#3 ...well some states (looking at you Texas) has a militia to back them up when the Guard is federalized.

Some states have enough former military who can volunteer for state militia duty. Mainly used for corridor and point defense. Just have to be sworn in to be covered by various public immunities as already addressed by SCOTUS. Report to your local sheriff.

Texas also has an informal militia. 1 Aug 1966 they were among the first to respond to Charles Whitman's shooting rampage from the Texas Tower.
