Oops – Gibson's Bakery Seeks To Execute On $36 Million Appeal Bond Since Oberlin College Failed To Obtain Stay Of Appeals Court Mandate
[LI] Motion filed in trial court today: "If Defendants wanted to stay execution of the mandate of the Ninth District Court of Appeals, they were required to seek that stay in the Ohio Supreme Court. They did not. Plaintiffs are entitled to judgment on the surety bond ...."

As posted recently, Oberlin College is seeking to have the Ohio Supreme Court hear an appeal from the massive $32 million judgment entered after jury trial in the Lorain County Court of Common Pleas as affirmed by the 9th District Court of Appeals.

There has been an appeal bond in place since trial issued by Zurich American Insurance Company securing the judgment plus future interest in the amount of $36 million, as a condition of a stay of judgment issued by the trial court.

In the Court of Appeals decision, the court noted on the very last page something that didn’t mean much to me at the time (emphasis added):

We order that a special mandate issue out of this Court, directing the Court of Common Pleas, County of Lorain, State of Ohio, to carry this judgment into execution. A certified copy of this journal entry shall constitute the mandate, pursuant to App.R. 27.

It does not appear that Oberlin College sought a stay of that mandate pending appeal to the Ohio Supreme Court. The Gibsons have just filed a Motion to Enter Judgment Against Surety Zurich American Insurance Company in the trial court arguing, in part:

Plaintiffs Gibson Bros., Inc. and Lorna J. Gibson, as the executor and representative of the Estate of David R. Gibson and the Estate of Allyn W. Gibson ( collectively "the Gibsons") respectfully request that this Honorable Court enter judgment against the surety Zurich American Insurance Company, Bond No. 9280167 in the amount of $36,127,181.25 plus $4,331.19 per diem from the date of filing. A chart calculating the judgment per diem is attached for the Court’s convenience as Exhibit 1. There is no valid stay of execution of judgment remaining, and the Gibsons are entitled to judgment in accordance with the mandate from the Ninth District Court of Appeals.

For His Safety, Lifeguard Waits An Hour For Backup Before Jumping In To Save Struggling Swimmer
[Babylon Bee] SAN FERNANDO, CA—A lifeguard at the San Fernando Community Pool reportedly refused to jump in and save a drowning child who was fighting for his life in 6 feet of water because it would constitute risking his life. The lifeguard in question, Peter Stroll, claimed to be following standard lifeguarding procedure.
"I just ate a sandwich. One hour is required"
"Are you kidding? I can't save you right now. I might drown!" said Stroll as he picked up the phone to call for help. "According to the procedure, I will block all access to the pool and call for highly trained Coast Guard rescue divers to arrive."

The child's father attempted to jump into the pool and save his kid but was prevented by the determined lifeguard.

"Sir, I can't let you risk your own life. Let me do my job!" Stroll reportedly said in between whistle blows.

"Then do your job! Save him!" pleaded the parent.

"Sir, please. It's a liability for me to risk my life. Do you know how much the city would have to pay my family? Hundreds of dollars!"

The child was eventually rescued when a group of parents overpowered the masculine lifeguard and braved the dangerous chlorinated waters. Authorities arrived on the scene shortly after to assess the child's health and arrest everyone who tried to save the child.

"This is a pool of law and order!" Sheriff Witherdrew told reporters at the scene. "We can't just have people bypassing our sacred lifeguard institutions to take rescues into their own hands. Millions could be saved! It'd be total anarchy!"

At publishing time, lifeguard Peter Stroll was awarded a key to the city by Mayor Rankowicz for extreme bravery in following procedure to keep the city free of liability.

Joe Biden's DHS Using Border Wall Funds to Conduct ‘Environmental Planning'
[Breitbart] President Joe Biden’s Department of Homeland Security (DHS) is spending border wall funds, previously allocated by Congress to construct a wall along the United States-Mexico border, on addressing “life, safety, [and] environmental,” issues.

In July 2021, DHS Secretary Alejandro Mayorkas announced the administration’s plans to spend American taxpayer money on a host of issues, including environmental restoration, rather than expanding on the border’s existing wall constructed during the Trump administration.

On Friday, Mayorkas detailed plans to close some of the border wall’s gaps that have remained since Biden halted all construction of border wall in late January 2021.

As part of that effort, Mayorkas said in a news release that DHS is moving “forward with projects in the San Diego, El Centro, Yuma, El Paso, and Rio Grande Valley Sectors to address life, safety, environmental, or other remediation requirements in accordance with [DHS’s] plan for the use of border barrier funds.”

[WIRE] New York City health officials sparked backlash with a series of public health signs posted around the city’s subway system encouraging intravenous drug users to be "empowered" — not by getting clean, but by taking steps to "use safely."

NYC Council Minority Leader Joe Borelli shared a photo of one of the signs on Twitter, which read, "Don’t be ashamed you are using. Be empowered that you are using safely."

The sign included a number of "helpful" tips for those who wanted to "use safely."

Under the section labeled "What is fentanyl?" the description read, "Fentanyl is a powerful opioid that can be found in heroin, cocaine, crack, methamphetamine, ketamine, and pressed pills."

A second section answered the question, "Why is it dangerous?" by saying, "Fentanyl increases the risk of overdose, especially among people who do not regularly use opioids."

The final section listed several steps that users could take in an effort to "empower" themselves to "use safely" and "prevent overdose."

#6  This is utterly irresponsible. In 2019 I had a friend die of a fentanyl overdose in my arms. The Deputy and I tried to save him... but his lips turned blue and he was gone. He wasn't an intellectually stupid man, and knew how to "do his drugs." And they still took him.

You can't use safely. You have to get clean.

The Mall died 2-3 years later.

A New Enlightenment is Coming
[American Thinker] The 18th century "enlightenment" changed the world. John Locke, Isaac Newton, Emmanuel Kant, and several others were largely responsible for the seismic humanist shift away from religion toward the complete sufficiency of science and intellectual thought. According to the Stanford Encyclopedia of Philosophy,

Kant identifies enlightenment with the process of undertaking to think for oneself, to employ and rely on one’s own intellectual capacities in determining what to believe and how to act... Enlightenment philosophy tends to stand in tension with established religion, insofar as the release from self-incurred immaturity in this age, daring to think for oneself, awakening one’s intellectual powers, generally requires opposing the role of established religion in directing thought and action. The faith of the Enlightenment -- if one may call it that -- is that the process of enlightenment, of becoming progressively self-directed in thought and action through the awakening of one’s intellectual powers, leads ultimately to a better, more fulfilled human existence.

Does it? Putting aside for the moment that miracles, religion, and tradition can be a part of cogent reality, the Enlightenment thinkers took a step away from religion, which until that time was the primary basis upon which mankind pursued knowledge and meaning. In its place came a strident self-directed philosophy by which many lived and still live.

Today we can see the distinct influence of Enlightenment thinking in American life: People are excessively self-absorbed to the point of being self-consumed. You can readily see this in TikTok, Instagram, and the Twittersphere where the singular aim is to get attention through "likes" and retweets. The dopamine hit has become the drug of choice.

Because this self-absorbed Enlightenment thinking has largely decimated decency and comity in our culture, the vacuum they have left paves the way for a new Enlightenment. This vacuum solicits meaning, not in the shallow Hallmark sense but with the deeper observation that little that the world provides is fundamentally meaningful.

Sadly, the science-based, anti-religious Enlightenment does not allow for ethics. Nowhere within can be found the methodology to determine right from wrong. Leaving ethics in individual hands seemed at the time (and still does for the non-religious) a perfectly reasonable thing to do because supposedly within each person lay the seeds of altruism and an innate striving to do what is right and good. But that is not the case. Human beings are too flawed to determine what is right and good without having a baseline in something or someone less flawed. Ethics can answer the question, "Is this effective?" It can never answer the question "Is this good?" God alone knows what is good.

Feds Confirm Investigation Into Elon Musk
[WIRE] The U.S. Securities and Exchange Commission confirmed on Friday that it is investigating Elon Musk’s disclosure that he owned shares in Twitter ahead of his $44 billion purchase of the company.

The SEC is looking into why Musk allegedly made his disclosure late that he owned more than 5% of the company’s shares, which he must legally disclose within 10 days of meeting the threshold.

"The SEC also wants to know why Musk filed a ’13G’ form, which is meant for passive investors, rather than a ’13D’ form that would be for activist investors (including those with interest in making a takeover offer)," Axios reported. "It’s important to note that the SEC’s letter came on the same day as Musk’s disclosure, which is before he offered to buy Twitter outright."

The SEC said in its letter that it wants a response from Musk even if he does not believe that their "comments apply to your facts and circumstances."

"The case is easy. It’s straightforward," Daniel Taylor, a University of Pennsylvania accounting professor, said. "But whether they’re going to pick that battle with Elon is another question."

[Daily Wire] As President Joe Biden reportedly nears a plan to cancel $10,000 in student loans per borrower, National Association for the Advancement of Colored People (NAACP) President Derrick Johnson argued Friday that the amount would not be enough — particularly for black borrowers.

After months of pressure from progressive Democrats, the White House is nearing a plan to scrap $10,000 per borrower earning up to $150,000 per year, according to a report from The Washington Post. Johnson argued that such a solution would be "pouring a bucket of ice water on a forest fire."

"Black Americans are the only people who have student debt higher than their median annual income," he said. "$10,000 in cancelation would not place their student debt lower than their annual income."

Johnson also pointed toward wealth disparities between black and white households.

'Good Gal With a Gun' Saves Many Lives in What Could Have Been Mass Casualty Event
[Red State] There are a lot of questions being raised now about the police response to the Uvalde mass shooter. Even Texas Gov. Greg Abbott is saying he was misled by the police about the timeline of what occurred, that they hadn’t told him that they had waited for an hour-and-15-minutes from the time an officer first arrived on the scene until they killed the shooter.

You did have heroic people, like CBP agent Jacob Albarado, who raced into the school with some other agents and helped to get out not only his own daughter but dozens of other children. Albarado urged people to allow teachers to be trained and carry, to be able to defend themselves and their students. It’s not hard to think of how different things might have been had that been the case.

Indeed, we can look to a case that just happened in Charleston, West Virginia, on Wednesday night.

Dennis Butler, 37, was warned about speeding near a party where children were present in an apartment complex. Then Butler reportedly returned with an AR-15 and began shooting. It was a recipe for a disaster; there were dozens of people at the party and a lot of people could have been hurt or killed. But a woman who was a guest at the party was lawfully carrying a pistol. She pulled it, fired, and took down Butler. He sustained multiple gunshot wounds and later died.

"Instead of running from the threat, she engaged with the threat and saved several lives last night," Charleston Police Lieutenant Tony Hazelett confirmed. "She was lawfully carrying a firearm and stopped a threat. There was a graduation party and a party with kids so obviously someone just graduated high school and we could have had a casualty shooting."

There has been a concerted action in the past decade or so in LE to make cops more socially "acceptable". Programs like COP (Community Oriented Policing) and "Coffee with a Cop" come to mind. That and the efforts to be "inclusive", ie. hire more women and minorities. There are also lots of departments that strive to make themselves "friendlier looking", e.g. fancy paint jobs on the patrol cars and cops with beards, etc. All this is well and good, I suppose, but it's long term effect (in this one old cop's opinion) has been that cops have forgotten their prime mission statement - in a word: Enforcement. The operative portion of that word is "force". It's not "convince" or "plead" or other weasle words. Policing to me always meant being there with a smile, but with an attack plan in my head - be prepared at a drop of a hat to go from friendly cop to attack cop. Many, many new cops don't have that. Not their fault - it's the liberal societies fault. In recent years there is also the "G. Floyd" effect - don't do anything (even the right thing), that may get you fired or sent to the slam. Long story short: Woke cops don't automatically "run to the gun". Sad.

Step 2, Eliminate 1-2 'Administrators' per school and hire former military (Combat arms/Military Police Only) to have at least 2 per school. They will be at the school during school hours and make regular patrols while wearing full battle rattle (Armor, weapon with optics, etc). Each has master key for school.

First-quarter economic growth revised down slightly to negative 1.5% annual rate
[Washington Examiner] GDP fell at a 1.5% annualized rate in the first quarter of 2022, a revised estimate from the Bureau of Economic Analysis showed Thursday morning.

The decline in inflation-adjusted GDP is a major reversal from the previous quarter, when growth soared to a 6.9% rate as businesses began healing faster from the pandemic as restrictions were lifted.

The first quarter of this year marks the first such contraction since the second quarter of 2020, when the economy suffered from the enormous shock of coronavirus shutdowns.

The decline in GDP for the first part of this year fueled anxiety among some economists that a recession is around the corner.

"While we still expect the Fed to steer the economy toward a soft landing, downside risks to the economy and the probability of a recession are increasing," economists from Oxford Economics said after the report was released.

The country is being plagued by explosive inflation, with consumer prices increasing by 8.3% in the 12 months ending in April. As a result, the Federal Reserve has embarked upon a historic interest rate hiking cycle designed to slow the economy and tame the rising prices.

Biden tells Naval Academy grads BS story of applying to attend Annapolis
[WND] Joe Biden has told another of his stories in an address to the Naval Academy graduates.

And it wasn't even hours before its truthfulness was being challenged.

The New York Post said Biden reported applying for the academy, but bluntly said the dates claimed by Biden "don't add up."

"President Biden told graduating midshipmen at the Naval Academy Friday that he applied to the school in 1965 — but a quick check of his biography shows problems with the story," the report said.

Biden claimed he applied with a letter from then-Delaware Sen. J. Caleb Boggs, "but the year he cited — 1965 — is the same year he graduated from the University of Delaware."

"I was told the Class of ’72 is here. I was appointed to the academy in 1965 by a senator who I was running against in 1972 — never planned it that way. I wasn’t old enough to be sworn in. I was only 29 years old when I was running," Biden said. "He was a fine man. His name is J. Caleb Boggs. I didn’t come to the academy because I wanted to be a football star. And you had a guy named [Roger] Staubach and [Joe] Bellino here. So I went to Delaware."

The post reported Bellino and Staubach are the only two Navy players to win the Heisman.

The report explained the U.S. was fully involved in Vietnam by the mid-1960s and had Biden gone to the academy, he would have needed to serve in the Navy on graduation.

Of the $15B for weaponry in the latest bill, only $6B will actually go to the Ukrainians. $9B is actually going to replenish the depleted US arsenal -- depleted by earlier shipments to Ukraine that succceeding in nothing more than buying the Ukrainians a few extra weeks. So in reality, US support under Biden is diminishing, not increasing.

This is corroborated by the EU chief's statement the other day that the European allies are so depleted now, "the European armies couldn't maintain a war like the one in Ukraine for more than two weeks. They'll run out of ammunition" in a conventional war with Russia.

Joe is just bullshitting again -- just like his lies about Afghanistan in that interview he gave to Stephanopoulos. As with Afghanistan, a big chunk of that $6B will probably end up in Russian hands.

One Navy seaman said Hale-Cusanelli told him "he would kill all the Jews and eat them for breakfast, lunch, and dinner, and he wouldn’t need to season them because the salt from their tears would make it flavorful enough," according to prosecutors.

Other coworkers recalled Hale-Cusanelli making derogatory remarks about women, Black people and other minorities, prosecutors said.

Before the trial, Crisp argued that any testimony about Hale-Cusanelli’s alleged statements about Jewish people and their role in the US government would be "highly prejudicial in nature without substantive value."

Crisp acknowledged Hale-Cusanelli shouldn’t have entered the Capitol building.

"But the question of why he was there is what is important," he told jurors Tuesday.

Hale-Cusanelli wasn’t charged with engaging in any violence or property destruction. He was indicted on five counts: obstruction of an official proceeding, entering or remaining in a restricted building or grounds, disorderly or destructive conduct in a restricted building or grounds, disorderly conduct in a Capitol building, and parading, demonstrating or picketing in a Capitol building.

The obstruction charge is a felony. The rest are misdemeanors.

A deadly explosion at Iran’s Parchin military complex on Wednesday was caused by quadcopter suicide drones, in an attack that fits a pattern of previous strikes that have been attributed to Israel, The New York Times reported Friday.

The report cited three Iranian sources along with a US official, who confirmed drones hit the site, but declined to say who was behind the attack. It said the drones went kaboom! into a building being used for research on Iran’s drone development.

The blast killed a young engineer at the site and injured one other person.

The report noted that the strike fits a pattern of previous attacks that have been attributed to Israel, including previous strikes against Iran’s drone program.

Iranian sources told the Times that the drone attack was launched from inside Iran, not far from the Parchin military base — which the Islamic Theocratic Republic uses to develop missile, nuclear and drone technology — noting that quadcopter drones have a short flight range, and Parchin is a long way from Iran’s borders.

While Iranian officials initially used the word "accident" to describe the earth-shattering kaboom, the Defense Ministry in a later statement called it an "incident" and labeled the casualty a "martyr," suggesting that Tehran is convinced it was an attack by a foreign entity.

The two congregants, one of whom is a Holocaust survivor, had first brought a joint lawsuit against the protesters, the city and Ann Arbor Mayor Christopher Taylor in 2019. Lower courts dismissed it on First Amendment grounds, and a judge ordered the plaintiffs to pay the protesters’ legal fees. Following a dispute between one of the plaintiffs, Marvin Gerber, and their attorney, Marc Susselman, the suit was broken up and two separate petitions under two separate attorneys were filed to the Supreme Court.
