#2 Judge Emmett Sullivan was successful in keeping this case on life support until after the election and the election was such a cock-up that Trump feels the need to pardon Flynn before Biden gets into the White House. If Biden is ever actually inaugurated, he will redouble DOJ efforts to put Flynn in jail. Trump should wait, though, until after all of his legal options are exhausted because it would be better for Flynn to be acquitted than pardoned.
