Linn rejected the defense’s request for a new trial after arguments were made by his lawyers at the lengthy sentencing hearing...

"There is nothing I can do here that can come close to the damage you’ve done to your own life," Linn told Smollett before issuing his verdict, adding he took the actor-singer’s character into account in making his decision, as well as the glowing endorsements from Jesse Jackson and Derrick Johnson.

‘A Very Big Deal’: Attorney Responds to Judge Dismissing Felony Obstruction Charge Against Jan. 6 Defendant
[EpochTimes] A federal judge has thrown out a felony obstruction charge leveled against a Jan. 6 defendant, saying the man’s alleged conduct doesn’t fall under the statute used by prosecutors in dozens of cases related to the 2021 breach of the U.S. Capitol.

U.S. District Judge Carl J. Nichols dismissed one of the 12 counts against defendant Garret A. Miller, 35, of Richardson, Texas.

In a 29-page ruling (pdf) on March 7, Nichols, a Trump nominee, wrote that the federal indictment of Miller doesn’t allege the kind of conduct covered by 18 § U.S.C. 1512(c)(2), which relates to the destruction of records or documents—not the attempt to prevent the counting of presidential electors by Congress.

DOJ Offers 70- to 87-Month Prison Sentence to Man Photographed With Feet Up in Nancy Pelosi’s Office

’s (D-Calif.) office on Jan. 6, 2021, rejected a plea agreement offered by the Department of Justice that would have seen him spend 70 to 87 months in prison.

Barnett, 61, of Gravette, Arkansas, faces three charges stemming from the U.S. Capitol breach, including knowingly entering or remaining in any restricted building or grounds while armed with a dangerous weapon, violent mostly peaceful entry and disorderly conduct on Capitol grounds, and theft of public money, property, or records.

Barnett’s attorney, Joseph McBride, rejected the plea offer, calling it "ridiculous." Barnett will proceed to trial in the fall, he said.

"The very general question is, ’Does the punishment fit the crime?’" McBride told The Epoch Times. "There is no standard of reasonableness under which 70 or 87 months of incarceration for a 61-year-old man with no criminal record can ever amount to justice.

"In this situation, it is egregious. It is disgusting. It is a criminalization of the First Amendment’s right to participate in political speech. While it was not a perfect day, he certainly should not spend years of his life—basically the entire decade of his 60s—behind bars. It’s ridiculous."

According to federal prosecutors, Barnett entered into the conference area of the Speaker’s office on Jan. 6, 2021, at about 2:50 p.m. and left at 2:56 p.m. He put his feet up on a desk and posed for photographs that went viral on the internet later that day.

Texas Elections Official to Resign After Thousands of Uncounted Ballots Found
[EpochTimes] The Harris County elections commissioner is resigning after 10,000 uncounted ballots for last week’s primary were discovered, according to an announcement posted online on Monday.

"Today I am submitting my resignation, effective July 1," Isabel Longoria said in the announcement. "I think this date ensures that there is a presiding officer during the May and June elections and allows the election commission the time they need to find a replacement. I remain committed to the office and its mission and hope to aid in defeating harmful rhetoric to ensure successful elections in the future."

It’s not clear exactly why Longoria was resigning. The Harris County Republican Party in Texas recently filed a lawsuit against the commissioner after the 10,000 uncounted ballots were discovered.

There were other issues with the primary election, including staffing problems, equipment issues, and longer-than-usual lines, according to local reports.

"The buck stops with me to address issues for voters and I did not meet my own standard or the standard set by commissioners," Longoria said Monday.

Before Longoria’s statement, Harris County Judge Lina Hidalgo said she had spoken with the commissioner about a "change in leadership," Hidalgo told a Commissioners Court meeting last week.

It came days after the Harris County Elections Office said that some 6,000 Democratic votes and 4,000 Republican votes weren’t counted and will be added to final tallies for last week’s primary.

"While the votes were scanned into our tabulation computer, they were not transferred and counted as a part of the unofficial final results as they should have been," the Harris County Elections Office said in a statement, blaming an "oversight" for why the votes weren’t counted in the county, which is home to Houston.

March 1’s primary was the first Texas election that took place in the state under newer, tighter voting laws that were passed last year. Outside of Harris County, thousands of mail-in ballots were rejected across the state for not having new required information.

On Monday, the Harris County Republican Party filed a lawsuit against Longoria and the elections office for committing the "worst elections fiasco in Texas history" after the ballots were found, uncounted.

In an accompanying statement, the GOP described the incident as "another example of the serious mismanagement of Lina Hidalgo’s unqualified Elections Administrator."

Even the Democratic Party of Harris County released a statement calling for an investigation.

"We called for a post-election review of all processes—there has not been any skirting of party responsibility, and we have been completely transparent in our desire to dig into the details of what went wrong and identify how to make corrections moving forward," Harris County Democratic Party Chair Odus Evbagharu remarked.

RNC Fights Back Against Partisan J6 Committee, Files Lawsuit

and the January 6 committee over their efforts to subpoena RNC databases.

"The RNC has sued to stop the January 6th Committee from unlawfully seizing confidential information about the internal activities of the Republican Party and millions of its supporters which is completely unrelated to the attack on the Capitol," RNC chief counsel Justin Riemer said in a statement.

"The select panel has subpoenaed Salesforce.com for the data it maintains for the RNC. Those digital communications enable political parties and other nonprofit organizations to operate and allow for organizations to interact with millions of online users," reports the Washington Times. "

Salesforce also collects and maintains RNC data, including confidential and "sensitive information about private individuals with whom the organization has engaged, ultimately helping develop and execute political strategies," the RNC said in a statement.

The 29-page lawsuit accuses the J6 committee of demanding documents "that have no connection to the attack on January 6, 2021. Without any limitation to the events of January 6, the Salesforce Subpoena demands production of sensitive and proprietary data over more than a two-month period."

The J6 committee has long been accused of exceeding its mandate of investigating the Capitol riot and of using the investigation as a pretext for acquiring sensitive information from Republicans, including Trump White House documents that would typically be protected by executive privilege. In addition, the RNC says the database the committee is demanding access to would expose the RNC’s internal political strategies and private information on supporters.

"Nancy Pelosi and the Committee have weaponized Congress’ investigatory powers by issuing this staggeringly broad subpoena which tramples on core First Amendment rights of the RNC and millions of Americans," Riemer said.

And all these people who’ve been so tough and so mean and so nasty are going to be delivered subpoenas for every document, every conversation, every tweet, every email," Gingrich said. "I think when you have a Republican Congress, this is all going to come crashing down. The wolves are gonna find out they’re now sheep, and they’re the ones who are, in fact, I think, going to face a real risk of going to jail for the kind of laws that they’re breaking."
