#1 Kagan has been asked to recuse herself. Don't know if she will.

#2 I don't see the same argument for recusing Clarence Thomas as I do for Kagan. The Donks think Thomas should recuse himself because his wife worked for an oranization which opposed national healthcare. Kagan was more directly involved in the process. She worked for the Obama administration as solicitor general on healthcare.

#3 That's right. Kagan was *directly* involved. Thomas was never directly involved.

If we are going to look at friends and relatives of the justices - we may as well have them all recluse themselves....

#4 recusing is an ethical act. Don't expect ~~Kevin James~~ Elena Kagan to do that
