#2 In the lame duck session. If the 2020 election was not on the up and up, it would be stupid to have both players on the same ticket subject to a blanket impeachment. It will depend on the final Senate headcount for January. 60 seems unlikely. A move before November will potentially turn a defeat into a rout.

#3 If Biden leaves before the midterms then the Democrats lose their majority because when Harris becomes the president, she’s no longer be the tiebreaker in the Senate and so basically the Democrats lose their majority and therefore they lose control over who is appointed as Vice President
