#1 They tossed out the verdict altogether AND remanded the matter with instructions that the case be dismissed

Did they consult the (Judge) Sullivan precedent? I mean, courts are all wrapped with with precedent to the point of ignoring the text of the Constitution. Why should the lower court dismiss? (do I need to put a /sarc on that?)
