multiple occasions in 2001.

The prince’s lawyers in October asked Judge Lewis A. Kaplan to throw out the lawsuit, saying the prince "never sexually abused or assaulted" Giuffre and they believed she sued Andrew "to achieve another payday at his expense and at the expense of those closest to him." The lawyers acknowledged that Giuffre may well be a victim of sexual abuse by financier Jeffrey Epstein, who killed himself in 2019 while awaiting a sex trafficking trial.

Last month, Kaplan said a trial in Giuffre’s lawsuit against the prince could occur between September and December 2022.

#1  Luckily Jeffrey Epstein cannot be called to testify or bring lawsuit, as he too is no longer in the US.

Similar to the Clinton 'home brew' servers, the Seth Rich murder, Feinstein's Chinese driver, Ashli Babbitt shooting, Fang Fang, Benghazi, the recent Kabul drone strike, and dozens more, this entire matter is memory hole bound.

Not even well oiled 'Deep States' can escape the occasional domestic chore. The bins will need to be emptied and the Hoover must be run down the halls from time to time.

#2  Slight refinement: Jeffrey Epstein is no longer living in the US. He still reliably votes democrat from wherever he is buried.

Gary Beikirch, local Medal of Honor recipient, dies at 74
[Democrat & Chronicle] Gary Beikirch, the U.S. Army medic whose heroism one April morning in Vietnam made him one of Rochester's greatest military heroes of the 20th century, died Dec. 26 at age 74. The cause was cancer.

Sgt. Beikirch in April 1970 was 22 years old and serving as chief medical officer for a Special Forces team and more than 2,000 villagers in Kon Tum province in south Vietnam. At 3 a.m. April 1, North Vietnamese forces launched a major attack against Camp Dak Seang, spraying rockets and gunfire across the fortified compound.

Sgt. Beikirch and his 15-year-old bodyguard, a Vietnamese boy named Dao, dashed repeatedly into the line of fire to help those who were wounded — despite their own wounds, which were significant.

Sgt. Beikirch was hit twice, the second time a devastating blow that left shrapnel in his spine. "I remember feeling like I'd gotten kicked by a horse," he said.

Dao carried him to the medical tent for aid, and then the two returned to the field. Dao was killed protecting Sgt. Beikirch from a rocket attack; Sgt. Beikirch was struck again, this time a gunshot to the back. Finally he was evacuated by helicopter.

"Not many people know what it’s like to be under fire and then hear someone yell out, ‘medic,’ except those who are medics," he said. "And they don’t know what takes place inside of you that causes you to get up and go when everyone else is hiding."

Sgt. Beikirch received the Congressional Medal of Honor in a ceremony at the White House Oct. 15, 1973. By then he'd been out of service for two years and learned to walk again through extensive rehabilitation.

Harry Reid and John Madden dead. Madden welcomed to heaven
[MarketWatch] John Madden, the Hall of Fame coach turned broadcaster whose exuberant calls combined with simple explanations provided a weekly soundtrack to NFL games for three decades, died Tuesday morning, the league said. He was 85.

The NFL said he died unexpectedly and did not detail a cause.

Madden gained fame in a decade-long stint as the coach of the renegade Oakland Raiders, making it to seven AFC title games and winning the Super Bowl following the 1976 season. He compiled a 103-32-7 regular-season record, and his .759 winning percentage is the best among NFL coaches with more than 100 games.

But it was his work after prematurely retiring as coach at age 42 that made Madden truly a household name. He educated a football nation with his use of the telestrator on broadcasts; entertained millions with his interjections of “Boom!” and “Doink!” throughout games; was an omnipresent pitchman selling restaurants, hardware stores and beer; became the face of “Madden NFL Football,” one of the most successful sports video games of all-time; and was a best-selling author.

Most of all, he was the preeminent television sports analyst for most of his three decades calling games, winning an unprecedented 16 Emmy Awards for outstanding sports analyst/personality, and covering 11 Super Bowls for four networks from 1979-2009.

“People always ask, are you a coach or a broadcaster or a video game guy?” he said when was elected to the Pro Football Hall of Fame. “I’m a coach, always been a coach.”

He started his broadcasting career at CBS after leaving coaching in great part because of his fear of flying. He and Pat Summerall became the network’s top announcing duo. Madden then helped give Fox credibility as a major network when he moved there in 1994, and went on to call prime-time games at ABC and NBC before retiring following Pittsburgh’s thrilling 27-23 win over Arizona in the 2009 Super Bowl.

Congress authorizes Medal of Honor for 5 soldiers and awards upgrade for 4 Black Hawk Down troops
[Army Times] The nation’s highest award for valor — the Medal of Honor — may be given to five soldiers after President Joe Biden’s signed the 2021 defense policy bill. And four from the 1993 Battle of Mogadishu, known also as the Black Hawk Down incident, could see their awards upgraded to the Distinguished Service Cross.

In the bill, Congress formally waived time limits on presenting the awards — a final administrative step necessary for Biden to present them.

Of the five potential Medal of Honor recipients, three fought in the Korean War, and two fought in the Vietnam War. The list of potential upgrades includes:

Russian court bans Memorial International NGO
Direct Translation via Google Translate. Edited.
[RBC] The Supreme Court continued to consider the claim of the Prosecutor General's Office on the liquidation of the international organization "Memorial" (recognized as a foreign agent).

In the debate of the parties, the representative of the Prosecutor General's Office Alexei Zhafyarov said that the organization poses a public threat, "speculates on the topic of political repression, distorts the historical memory, including the Great Patriotic War, and creates a false image of the USSR as a terrorist state," the RBC correspondent reports.

In addition, the prosecution believes that Memorial, under the guise of restoring historical memory, is trying to "rehabilitate Nazi criminals and traitors to their homeland."

Zhafyarov clarified that “someone pays for all this”.

The international organization "Memorial" was included in the register of NPO-foreign agents in 2016. It specializes in research on political repression in the USSR. On November 11, the General Prosecutor's Office applied to the Supreme Court with a demand to liquidate Memorial.

In addition, the Moscow prosecutor's office filed a lawsuit to liquidate the interregional public organization "Human Rights Center" Memorial "(recognized as an NGO-foreign agent). She is accused of violating the law on foreign agents for the lack of marking in the publication of materials.

After filing the lawsuit, Memorial said that they saw no legal basis for liquidating the organization, and called the actions of the Prosecutor General's Office "a political decision to destroy society."

Experts warn of the risk of massive bankruptcies in the road industry
At a hearing in the Moscow City Court on December 23, a representative of the Moscow Prosecutor's Office said that Memorial's materials could cause a “depression” among those who read them. “The mental health of citizens may suffer.

These materials can cause, among other things, a depressive state of citizens, "- said the prosecutor, answering a question from attorney Maria Eismont about the "destructive" consequences of distributing Memorial materials without marking that the center is considered a foreign agent.

When asked whether the prosecutor's office had established such facts, the representative of the department replied that data on such cases were not attached to the case file. In addition, the prosecutor said that Memorial's materials could have a negative impact on the "spiritual and moral development of minors."

After the lawyers asked to clarify this argument, the plaintiff's representative stated that the children could not critically assess the information disseminated by the Memorial Human Rights Center.
Memorial's trial caused a great public outcry. Many public figures, scientists, politicians in Russia and abroad spoke out in defense of the organization.
Says the BBC:
Russia's Supreme Court has ordered the closure of International Memorial, Russia's oldest human rights group.

Memorial worked to recover the memory of the millions of innocent people executed, imprisoned or persecuted in the Soviet era.

Formally it has been "liquidated" for failing to mark a number of social media posts with its official status as a "foreign agent".

That designation was given in 2016 for receiving funding from abroad.

But in court, the prosecutor labelled Memorial a "public threat", accusing the group of being in the pay of the West to focus attention on Soviet crimes instead of highlighting a "glorious past".

Founded in 1989, Memorial became a symbol of a country opening up to the world - and to itself - as Russia began examining the darkest chapters of its past. Its closure is a stark symbol of how the country has turned back in on itself under President Vladimir Putin, rejecting criticism - even of history - as a hostile act.

Lawyers criticized the decision to liquidate International Memorial *

[KavkazUzel] The decision of the Supreme Court of Russia to liquidate International Memorial * is unjust and politically motivated, it will be appealed, the organization's lawyers said. The organization is looking for formats for further work, said Yan Rachinsky, head of the board of the International Memorial.

As the "Caucasian Knot" wrote, today the Supreme Court of Russia held a debate of the parties on the case of the liquidation of the "International Memorial". At them, representatives of the organization and the defense called on the court not to satisfy the claim of the prosecutor's office, but the court decided to liquidate the organization and its regional divisions. The judge, having voiced the decision, did not read out the reasoning. Those present in the hall greeted the decision with shouts of "Shame!"

The Supreme Court of Russia notified International Memorial that the Prosecutor General's Office filed a lawsuit to liquidate it due to the lack of marking on the status of a foreign agent, on November 11. The lawsuit began on November 25. On December 14, nine volumes of materials were heard at the court session . The court agreed to attach to the case the signatures under the electronic petition in support of Memorials, but denied other petitions to the defense.

Immediately after the session, first in the hall and then on the threshold of the building of the Supreme Court, the lawyers of International Memorial were surrounded by journalists, the "Caucasian Knot" correspondent who was present at the court reports.

Henry Reznik said that the decision was unjust and would certainly be appealed. He considers the reasons for such a court decision to be political motives, the fear of representatives of the authorities of active participation in public life of independent non-governmental organizations.

"We see that independent media are announced as foreign agents. We see dubious criminal cases. Everything that is independent, including those that have independent funding, arouses the authorities' suspicion. Now we are at a stage in development. But I'm sure we'll get through it. We will come to the understanding that human rights are above the state," said Henry Reznik.

Another lawyer representing International Memorial, Mikhail Biryukov, in turn, said that such a court decision was conditioned by the political situation and was intended to "search for the enemy."

"After the ultimatum on NATO and the search for an external enemy, the authorities need to find an internal enemy to enhance the effect. And, unfortunately, they found him in the person of Memorial," he said.

Lawyer Tatyana Glushkova said that the motivation part should be transferred to the defense within five days, according to the law. “Most likely, this will happen after the New Year holidays, and then we will file a cassation appeal,” she said.

Today's court decision was the most likely, said Yan Rachinsky , chairman of the board of International Memorial.

"There were two possible solutions. And what happened was more likely. Since the courts have forgotten how to argue with the prosecutor's office, especially with the general," Yan Rachinsky told the "Caucasian Knot" correspondent.

He also noted that the organization will now think about the format of further work.

"We will think about what to do to continue our activities. Memorial is not only International Memorial, it is a multitude of organizations, and in one way or another the work will continue," stressed Yan Rachinsky.

As a reminder, on November 23, the Moscow City Court began considering a claim to liquidate the Memorial Human Rights Center. The Moscow prosecutor's office filed a lawsuit in court, stating that the organization justifies extremism and terrorism. The last meeting took place on 23 December. Tomorrow, December 29, the process will continue.

On November 12, the Change.Org website published a  petition in support of the Memorial Human Rights Center. As of 21:05 Moscow time on December 28, 138,783 people signed it . Who else is in defense of Memorial, and what persecution he was subjected to earlier, is described in the updated information of the Caucasian Knot."

The public outcry caused by the claim of the Prosecutor General's Office to liquidate this organization eloquently testifies to the value and significance of the work of the International Memorial, lawyer Tatyana Glushkova pointed out to the court during the trial. The court is considering the case formally, without comparing the scale of the violations imputed to the organization with the significance of its work, said human rights activist Oleg Orlov after the first meeting. The prosecutor's office chose the tactics of trivializing the process, avoiding talking about its repressiveness and absurdity, said lawyer Grigory Vaypan.

Earlier, human rights activists, lawyers and journalists indicated that the closure of Memorials would seriously damage the protection of human rights in the North Caucasus. Dunja Mijatovic, Commissioner for Human Rights of the Council of Europe, has twice opposed the liquidation of Memorials.

BTW, the Chinese chasing the Marines from Chosen didn't fare much better. Lots of frozen.

#4  Time for the standees. I have a very low opinion of the Chinese military. They do have a loud mouth but I see them pathetically weak in many ways. India however is a tiger they should let alone. China will always try the back door. Bio weapons and such. Certainly China has built and mass produced many things but their quality control is an absolute joke. Every day this is quite evident.

#5  there are a lot of Chinese military vulnerabilities

I worry about their cyber related abilities, their capability in use of electro pulse to suppress enemy capabilities and similar areas.

On the other hand I don't see how the PRC could actually send 200,000 soldiers across the strait and get them landed and supplied in Taiwan.

China Goes After Elon the Alien
[Express] Chinese citizens lashed out against the tech billionaire’s space ambitions on Monday after satellites from Starlink Internet Services, a division of Musk’s SpaceX aerospace company, had two "close encounters" with the Chinese space station. According to a document submitted by China to the UN space agency, the incidents occurred on July 1 and October 21
In other words, the Middle Kingdom sees SpaceX as a space domination competitor

#2  I've always had the feeling that just as it was shown cell phone tower signals could be used to detect F-117s in flight, the StarLink sats have "off-label" capabilities that probably bug China and Russia.

#3  I think Musk has always talked out of both sides of his mouth, doing the machine's bidding when it could make him a multi-tens-of-billions-aire... and then turning around and wanting a libertarian lifestyle with his money, building rocketships to Mars and his own internet.

Neither of which the machine wants to exist, any more than they want the drilling rigs he wants to use to fuel his rockets to exist.

ESPN To Lose Up To $400 Million In Ad Revenue Due To Cancelled College Bowl Games
[Zero Hedge] - As one headline after another breaks that the new Omicron Covid variant looks more and more like the common cold, businesses still have very serious amounts of money at risk thanks to overbearing "Covid protocols" being forced down everyone's throat (and up their noses).

The latest example is Disney's ESPN, which has as much as $400 million in college football playoff advertising at risk hanging in the balance of a series of Covid tests, which will ultimately determine which College Football Bowl Games will be played and which will be cancelled.

The Hawaii, Military and Fenway bowls have all been cancelled already, Bloomberg reported this week, as a result of surging Covid cases. Playoff organizers are also taking steps to determine whether or not the national championship game can be played this year.
1) I believe most contracts stipulate that $ for ad revenue changes hands only if commercials are shown, but ESPN has already incurred major costs before the bowl games take place; sending out the camera crews & such. 2) Even though this is happening to a woke company, this illustrates a small part of the massive economic damage these lockdown type measures inflict on the economy as a whole.

#5  Meanwhile, a Puerto Rico blogger chronicles the Covidian morons' creation of the Mother of All Goat Rodeos:

"A simple 3 step plan to turn new years eve into the rodeo of 1000 goats and send hotels and hospitals alike into a tailspin.

Step 1: Mandate covid tests on top of vaccine proof for all large gatherings and for flying into Puerto Rico

Step 2: Panic everyone into wild over-testing

Step 3: Completely run out of not only rapid tests but even the actual reagents for PCR such that you literally cannot get a covid test on PR for love or money

This 3 step plan has literally inundated the emergency rooms with healthy people trying to get PCR tests so they can go to concerts, clubs, and big hotel parties for NYE.

Pretty much every event over 100 people is demanding it.

In flawless, on point irony, the ER’s are struggling to provide the actual emergency care for which they are intended because of this and we’re having, for the first time all covid, an actual crisis at the hospitals, not because of disease, but because people want to hit the el san juan hotel party or club 787.

it’s going to be the perfect lose/lose scenario as these parties are going to get gutted because guests cannot enter, the ER’s are on tilt, and who knows how the incoming tourists or locals coming home are supposed to get a test within 48 hours of landing (per new rules).

Apparently, trips and reservations are getting cancelled wholesale over it.

Probably 1/3 of the restaurants in san juan are closed because staff got a positive covid test and the rest cannot get cleared with negatives as no tests are available.

So the health minister responds by cutting restaurant capacity to 50%. so now it’s bedlam everywhere.
