Police shoot, kill naked intruder in Mankato
MANKATO, Minn. -
Police shot and killed a naked man who apparently broke into an apartment and threatened the officers with broken glass.

Police were called by residents who came home to find a naked man damaging things in their apartment.

The officers who responded late Sunday tried to subdue the man and were injured. They shot and killed the man at the scene.

The name of the man was not immediately released. The three officers were treated and released from Immanuel St. Joseph's Hospital in Mankato.

The Minnesota Bureau of Criminal Apprehension is investigating, with help from the Mankato Department of Public Safety.

Anti-military lawyer key-jobs Marine's car
Moderator note: I'm betting we're going to get multiple posts on this one today. Please use this post for all comments on the case, and please refrain from duplicate posts. Thx. AoS.

Oh, and the lawyer is a snake.
Blackfive

Marine Sgt Mike McNulty is on activation orders to Iraq (second tour). On December 1st, 2007, Mike went to visit a friend in Chicago before deploying to say goodbye. In order to get to his friend's residence, and keep in mind that Chicago is a myriad of diagonal and one-way streets, the front entrance (right way) to the one-way street was blocked. Mike, being a Marine, overcame and adapted by driving around the block to the other end of the street and backing up all the way to his friend's place.

While saying goodbye, at about 11am, he noticed a man leaning up against his car. Mike left his friend's apartment and caught the man keying his car on multiple sides.

The police report states:

Victim related to P/O that as he walked back to his vehicle, he observed the offender leaning up against his vehicle and rubbed/dragged his left arm and hand across the passenger side. As offender walked away from victim's vehicle, victim observed a scratch along the rear trunk and passenger's door area where offender dragged his arm and hand over. Victim and witness stopped offender and confronted him. Victim has military plates and decals on his vehicle and offender made anti war and military comments to victim. Upon P/O's arrival to scene, offender denied scratch victim's vehicle, but did admit to rubbing past it. Victim at this time did not sign complaint, because he is leaving tour for military duty. Offender said they accused him of scratching the car because he is Jewish. Offender's statements/responses to P/O's questions unreasonable.

As it turns out, the man is Chicago lawyer Jay R. Grodner, who owns a law firm in the city and has offices in the suburbs.

To make a long story short: Atty. Grodner is attempting to string the matter out until Sgt. McNulty ships out, after which it would be dismissed for lack of a complaining witness. There are, perhaps, a few things we can do:

1. Blackfive has Atty. Grodner's office contact information on his website. Should you choose to express yourself directly, please be polite, avoid foul language, and do not make threats. If you do any of these things, you will only give Atty. Grodner something to go after you on, by either a civil suit or a criminal complaint, and something he can post to DU or Daily Kos to gain sympathy with.

2. If anyone is a member of the Illinois bar and wants to take on Sgt. McNulty as a pro bono client, that would be nice. (I'd do it, but I'm not licensed to practice in Illinois.)

3. Regardless of the outcome of the criminal charges, this incident can and should result in action against his law license. There's a website where you can initiate a request for investigation.

#1  My son deploys about the same time. This pisses me off like few things can. I would be willing to donate through PayPal if he has to hire a lawyer. If the charges are true...I would like to see him disbarred...and I would be proud to say I contributed to that end.

#2  If Sgt. McNulty has collision or uninsured on his auto insurance policy, can he just have his insurance policy pay for it and let them ream Grodner? Perhaps he can just work through affidavits or something? Maybe the insurance company can keep the claim alive while he is in Iraq.

#5  The guys at Blackfive are all over this - lots of details re: address, fax numbers and what looks like (to my untutored eye) sensible legal advice. In particular, there may even be the possibility of the lawyer being charged with a hate crime! (personally, I despise those laws)

I think SGT McNulty is finding out he has a lot of friends, and Mr Grodner is about to find his life somewhat more difficult. Grodner using the "they're picking on me because I'm Jewish" argument is despicable.

#18  Please help me remember the line once again.... I believe it still applies.

William Shakespeare (1564–1616), British dramatist, poet. Dick the butcher, in Henry VI, Part 2, act 4, sc. 2, l. 76-7.
Posted by: Besoeker || 12/31/2007 14:13 Comments || Top||

#19  Yes Besoeker; "let's kill all the lawyers" - I used to think that...

But this is actually *in praise of lawyers*.

Rather, it was intended to eliminate those who might stand in the way of a contemplated revolution -- thus underscoring the important role that lawyers can play in society.

To the vast majority of people in the World, it must seem strange that the US Supreme Court (just 9 people) can hamstring any President - generally thought the most powerful person on the planet. But that's what happens. It astonished me when I first realised it.

Which is why it is so vital that lawyers 'act the part', and recognise that with this power comes immense responsibility. The rule of law is a major bulwark against the expansion of the power of Government, and the erosion of personal liberties. The final bulwark is rebellion, but at least in the US, the 2nd Amendment is there to ensure that descent into anarchy won't happen. Almost every other country in the world does not have that final safeguard...

All of which makes this lawyers' behaviour even more odious - tweaking the nose of the very people who create a safe and secure environment within which he can make (presumably a very good) living.

:(

#24  A Free Republic guy was present in court today --
His report is here

Part of his report:
Sgt. McNulty was in civvies. He was there with family & friends and his attorney.

There also appeared to be a couple of supporters sitting in the gallery.

I sat in the last row. With my eyesight & hearing shot, the following is the best I can make out.

The court is secured by the Cook County Sheriff's office The judge ( I didn't hear his name or see his nameplate) convened the court early - at 13:24. (Courtroom 29 - I believe it was Felony court)

Sgt. McNulty was called at 13:33. Jay R. Grodner was a no show. The judge issued a bench warrant for Mr. Grodner @ 13:36.

Sgt. McNulty filed the complaint and raised his hand and swore that it was true.

I thought that was the end of it, so I got up to leave and waited in the waiting area for the Sgt. to come out.

A Marine PFC, in dress blues, cut & razor sharp, walked in to lend his support.

Sgt. McNulty and his entourage came out, then was called back into the courtroom for about 10 minutes.

He came back out to leave. I met them outside. I gave Sgt. McNulty FRegards and a Semper Fi and told him we have his back and that thousands have his back.

He thanked us for the support.

Jay Grodner (or a representative) must have showed up, as, when I talked with the Sgt.'s attorney, he said Grodner wanted a continuance to get an attorney.

The case was continued and will go to fruition and Sgt. McNulty wont have to re-appear.

From 'Lectric Law Library
BENCH WARRANT - An order issued by a judge for the attachement or arrest of a person. The name of a process sometimes given to an attachment issued by order of a court, against an individual for some contempt, or for the purpose of arresting a person accused; the latter is seldom granted unless when a true bill has been found.

If a person fails to appear in court when she has been properly ordered to do so, the judge is authorized to issue a warrant (a court order authorizing a law enforcement officer to arrest someone) for her arrest. A warrant issued this way is called a bench warrant.

#27  I am very pleased that this case can continue on with Sgt McNulty on his tour. The perp needs to be hammered by the very system that he has used to his nefarious ends.

I am also thrilled to see the groundswell of support on the ground support for this fine Sergeant. If a few examples are made of perps like this lawyer, they will change their behavior, not because it is right to do so, but because they will get hurt by their actions.

No billions for Paris Hilton - Grandpa to give away fortune to charity
Paris Hilton's grandfather and hotel magnate Barron Hilton has announced he will leave 97 per cent of his fortune to charity, which amounts to $2.3 billion. The Hilton hotel chain consists of more than 500 hotels around the world.

Family patriarch Barron Hilton is believed to be embarrassed and upset by his granddaughter's wild behaviour - notably when a compromising video of Paris Hilton was leaked on the Internet and by her 23-day prison sentence last month.

The money will go to the Conrad N Hilton Foundation, the charity set up in the name of the founder of the family business.

Duuude, the Man is, like, he's got a stash, man! The man is stoned!
When it comes to turning a blind eye to cannabis use in Europe’s most tolerant city, police in Amsterdam are demanding the right to practise what they preach. Officers in the capital of the Netherlands are in open revolt against a new code of behaviour that orders them to stop taking drugs in their free time.

The new rules, due to come in on January 1, have upset officers who patrol the city’s infamous coffee shops, where cannabis is smoked openly by locals and millions of tourists attracted by Amsterdam’s relaxed atmosphere.

It has been their duty for years to operate a policy of nonenforcement over the coffee shop culture. Now the police union will back its members in defying the cannabis ban. The union has vowed to bring a test case in court against the first officer to fall foul of the new rules, claiming that they amount to an unjustified intrusion into personal life. “Police should not be put in pigeonholes in which they can no longer be themselves,” said Hans van Duijn, the chairman of the Nederlandse Politie Bond, the police union. “If you allow people in the country to smoke [cannabis], you would be a hypocrite to say to the police officers, ‘You are not allowed to do that’.

“It is illegal by law but we allow it for everybody else just to use it in small amounts for themselves. There must be scope for using soft drugs.” . . .

#1  Noora, who had been lodged in the Lucknow District Jail, was being taken to court when four motorcycle-borne accomplices attacked the police escort vehicles on the Jail Road.

Your classic "shot while trying to escape". Anyone find a shutter gun lying around?
