L.A. Unified says girl, 14, could consent to sex with teacher
[LATIMES] L.A. Unified [school district] officials are coming under fire for allowing their attorneys to argue that a 14-year-old student was mature enough to consent to sex with her middle school math teacher.
The age of consent in Caliphornia is 18. It's my understanding--and admittedly I'm getting old and my mind's going--that if you're under the age of consent you're considered not to have the capacity to understand the consequences of making whoopee without benefit of clergy. You also have to be 18 to marry in California, or else you need the consent of at least one parent, have counselling, and have the whole thing signed off on by a Superior Court judge.
The arguments were made in a civil case that was filed last year by the student, who was seeking financial compensation from the district. She said she suffered emotional trauma from a five-month sexual relationship nearly four years ago with her teacher at Edison Middle School in Los Angeles.
It's a civil case, for damages, not criminal, which should result in the adult involved getting tossed in the jug.
District officials, defending their legal strategy Thursday, said they needed to rebut the student's claim with evidence that she was a willing participant who had a prior history of sexual activity.
The "she's a slut" defense, the idea being that if everybody's had her then one more won't matter.
"While we are sympathetic of the pain that this type of inappropriate relationship could cause this young woman and her family, the case focused on whether the school district could have done anything to prevent it," L.A. Unified's attorney, W. Keith Wyatt, said in a statement. "Trying this case in a respectful manner, but one that allowed the jury to consider the full weight of the facts and evidence, was critical."
If you rape a whore it's still rape. I guess if you statutorily rape a slut it's still rape. The question isn't whether it was rape but whether the school district is responsible for it. It's my uninformed opinion that she should be suing the teacher, unless he had a history of getting after the young stuff and they kept him on.
But the actions in the case, first reported by KPCC, were blasted by legal experts.
"I'm a legal expert! Take that!"
"The belief that middle school children can consent to sexual activity is something one would expect to hear from pedophile advocates, not the second-largest school district in the U.S.," said John Manly, one of the attorneys representing plaintiffs in the Miramonte Elementary child abuse case.
I believe that's been the common law since the age of consent was first established.
That case, involving allegations that the district failed to supervise a teacher who allegedly fed semen-laced cookies to children, is set for trial this month.
Whoa! Major perv here. I can understand why the girl's torn up about it, even if she is a roundheels.
David M. Ring, an attorney who has specialized in sex abuse cases for 25 years, said he had never heard of anyone presenting the sexual history of a minor in court and called the action despicable.
It doesn't matter if it's not the first horse she rode; what matters is whether it threw her.

No "especially" about it. Her favorite teacher's no different from the guy back in the bushes offering her candy.
A jury last fall found L.A. Unified was not liable for damages in the case. District officials argued that school staff did not know of the abuse and that the eighth-grade teacher and student took pains to conceal their relationship until it was reported to a science teacher by the victim's friend. When notified, officials said, the district immediately removed the teacher, Elkis Hermida, from the classroom; he was subsequently convicted on criminal charges of lewd acts against a child and sentenced to three years in prison in 2011.
That sounds like a reasonable reaction from the school district. If you hide the crime you can't bitch when it takes a while to uncover it.
Holly Boyer, a Pasadena attorney who is appealing the case on behalf of the student, said witnesses testified that Hermida hugged students and that one teacher saw him lying on classroom desks texting with pupils present but acknowledged that she did not report any inappropriate sexual activity.
The fact that his behavior was inappropriate doesn't mean it was sexual. It sounds like nobody alerted the administrators to the guy until they got the funny-tasting cookies.
Boyer said the appeal will challenge the decision by Los Angeles County Superior Court Judge Lawrence Cho to allow the district to present evidence of the girl's prior sexual history, among other grounds.
She's under the age of consent, therefore chaste by definition.
Laurie Levenson, a Loyola Law School professor, said that it was a risky tactic to present evidence of a minor's sexual history and that many judges would have limited its use or barred it.
I think most people who've ever opened a law book would have barred it, but of course precedent doesn't mean much these days.
She also said that only a few California cases have indicated that minors might possibly be able to consent to sex with an adult and that the issue needed to be more clearly litigated.
California law is based on Common Law, but of course it's "evolved" a lot. It'll be another bit of evolution if the Learned Judges come to the conclusion it's okay to hump a 14-year-old.
She added, however, that the student in this case appeared to have "opened the door" to such evidence by seeking damages against the district for the teacher's actions.
It doesn't sound like she had much of a case to start with. The issue isn't whether Mr. Hermida was first in line, but whether the school district knew he got on board.
Manly called on the district to fire Wyatt and others responsible for the handling of the case. Wyatt, in remarks to KPCC that further stoked the outcry, said it was a more dangerous decision to cross a street with oncoming traffic than to have sex with a teacher.
Crossing the street with oncoming traffic won't give you herpes.
He issued an apology to the student and her family Thursday, saying that his remarks were "ill thought out and poorly articulated" and did not represent the district.
Dumbass.

[CSMONITOR] It was the biggest international astronomy story since the moon landing. Rosetta's lander was about to touch down on a comet hurtling through space. And while the world eagerly waited to hear if Philae managed to successfully land on 67P/Churyumov-Gerasimenko, Rosetta scientist Matt Taylor filled the eager populace in on the challenges involved in the monumental task.

And what did Dr. Taylor choose to wear for this historic occasion? Maybe a lab coat? Or perhaps a sharp button down? No, the voice of the Rosetta mission showed up in a loud bowling shirt that was not only garish, but was also slathered in buxom, leather-clad, anime babes. Women in the scientific and science writing community--many of whom have spent their careers attempting to shatter conceptions that women are not welcome in science--were less than amused.

"No no women are toooootally welcome in our community, just ask the dude in this shirt," tweeted The Atlantic's Rose Eveleth.
I wasn't aware that The Atlantic employed scientists, so I doubt if Rose actually has a dog in the show. Dr. Taylor wouldn't have had this problem had he showed up for work in a jacket and tie, as would have been expected of him twenty or thirty years ago.
Women have long been underrepresented in science and many of the historic contributions to science made by female researchers have frequently been minimized or misattributed to their male colleagues. In recent years, some have argued, most notably renowned economist and former president of Harvard University Larry Summers, that women are not equally represented in the sciences because they simply aren't interested in science. However, advocates of women in science have argued that girls and women are discouraged from pursuing science and when they do, they run into double standards, discrimination, and outright harassment.
There are more men than women employed in the hard sciences, but there are more men than women in hard science courses at the undergrad level. I've only worked for three places who routinely employed scientists--NASA and NIA and that other place--and never actually did a head count, but my impression was that what women were there were just as smart and just as respected as the men. I'd guesstimate the ratio as 60:40 men:women.

At NIA (National Institute on Ageing) I was particularly struck by the number of Russians, Chinese, and Europeans there were. Many were post-docs but they were well represented, both male and female, in the management chain. I presume that applies to the rest of NIH as well, though Doc Steve knows more about that than I do.

The other government agency I worked at was big on mathematicians and engineers and linguists. I don't remember the ratios--it was back in the Lower Paleolithic--but I do remember working with some pretty brilliant women, some of whom the agency went out of its way to recruit and train from scratch in its own schools.

My opinion on this whole episode: Doc Taylor shouldn't have come to work dressed like a slob, especially on a day when ten or fifteen years work, from idea to success, was being celebrated. And the women with no skin living in a sandpaper world should have been congratulating him to his face and quietly rolling their eyes at his lack of taste when they were chatting in the elevator or in their cubicles.

Beethoven's friends used to sneak into his room while he was asleep and steal the clothes he had been wearing for a few weeks, replacing them with new ones. But women outnumber men in schools of music, so I guess it's understandable. The only female composer I can think of off hand was Clara Schumann, and she wasn't all that much compared to Beethoven, to her husband Robert (whom she dumped), or to Wagner (her paramour). Her love life was a lot more interesting than her musical efforts.

At the semi-behest of Golf Bravo some time ago I included 9mm pistols in my used gun price analysis, including the Beretta 92FS semiautomatic. Now Arms of America, a company I have done business with, has used Berettas for sale. See here.

I found this video at Sipsey Street Irregulars. I had to Google a number of the acronyms and product names to fully understand it. It's still funny even if you don't understand it all. "You know what a stovepipe is? It's your rifle giving you the finger for using cheap ammo!"

The video does point out, in my mind, about the large numbers of AR rifles for sale at somewhat inflated prices. Think about your position. What would you do?

Back 18 months ago, you bought an AR15 rifle concluding you could make your money back and then some if you had to sell it. Fast forward to about seven months ago when AR-15 rifles prices collapsed. What do you do? One thing you can do is to adorn your rifle with new scopes and other add-ons in the hope of at least recovering some of your investment. Recall then that some AR-15 rifles were going for as much as $1,200, and now on average they are going for around $500, some as low as $350.

AR-15s and AR-10s are commodities. There are millions of rifles sold over the counter (and registered with the government) and an additional very large number built privately by individuals. All the internals are interchangeable, only the receivers are different. Leaving aside for the moment the massive requirements for governments such as the states of New York and Washington to record every transfer between every individual, how do you use such a system to rein in trade of a commodity? Does it even make economic sense anymore?

But, damn the cost and full derp ahead for New York state cops:

98-year-old Scotia vet dons uniform one last time
[DAILYGAZETTE] GLENVILLE, NY â World War II Veteran Justus Belfield gave his final salute on Veterans Day.

The proud 98-year-old was too weak to leave his bed at Baptist Health Nursing and Rehabilitation Center for the nursing home's veterans' parade and luncheon, but there was no doubt he was there in spirit.

In honor of the day, he asked to be dressed in his olive green Army uniform, which he'd worn for every patriotic occasion since he and his wife, Lillian, moved to Baptist several years ago.

Three-Year-Old Girl's Rapist Detained in Takhar
[Tolo News] Northern Takhar's provincial police detained three people in connection to rape of a three-year-old girl, said the Ministry of Interior (MoI).
It took three of them to overcome a toddler?
The MoI's media office in a statement said that the toddler was raped in Aqcha village of Rustaq district in Takhar province while she was playing outside.

The incident occurred on Monday when the child was kidnapped by three men and at about 6 p.m. on the same day she was found nude in a garden far from her home.

The provincial police said that the men are in custody of the police and are undergoing interrogations.

Two Children Raped in Takhar
[Tolo News] Two maidens of tender years, one 12-years-old and one only three, were kidnapped and raped in Takhar province in just the past week, local officials have confirmed.

The parents of the 12-year-old girl, who live in the Yangi Qala district, said their daughter was kidnapped by gunnies late at night six days ago, then taken somewhere and raped.

Police officials on Friday said they found the girl inside a forest near the Amu River. An arrest was made by NDS personnel and a man has reportedly confessed to the crime, and said he was high on drugs at the time. Officials said they are still in search of his collaborators.

"It was at night, the guy, who is known as Rohullah, came to my home and tortured my 12-year-old daughter and myself and threatened that two more gunnies were on the roof and they took away my daughter," the mother of the victim told TOLOnews.

The father of the girl called for swift justice. "We want him to be executed in public, we demand the president address our call for justice, and if our demands are not honored, I will burn myself alongside my ten children," the father of the raped girl said.

Just two days before, it was released that three men brutally raped a three-year-old girl in the same province. The doctors who are treating the infant have said the men tried to kill her after sexually abusing her. "The criminal apparently wanted to kill the girl after raping her and there is signs of suffocation around her neck," the doctor said.

The horrendous crime has caused a backlash in the community, and the Police Chief has called for justice. "As Takhar police chief, I call on the legal and judicial institutions of the country to give a tough penalty to the perpetrators behind the crime and order their execution," Takhar Police Chief Abdul Hanan Qataghani said.

the Afghanistan Independent Human Rights Commission (AIHRC) continues to express major concerns about the state of women's rights in the country. Violence against women is on the rise, and so far, just this year, 200 cases of violence against women and sexual abuse of children have been reported in Takhar.

Russia to create 'alternative' version of Wikipedia
[Iran Press TV] Russia has announced plans to create an "alternative" version of Wikipedia to ensure the access of its citizens to more detailed and reliable information about their country.

In a statement issued on Friday, the Russian presidential library said it has commenced cooperation with the country's National Library to develop an online encyclopedia, which will act as an "alternative to Wikipedia."

"Analysis of this resource showed that it is not capable of providing information about the region and life of the country in a detailed or sufficient way," said the statement.

It added that 50,000 books and archive documents from 27 different libraries around the country had already been collected for the process of establishing the alternative encyclopedia.

Alexandr Vershinin, head of the presidential library, said a virtual museum will also be included in the project, which will display regional developments across Russia, while retaining Wikipedia's open editing feature.

Wikipedia is a free-access online encyclopedia assembled and written by Internet users around the world.

#4  I'm surprised China and Russia don't develop an alternate internet. Allow other nations to join if they want. No connection (or closely guarded) connection to the original internet so that noone can mistake across any info the leadership doesn't want them to come across.

Romanian protesters call for fair run-off election
[Iran Press TV] Thousands of people have taken to the streets in a number of cities across Romania to call for a fair election two days before a presidential run-off vote in the country.

On Friday, the demonstrators staged anti-government rallies in the Romanian cities, including the capital Bucharest as well as Cluj, Timisoara, Sibiu and Brasov, over possible voting limitations for their compatriots living abroad in the election slated to be held this weekend.

Protesters carried banners that read, "We care," or "Vote with your head, not your stomach."

Many of the Romanians living abroad reportedly were unable to cast their ballots during the first round of the election on November 2 due to long queues and bureaucratic hurdles at the country's embassies across the European Union

and some other countries.

Thousands in Romania held protest rallies following the first round of the vote, forcing Foreign Minister Titus Corlatean to step down on November 10.

Bucharest has tried to solve the problems in the first round by increasing the number of voting booths and staff abroad in the November 16 run-off, but it has not responded to requests to increase the number of polling stations.

According to estimates, up to four million Romanians live abroad, with only a fraction of them voting in elections.

According to data released after the November 2 poll, some 46 percent of the 160,056 Romanians who voted in foreign countries supported Klaus Iohannis, an ethnic German mayor backed by two center-right parties, while only 16 percent voted for Victor Ponta, the country's Social Democrats premier.

Sweden says it has proof of submarine incursion
[EURONEWS] Sweden says it has proof that a submarine was operating in its waters illegally, but has not identified which country was behind the intrusion in October.
Best proof would be a big piece of the conning tower with the boat's number, but I'm notoriously hard to convince on these things...
"The intelligence operation conducted in the Stockholm archipelago has used all of the available assets that we have in the Royal Navy. It is a different kind of census â on the surface and on the ground...We have a confirmation that there has been a smaller submarine in the archipelago," Sverker Goransson, Supreme Commander of the Swedish Armed Forces announced.

Prime Minister Stefan Lofven warned against any further incursions.

"The Defense Forces have not been able to identify the nationality, but still, it is a very, very serious report when it is one of anybody having entered our territory illegally."

The incident triggered the country's largest military mobilisation since the Cold War.

With increasing tensions between Europe and Russia over the crisis in Ukraine, many pointed to a Kremlin vessel lurking beneath Swedish waters, though Moscow has denied any involvement in the incident.

US white supremacist group threatens Ferguson protesters with 'lethal force'
[Iran Press TV] The American white supremacist group of Ku Klux Klan has threatened protesters in the US city of Ferguson with "lethal force" should their demonstrations become violent.

Members of a Missouri-based branch of Klu Klux Klan on Thursday handed out some threatening fliers around St. Louis County.

"You have awakened a sleeping giant," said one of the fliers.

"The good people of St. Louis County of all races, colors and creeds will not tolerate your threats of violence against our coppers, their families and our communities."

The warning comes ahead of a grand jury decision over the fatal shooting death of unarmed black teenager Michael Brown by white police officer Darren Wilson.

Traditionalist American Knights of the KKK head Frank Ancona said on Wednesday that he has received hundreds of phone calls from people concerned about "random attacks on whites, D.C. sniper-style shootings."

He added that the fliers would educate people on what rights they legally have to use lethal force in self defense.

#7  When I was a child my father and I were going to a rural water tower for water after our well went dry at the farm. It was night time and as we pulled into the drive way to the tower, under the tower there were numerous torches and people in white robes. Even though we were white, he immediately backed out of the driveway and delayed the water run for another day.

Fast forward to a few weeks after the Rodney King LA Riots. In our part of the country in the south blacks decided to announce they were going to pull an LA style riot in response to an incident. I told two African American guys who shared a cubical who were saying they were going, that it was best they didn't, because if any thing hits the fan, that area is not LA. They will get shot. The Klan announced they would be lurking in the shadows. The protest turned out to be very peaceful.
