[NYPOST] The left is determined to bring down Elon Musk for championing free speech, but he’s fighting back — and throwing badly needed sunlight on his foes’ shady tactics.
Good for him. And Americans generally.
On Monday, the X owner filed the "thermonuclear" lawsuit he’d threatened against the left-leaning advocacy group Media Matters.
In full Media Matters for America (MMFA), it’s yet another project of the plot to remake the world to George Soros’ specifications.
His suit charges the group with "maliciously" and misleadingly depicting major-company ads appearing on the platform next to pro-Nazi and white-supremacist posts "as if they were what typical X users experience on the platform."
Media Matters stands by its "reporting," but if the lawsuit’s charges are true (and they sure seem plausible), then this group has stooped to a new low: intentionally misleading companies to think the platform is so rife with ugly content that their ads are sure to appear near such posts.
Per the suit, Media Matters created its report by intentionally bypassing X’s safeguards against such posts, creating accounts that "exclusively followed" accounts owned by big-name advertisers plus "a small subset of users" who are "known to produce extreme, fringe content."
It then "resorted to endlessly scrolling and refreshing" until it got the results it wanted: "controversial content next to X’s largest advertisers," which it screenshotted and used in its "reporting" on X.
The group revealed none of this shady, behind-the-scenes book-cooking, but Musk and X have the tools to expose it — tools the public lacks.
Indeed, the average person often has no idea why they’ve been "canceled" or thrown in social-media prison, let alone how an activist group might distort what appears on social media.
Yet Musk has been pulling back the curtain on platforms’ underhanded tactics, as when he released the Twitter files.
That’s let Americans see how government officials collude with left-leaning social media to censor disfavored speech — such as when pre-Musk Twitter and Facebook squelched The Post’s scoop on Hunter Biden’s laptop to protect Joe The Big Guy Biden ...46th president of the U.S. The very model of probity.... before the 2020 election.
You may not like Media Matters for what reasons ever, but the lawsuit is frivolous and has no merit. (And Elon knows this or he wouldn't have gone judge shopping in Texas).
I tested this myself immediately after Media Matter broke the story.
Just by entering #HeilHitler in the search box, I immediately got an ad of one of the "major companies" Media Matter mentions (you need to be careful here obviously). I tried again several times, and then an ad of the German government came up.
Champion of Free Speech? Are you kidding me? Is he going to sue me now?

I'm not so sure - plenty of states have laws against deceptive advertising / business practices. I know H & R Block gets sued nearly every year by at least one state Attorney General for that very thing. Maybe that's why Musk brought suit there (add in the facts that both Tesla and SpaceX are now Texas companies).

Not so fast, EC. I read the complaint, and if the facts are as stated, Elon/X have prima facie cases for tortuous interference and defamation. (IANAL, but spent enough time in senior management to have some idea of how this works...)
If this ends up in court, discovery will be lots of fun - for X. They are least semi-transparent through publishing their placement algorithms. MM has been entirely opaque, and X has plenty of reason - again, assuming the allegations prove out - to be given access to search for proof of malice on MM's part.

I'm no lawyer. I have no opinion on the merits of Musk's suit. But I can tell you as soon as I heard Nora O'Donnell on CBS news last week breaking this story that it was a hit job. O'Donnell and her ilk hate Musk because he doesn't censor X the way her bosses censor and slant the news on CBS. If she had any pride she would have left CBS a long time ago and tried to find honest work somewhere...anywhere would be better than CBS. This whole story is yet another left wing hoax.

Media Matters is a Soros operation top to bottom. Their job is to fight anti-Semitism.
Maybe if you find yourself posting hate propaganda against them, you're on the wrong side. Say, who are the good guys in the current Israel-Hamas war?
Tortuous interference? I don't know how MM did it (and I bet Musk doesn't know either) but I could REPRODUCE the results.
I put "#HeilHitler in the search box. Of course Nazi posts (and accounts) came up, and next to them an ad of one of those companies, then an ad of the German gov. And you bet I didn't do anything "tortuous". No shady tactics here.

The Left routinely uses this tactic to take platforms offline. Gateway Pundit and many other right leaning sites have had problems in the Comment Sections by the Brigades of Lefties that invade and start posting their anti-gay slurs, racist black pics, and their anti-semitism troupes - then they report their comments as hate speech.
They do this stuff all the time. It is calculated. That's one reason why it needs to be defeated. Give them an inch and they will exploit it at our detriment.
Half decade ago The_Donald over at Reddit was nuked by this exact tactic. This is part of their playbook. And considering we on the right dont have much protections and the protections we do have increasingly thin, maybe we need 1000 more frivolous lawsuits.

[Daily Mail, where America gets its news] Congress is demanding answers from the Biden administration about a secret spying program that tracks more than a trillion phone records from innocent and unsuspecting Americans each year.
The under-the-radar system, known as Data Analytical Services or 'Hemisphere,' has been in operation for over a decade. It allows federal, state, and local law enforcement agencies to tap into the phone records of U.S. citizens who have not been accused of any crime.
Under the Hemisphere program the White House Office of National Drug Control Policy (ONDCP) pays phone service provider AT&T to hand over phone records as far back as 1987.
The deal first came to light in 2013 after a bombshell New York Times report, but it has since been expanded.

Sen. Ron Wyden, D-Ore., has now written to the Department of Justice (DOJ) demanding documents related to the Hemisphere program be made public and raising 'serious concerns' about its legality.
According to the letter, Wyden received 'sensitive' information about the program from the DOJ - allowing him to view it but not share it with the wider public.
The senator said the 'troubling information' he'd learned about the program 'would justifiably outrage many Americans and other members of Congress.'
Republican congressman Andy Biggs, Ariz., accused the government of spying on Americans.
Hemisphere is 'invasive' and allows 'government agents warrantless access to trillions of Americans' domestic communications records,' he said.
Biggs went on: 'The federal government doesn’t care about your privacy and it’s long past time we end these abuses and hold rogue actors accountable.
'The Hemisphere Project highlights major loopholes in federal law through which the government is able to spy on Americans without judicial oversight, such as the purchase of personal data.'
Congress is currently considering renewal of the Foreign Intelligence Surveillance Act's Section 702.
That allows for warrantless surveillance of foreigners but often catches the conversations of Americans.
Biggs said it must also look at the Hemisphere program.

[NYPOST] House Republicans are investigating a leaked glossary of Diversity, Equity and Inclusion (DEI) terms passed around the National Security Agency, which they say provides a “deeply troubling” look into the “hiring and contracting processes” of the intelligence organization.
Reps. Mike Waltz (R-Fla.) and Jim Banks (R-Ind.) wrote in a Tuesday letter to NSA Director Paul Nakasone that the glossary includes “incoherent” definitions of terms concerning gender, race and capitalism that could “harm national security.”
The lawmakers are asking for information about who disseminated the glossary, whether that employee has been disciplined and when it was removed from circulation.
“We understand NSA believes that an employee posted this glossary to an internal server without authorization and [it] was taken down once it was discovered,” they wrote.
“As a whole, it prompts these and other questions that as members of the House Armed Services Committee and Permanent Select Committee on Intelligence we need answered in order to conduct oversight and ensure NSA is focused on countering threats to US interests.”
The glossary includes well-known social justice terms like “white fragility” and “settler colonialism,” as well as endorsements of critical race theory as promoted by authors Robin DiAngelo and Ibram X. Kendi, according to a copy first published and reported on by the Daily Wire last week.
Waltz as a member of the House Intelligence Committee was able to verify the document’s authenticity.
