#1 Doesn't look like the right link to the article; it says nothing about the supposed IRS liability. That said, I'm thinking said liability is really what the union owes the pension fund in matching 401(k) contributions, not a tax it owes to the IRS. The latter kind of liability would generally be for unpaid payroll taxes like Al Sharpton did for a number of years.
