SANTA CRUZ (AP) - The state's oldest California Youth Authority inmate was in court again in a bid for freedom.
Donald Schmidt, 34, was a 16-year-old kid high on methamphetamines when he sodomized a 3-year-old girl and drowned her in a bathtub at a Lompico house where he was a guest in 1988. Another good reason to make capital punishment available in juvenile cases involving special circumstances.
He was convicted entered CYA, where juveniles are typically not held beyond age 25. "He's a danger to others," said Dr. Elaine Mura, a prison psychologist. But not quite dangerous enough for some idiot judge not to try and free him.
On Tuesday, Superior Court Judge William Kelsay decided a jury should decide if Schmidt is a danger to society. A jury trial was set for Dec. 19. "I feel very bad. I'm not sure if the system's meeting his need," said Kelsay, How can it possibly do so without the gas chamber or electric chair? We "feel very bad" too.
who convicted Schmidt in juvenile court 17 years ago. "I never expected today I would still see you in custody." Me neither. Shouldn't this asshole be dead by now?
Schmidt is incarcerated at the Herman G. Stark Youth Correctional Facility in Chino. Where his nickname is "sweetcheeks".

Another good reason to make capital punishment available in juvenile cases involving special circumstances.
Isn't it amazing when the ACLU fights court cases on behalf of young people having 'adult' rights concerning search, privacy, due process, and curfew, but when it comes time to pay the price for adult crimes suddenly they're just children? Equal before the law must apply both to rights and consequences.

There was a famous case if Rhode Island when I lived there of a particularly vicious teenage serial killer (story here) who could not be charged as a adult. Essentially, the jail guards always managed to provoke him into assaulting one of them shortly before his release hearings, getting more years tacked on to his sentence. As of now, he's in until at least 2022.

After two months of uncertainty, Judge Mary C. Morgan ruled Wednesday morning that Popal, 29, is competent to stand trial. She said he understands the 40 felony charges he faces in connection with the hit-and-run spree that killed a Fremont man and injured 18 pedestrians in San Francisco.
"I find Omeed Popal competent to stand trial and order that this report be filed in the confidential section of the docket," Morgan said during the brief hearing. She also reinstated Popal's criminal case which had been suspended last month pending the outcome of the report and ordered him to return to court on Dec. 5. He could enter a plea at that time. The judge's decision brought an end to the 2-month-old debate about Popal's mental state. During previous hearings, Deputy Public Defender Sandy Feinland appeared to be laying the groundwork for a plea of insanity when he twice asked that criminal hearings be postponed so that his client could undergo further psychiatric evaluation.
HARRISBURG - Two days of bear hunting have produced a preliminary harvest of 2,185 bears, according to Pennsylvania Game Commission reports.
Game Commission employees processed 723 black bears on Tuesday, the second day of state's three-day bear season. In 2005, when the state record bear harvest was set, agency personnel processed 2,875 bears on the first two days of season; 2,262 in 2004; 2,299 in 2003; and 2,022 in 2002.
"The statewide two-day bear harvest continues to be typical of an average season and remains comparable to the 2003 and 2004 seasons," said Mark Ternent, Game Commission bear biologist. "Favorable hunting weather remains in the forecast for the last day of season."
These harvest numbers do not include the results of the state's first-ever archery bear hunt, which was held on Nov. 15 and 16. Those results will be available on Nov. 29.
The top nine bears processed at check stations over the first two days of season all had estimated live weights that exceeded 600 pounds. The largest was a 693-pound male taken by John D. Eppinette of Adamstown, in West Branch Township, Potter County, at 3:30 p.m. on Nov. 20.

I guess that shows what you know about bear hunting! Nothing. Most bear hunting in PA is done from tree stands or ground blinds at very close range. Personally, when I used to hunt bear (black/brown) I used a handgun, on the ground, over bait.

BERLIN (Reuters) - German traffic police were shocked to see a California Highway Patrol car cruising along the motorway, driven by a man dressed as an authentic American cop, authorities said on Thursday. But they recovered sufficiently to book the 35-year-old Goettingen resident, whose uniform badge read "T.J. Lazer," for possessing a replica Smith & Wesson revolver without a license and having out-of-date registration plates.
"He was sitting at the wheel with his elbow on the window like in the best TV crime series," said Osthessen police spokesman Martin Schaefer. "Because wearing such a uniform in public is also prohibited, he had to exchange it for civilian dress after a shopping trip with 'real' colleagues," he added.

On the Internet Danish animal owners advertise openly that they offer sex with animals, without intervention from police or other authorities, Danish newspaper 24timer reports. Danish ham for Christmas? Think twice!
In correspondence with the animal owners, the newspaper was told that the animals involved have many years of experience and that the animals themselves wanted sex. The cost to the client varied from DKK 500-1,000 (USD 85-170). Duct tape for hamsters extra.
The Norwegian Food Safety Authority's section chief for animal welfare, Torunn Knævelsrud, could not rule out that such a bordello could be legal here as well. "It is difficult to say yes or no," Knævelsrud told Aftenposten.no. Try this, Torunn: HELL NO! Guess not.
As long as basics like shelter, feed and care are in place, and injury or suffering to the animal can not be documented, there are no other ways to attack an animal bordello under existing Norwegian law. "The acts provoke moral disgust. The question is whether immorality should be made illegal. The FSA group discussing the new animal protection act has been in disagreement about this," Knævelsrud said.

But seriously folks, sorta lends new meaning to the old saying of "Why buy the cow ..." For me the issue of morality in this is pretty clear cut. It's much like the Supreme Court justice said about pornography; "I know it when I see it."
There are a sufficient number of questionable aspects to this whole endeavor where it's a fairly obvious case of outright animal abuse. Yeah, we kill these critters on a regular basis, but I'd say that's a lot more humane than having people stand in line to boink them.
This certainly sheds new light upon the classic Australian catchphrase; Fuck all.

A country court in New South Wales state was told 50-year old David Stack had a blood alcohol level of 0.26, which is 13 times the legal limit for a bus driver, when he was stopped on November 7. The court was told two adult passengers had alerted police after Stack's bus was speeding and swerving across the road.
Stack, who pleaded guilty to the drunk driving charge, said he regretted his actions and had apologized to the children on the bus at the time. Now unemployed, Stack will be sentenced in February.
Some wild turkeys, it appears, were trying to get out of New Jersey before Thanksgiving. NJ Transit officials reported seeing a dozen or so wild turkeys waiting on a Ramsey train station platform Wednesday. The line continues to New York after going through Mahwah, where wild turkeys also caused a minor traffic accident. It was not clear whether they were the same birds as the ones in Ramsey. The towns are about 2.5 miles apart.
Dan Stessel, a spokesman for NJ Transit, said the sighting at the station wasn't a joke.
"For a moment, it looked like the turkeys were waiting for the next outbound train," he said. "Clearly, they're trying to catch a train and escape their fate."
NJ Transit workers began noticing the birds about 1:45 p.m. and followed their movements on surveillance cameras. A still photo shows a woman with a Macy's shopping bag near the turkeys. The birds left and returned to the platform about an hour later.
Police in Ramsey, a town about 20 miles northwest of New York City, heard about the birds, too. A dispatcher said the department had received three calls Wednesday about a dozen turkeys traveling together. They also caused a problem with car traffic Wednesday morning.

The original £2.375bn budget to build the Olympic facilities in Stratford, East London, has now risen to £3.3bn. Insiders think an £8bn bill is now realistic and a £10bn bill far from alarmist. On top of the £3.3bn cost of building the facilities you have to add the spiralling security costs of staging the games in London, where costs have risen since the July bomb attacks last year.
The original budget did not include a bill for VAT costs on the construction, which the Treasury now expects the Olympic Delivery Authority to pay. That bill will be at least £250m - taking the total costs to £8.25bn. Others say the VAT bill could be up to £1bn - raising the total above £9bn. The £2.375 billion public funding package included £1.5 billion from National Lottery, £625 million from London council taxpayers and £250 million from the Mayor's London Development Agency. Tony Blair and Ken Livingstone have both ruled out council tax rises to fund the shortfall. But lottery good causes are likely to be squeezed further. One other option would be for the Treasury to give up the 12p it takes from the sale of every lottery ticket.

A member of the Alasam Beduin tribe was killed and three were wounded - two seriously, one moderately - after a brawl erupted into a shoot out on Wednesday evening on the Dimona-Beersheba Highway near the Beduin town of Arouar. The dead man and the wounded were all in their 20s.
The incident began as a fight among kids but soon deteriorated into a fatal firefight. Police officers were on the scene, trying to reestablish order. Police estimated that the attack was criminally motivated.

AMMAN - Jordans King Abdullah II issued a decree Wednesday approving the reshuffle of Prime Minister Marouf Bakhits cabinet, according to an official statement. Nine new ministers joined the cabinet while Seven ministers left the government, including Justice Minister Abd Shakhanbeh who was replaced by Sharif Zoabi, and Energy Minister Azmi Khreisat who was replaced by Khalid Shraydeh.
Among those retaining their posts in the new ministerial formation were Foreign Minister Abdul Ilah Khatib, Interior Minister Eid Al Fayez and Finance Minister Ziyad Fariz, official sources said.

Joe Mroszczyk, president of the College Republicans at Boston University, admits he set out to stir up a hornet's nest when he came up with the idea of offering a whites-only scholarship at the school. But he got a little more buzz than he bargained for. "To tell you the truth, we didn't see this coming," Mroszczyk said. "The Drudge Report picked it up yesterday, and today I just finished a round of national interviews. It's kind of overwhelming."
All the media attention is focused on a $250 Caucasian Achievement and Recognition Scholarship offered by Mroszczyk and the BU chapter of the College Republicans. Applicants must have a cumulative grade point average of 3.2 or higher; they must write two essays; and, here's the kicker, they must be at least one-quarter Caucasian. The application itself offers an explanation: "We believe that racial preferences in all their forms are perhaps the worst form of bigotry confronting America today."
According to Mroszczyk, his group is offering the scholarship to point out "how ridiculous it is to have any sort of racially based scholarship." At BU, for example, students who are at least one-quarter Hispanic can apply for a National Hispanic Recognition Scholarship. "There are plenty of poor, white, academically gifted students who need that money just as much," Mroszczyk said.
It isn't the first time a group of students has tried this kind of stunt. Two years ago a chapter of the College Republicans at Roger Williams University also offered a $250 whites-only scholarship. That's where the BU students got the idea.
"We are not doing this as some kind of white supremacy thing. I wanted to have a dialogue about racial preference," Mroszczyk said. It seems as if Mroszczyk has gotten his wish. People from across the country are now weighing in on the idea through e-mail and the radio. And closer to home, some BU students are having their say too.
"It's a poor way to talk about affirmative action," said David Coreas, the 21-year-old senior who is president of the Latino fraternity Phi Iota Alpha at BU. "If they want to have a scholarship, then let them have a scholarship, but they're stirring up controversy in the wrong way."
Coreas said he believes that racially based scholarships are necessary to level a very uneven academic playing field. "We have to look at the situation honestly," he said. "Caucasians tend to have a higher per capita income than Latinos and other minorities. We have to have scholarships to survive." Another Perfect Latin American Idiot.
Coreas said he would welcome an honest dialogue on campus about race and affirmative action. As long as he gets to set the boundaries on what are permissible topics.
Mroszczyk admits even some of his good friends are shaking their heads. "They said I can't believe you're doing this," he said.
But for all the talk, there are still no takers for the scholarship. The application has been available online since Nov. 7, and so far not one student has filled it out. That's money wasted, according to David Coreas. "I wish I could apply: That $250 could help me pay for my textbooks," he said. Coreas isn't eligible, though. Though there are many scholarships for which he (and not whites) is eligible. He's apparently not smart enough to earn one, preferring to ride victimhood to wealth.
But for BU students who have a pretty good GPA and can write a couple of essays, there's still time, as long as they're also 25 percent Caucasian. The deadline for applications is Nov. 30. The problem for Mr. Mroszczyk is that he has the idea that a university is a realm of free-thinking and open conflict of ideas, rather than a Stalinist indoctrination mill.
